About this file

This is a disclaimer document issued by the Texas Department of Criminal Justice (TDCJ) regarding the procurement of an OPIS Wholesale Rack Report Subscription. The document serves as a legal notice clarifying TDCJ's position and limitations concerning the bidding process and contract award. The disclaimer establishes that TDCJ is not responsible for certain aspects of the procurement, including vendor communications, system access issues, or technical difficulties that may arise during the bidding period. The document outlines the agency's right to modify, suspend, or cancel the procurement at its sole discretion and specifies that participating vendors acknowledge and accept these terms by submitting a bid response.

The disclaimer emphasizes that TDCJ makes no warranties regarding the accuracy, completeness, or availability of procurement-related information and materials provided to bidders. It further clarifies that the agency is not obligated to accept any bid, award a contract to the lowest bidder, or provide explanations for its procurement decisions. The document protects TDCJ from liability related to bidder reliance on provided information and establishes that submission of a bid constitutes acceptance of all stated terms and conditions contained within the disclaimer and solicitation documents.
