PART II – ATTACHMENT B – PERFORMANCE WORK STATEMENT (PWS)
1. TITLE OF PROJECT:
Communication Access Real-Time Translation (CART) support services for the USCIS RAIO Directorate.
2. BACKGROUND:
USCIS is the agency under DHS that is responsible for providing immigration benefits through a variety of USCIS offices located through the United States and international locations. The OEOI develops and delivers quality programs and services to ensure equal employment opportunity, promote and sustain a diverse workforce, and foster workplace accessibility and inclusion through the utilization of data-driven, strategic, and collaborative approaches.
USCIS’s mission is to uphold America’s promise as a nation of welcome and possibility with fairness, integrity, and respect for all we serve. OEOI supports the USCIS mission by:
Maintaining an efficient, fair, and impartial EEO complaint resolution process;
Promoting inclusion and diversity at all levels of the organization through workforce analysis and barrier elimination/mitigation; and
Providing an effective disability accommodation program to ensure that individuals with disabilities receive full access to equal employment opportunity.
The RAIO Directorate has a Fraud Detection & National Security (FDNS) employee in its program that is deaf and requires use of real-time captioning and translation services for formal and informal meetings, which occur at the Unclassified, Classified National Security Information at the Confidential (C), Secret (S), Top Secret (TS)and Sensitive Compartmentalized Information (SCI) national security levels. The contractor shall provide CART reporting services to the deaf employee for all oral communication needs, thereby allowing the employee to fully participate in work-related activities.
3. SCOPE OF WORK:
The contractor shall perform CART services to USCIS Federal employee(s) during formal and informal meetings, classroom and virtual trainings, seminars, conferences, conference calls, and other events as required, which may be physically on-site, remote, or virtual. The USCIS deaf employee(s) full participation is required in interactive conversations with other employees, as well as the employee(s) delivery of oral presentations to their colleagues and agency leadership, which will occur during these meetings.
During these events, the contractor CART reporter must rapidly transcribe obscure and complex terminology to the employee who attends unclassified or classified meetings where For Official Use Only (FOUO), Secret (S), Confidential and/or TS/SCI will be communicated. For unclassified events, the contractor’s employee will need to perform CART reporting services and provide their own laptop and transcription equipment.
During classified meetings, the CART reporter must use the authorized/accredited Government Furnished Equipment (GFE) instead of their own transcription equipment.
4. OBJECTIVE:
The contractor shall provide onsite and virtual CART captioning services on a reoccurring and as-needed basis for hard of hearing or deaf employee(s) at the RAIO. These services may be used during onsite or virtual team meetings, town halls, and facility presentations, or other events as required. It is possible for some events to take place after normal business hours and on weekends. Scheduled meetings, trainings, and town halls are crucial for the USCIS employees to attend, and it is imperative that CART services are received; if a scheduled CART reporter cannot meet the required timeframes, a qualified replacement CART reporter shall be made available.
5 70SBUR22Q00000242
5. APPLICABLE DOCUMENTS:
Title I of the Americans with Disabilities Act of 1990 (ADA), the ADA Amendments Act of 2008, Section 501 of 1973, and The Genetic Information Nondiscrimination Act of 2008 (GINA), all which can be located at the following website:
http://www.eeoc.gov/.
6. SPECIFIC TASKS/REQUIREMENTS:
The contractor shall provide services in accordance with these requirements:
a) The contractor shall provide classified and unclassified CART reporting services. Classified services will be at any of the three (3) levels of security classification Confidential, Secret, and Top Secret/SCI. Services will be performed during formal and informal meetings, classroom and virtually based trainings, seminars, conferences, conference calls, and other events as required to facilitate the employee’s full participation and involvement in conversation and communication. Classified information will not be accessed virtually.
b) In-person CART services are needed on a regular and ad-hoc basis for the following schedule:
Services will typically be requested on Tuesdays and Thursdays from 9:00am - 12:00pm and 1:00pm – 4:00pm ET.
(generally fourteen (14) hours a week or 728 hours a year)
If hours exceed 728 hours per Period of Performance (POP) for RAIO, an unfunded optional increase Contract Line Item Number (CLIN) will be exercised for an additional 208 hours per POP in accordance with Federal Acquisition Regulation (FAR) 52.217-7. This CLIN will be on an ad-hoc/as needed basis, generally sixteen (16) hours per month or 208 hours per POP.
If the time for the regularly scheduled meetings needs to be changed, the Government will notify the contractor five (5) business days in advance without incurring added fees.
c) Virtual services may not be provided in-lieu of requested in-person services unless approved in advance by the Contracting Officer’s Representative (COR) and on-site Points of Contact (POC). Virtual services in-lieu of in-person services may be requested by USCIS at its discretion.
d) Virtual services will be provided via approved USCIS virtual conferencing software. USCIS will provide publicly accessible links for the contractor to connect to USCIS-hosted meetings. The contractor will be required to have ability to connect to USCIS-hosted meetings. Meetings will be joinable through browser-based or free downloadable applications (e.g., Microsoft Teams, WebEx, Adobe Connect, or other USCIS-approved software).
e) CART services may be required on an ad-hoc/as-needed basis to provide live or recorded captioning service for presentations, ceremonies, webinar conference/training, announcements, or other events. Most events are 60 minutes long and some may exceed 60 minutes.
