About this file

This document is the Texas Department of Criminal Justice (TDCJ) Required Contract Clauses exhibit for a solicitation related to HVAC system installation at the Lopez Unit in Edinburg, Texas. The file establishes mandatory representations, certifications, and warranties that all respondents must affirm as conditions of contract award, including compliance with state and federal regulations. The contract involves the replacement and installation of new HVAC systems in inmate housing facilities. While specific pricing, quantities, response dates, and contract duration are not detailed in this clauses document, respondents must acknowledge their understanding that performance will be tracked through the Texas Comptroller's Vendor Performance Tracking System and that contracts are subject to termination based on legislative appropriations and availability of state funds.

The clauses impose extensive compliance requirements on respondents, including verification of non-debarment status, E-Verify participation for all personnel working in Texas, cybersecurity training completion, and certifications regarding child support obligations, human trafficking, and various boycott prohibitions. Respondents must disclose any artificial intelligence systems used in contract performance, prior legal or governmental actions, and any employees with prior state service. Additionally, respondents assume full indemnification and intellectual property liability obligations, must comply with the Texas Public Information Act, and cannot assign contract rights without prior written TDCJ approval. Failure to complete, sign, and submit the required certifications will result in disqualification of the response.
