2. Description of the Action Being Approved: This is a sole source Firm, Fixed-Price (FFP) type contract to Derse to fulfill the requirements directed by NSTC RTC for temporary partitions to be installed in the RTC Drill Hall.
3. Description of Supplies/Services: The scope of this requirement is to provide and install prefabricated partitions needed to convert the RTC Drill Hall into temporary living quarters in response to the Coronavirus (COVID-19) Pandemic. Sailors must lodge in single occupancy rooms in order to follow Center for Disease Control (CDC) guidance of COVID-19. The required final installation date is
01 July 2020.

Unusual and Compelling Urgency, as implemented by FAR 6.302-2.
5. Rationale Justifying Use of Cited Statutory Authority: The support to be provided under the authority requested by this J&A is critical and necessary in order for the Navy to adhere to CDC and
DoN policies established due to the COVID-19 outbreak. Constant vigilance for potential exposure of recruits to COVID-19 together with aggressive sequestration of exposed personnel and (when appropriate) quarantine of symptomatic personnel will be the core tenets of an effective response.
Therefore, it is in the best interest to meet the guidelines of social distancing to provide adequate lodging to help prevent the spread of COVID-19. The requirement to immediately award this contract and thus to come into compliance with CDC guidelines is urgently needed to mitigate risk to the hundreds of recruits. Due to upcoming increases in the number of recruits that are reporting to the RTC, it is required that all partitions be installed no later than 01 July 2020, which requires that award be made no later than
05 June 2020 to allow for adequate installation time. Based on the dollar value of the requirement and the required timeframe, in combination with the COVID-19 outbreak, it was determined that the need for the supplies is of an urgent and compelling nature. Additionally, due to the impact on the health of the sailors, it is determined that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits quotes. It is in the government’s best interest to issue a sole source award to Derse.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable:
The required supplies in the proposed acquisition will be used to establish safe housing for recruits upon arrival at the RTC. As stated above, due to the urgent and compelling nature of the supplies and the compressed timeframe, there is not adequate time to solicit the requirement competitively. Market research was conducted by the requiring activity and FLCN, to include internet searches and review of similar requirements, to identify capable sources. It was through this research that Derse was identified as a capable and interested source. While other companies may exist in the market place that could also satisfy the requirement, Derse has been confirmed to be able to meet the requirement to include the expedited installation timeframe. If award is not made to Derse and the requirement is competed, adequate time may not exist to solicit and award prior to 5 June 2020. Therefore, installation of the partitions may not occur by the required date and could result in unacceptable and dangerous living quarters for the recruits. Thus, in accordance with:
FAR 5.202(a)(2): a synopsis will not be posted to the GPE because the proposed contract action is made under the conditions described in 6.302-2 and the Government would be seriously injured if the agency complies with the time periods specified in 5.203;
NOTE: The proposed acquisition is a new requirement; and therefore, a sources sought synopsis is not required.
7. Determination of Fair and Reasonable Cost: A determination of fair and reasonableness of price will be based on the Contracting Officer’s price analysis of the contractor’s proposal and/or a comparison of previous pricing history and published price list of the same or similar items in accordance with FAR 13.106-3.
8. Actions to Remove Barriers to Future Competition: As stated herein, Derse is the only contractor identified with the capability to immediately provide support of the required supplies without a negative impact to the Navy.