Captioning of live and recorded videos is required to ensure compliance with Section 508 of the Rehabilitation Act of 1973. Content may be accessed by a wide audience within USCIS.
Captioning of video must be completed within ten (10) business days.
Due to the sensitivity of content, captioning service may be required to be performed on-site at the USCIS facility.
Virtual captioning may be requested at the sole discretion of USCIS.
If required on-site, upon arrival at the USCIS facility, the on-site POC shall brief the interpreter of the required captioning need. The interpreter will be provided with a standalone laptop that is not connected to the USCIS network. The laptop is preloaded with the video needing captioning. The interpreter shall return the laptop to the on-site POC before leaving the site.

The USCIS deaf employee(s) may ask for a copy of the draft transcript at any time prior to the contractor leaving the facility, including before, during, or after a meeting. If a draft transcript is requested before, during, or directly after a meeting, the contractor shall provide the draft transcript to the employee no later than fifteen (15) minutes after the conclusion of the meeting. The draft transcript will be for the employee’s use and will not be shared beyond the business needs of the agency. It is understood that the transcript will be unedited and in draft form and, as such, the transcript may include errors and/or typos.
When the assigned CART reporter is unable to provide the scheduled services due to unforeseen circumstances, the contractor shall notify USCIS at least three (3) hours prior to the expected arrival time.
For remote captioning services for unclassified meetings, the contractor shall log into the assigned connection platform (e.g. Skype, WebEx, Adobe Connect, VTC, Microsoft Teams, or conference call, etc.) prior to the start of the meeting to allow for adequate time to confirm an effective audio connection, which is standard procedure. The contractor must provide the captioning link two (2) hours in advance, and, for back-to-back meetings, be prepared to have multiple links as needed. If there are technical difficulties preventing services, this must be identified prior to the start of the session and the reporter must notify the USCIS employee, the COR and the contractor with sufficient time to identify a back-up CART reporter for the meeting.
For on-site captioning services, the CART reporter(s) must report to the assigned physical location within the facility prior to the scheduled service time to allow adequate time to be processed through federal building security, to be escorted to the meeting room, and to setup equipment and test connections so that transcription can begin at the scheduled start time of the meeting or training session, which is standard procedure. If there are technical difficulties preventing services, this must be identified prior to the start of the session and the reporter must notify the USCIS employee, the COR and the contractor with sufficient time to try to identify a back-up CART reporter for the meeting.
If an event is cancelled or ends early, on the date of the scheduled service, the contractor employee shall remain available for the deaf employee for the remainder of the scheduled time. The contractor employee may be given another appropriate assignment, if needed, by the COR.
Any information made available to the contractor by the Government shall be marked FOUO and used exclusively for the purpose of carrying out the provisions of this contract. Information shall not be divulged or made known in any manner to any persons except as may be necessary in the performance of the contract. f) Requests for services made with less than five (5) business days’ notice may be subject to late notice fees.
g) Any cancelation less than forty-eight (48) hours from the start of the requested service will result in a cancellation fee owed to the contractor.
h) Requests for transcription services may be made within twenty-four (24) hours’ notice. Ad-hoc services shall be requested in two (2) hour increments for the base request and then thirty (30) minute increments thereafter.
i) A working lunch will be payable when verified by the USCIS employee as well as the Contractor employee. A working lunch is defined as the USCIS employee using interpreter services during their 30-minute lunch break, verified by USCIS supervisors or management that the interpretation services were required, and to the benefit of the Government.
j) The contractor is required to notify the Government in writing when 85% of each Contract Line-Item Number (CLIN) has been expended. Any work hours worked by the contractor above the ceiling value of the award shall not be reimbursed by the Government.

19.2 CONTRACTOR DEFICIENCY REPORTS:
When the contractor’s performance is unsatisfactory, the CO will issue a Contract Deficiency Report (CDR) to the contractor. The contractor shall reply to the CO in writing within fifteen (15) calendar days of notification and in accordance with instructions contained therein, giving the reasons for the unsatisfactory performance, corrective action taken, and procedures to preclude recurrence.
19.3 PERFORMANCE REQUIREMENTS SUMMARY:
PERFORMANCE STANDARDS:
This Purchase Order includes a PRS. The PRS plays an integral role in the administration of the order. In addition to any applicable inspection clauses or other related terms and conditions contained in the order, the PRS shall serve as a primary tool for inspection and acceptance of services as facilitated by the COR. Evaluation of the contractor’s overall performance shall be in accordance with the performance standards set forth in the PRS, and will be conducted by the COR. The PRS constitutes a material aspect of the order and will not be changed or otherwise modified without prior written approval of the CO.
Performance standards define desired services. The Government performs surveillance to determine if the contractor exceeds, meets or does not meet those standards. The PRS, of the PWS, includes performance standards. The Government shall use these standards to determine contractor performance and shall compare contractor performance to the stated Acceptable Quality Level (AQL).
The PRS tables below sets forth the expected requirements of the Purchase Order. The PRS is not an exclusive remedy and inclusion of the PRS does not preclude the Government from using any other remedy available by law or contract terms, including reductions in payment in accordance with any clause for inspection of services. Changes to the standards will be made by bi-lateral agreement.
