FEDERAL BUREAU OF INVESTIGATION

JUSTIFICATION FOR OTHER THAN FULL AND OPEN

COMPETITION

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION IN ACCORDANCE WITH 10 U.S.C.

2304 (C)(1)

Requisition Number: DJF-18-1200-PR-0003025

Date: 2 August 2018

Estimated Contract Dollar Value: $415,500.00

1. Identification of the agency and contracting activity.

The U.S. Department of Justice, Federal Bureau of Investigation, Information Technology

Acquisition Unit (ITAU), has prepared this justification for other than full and open competition for In2itive software term licenses and training and implementation services on behalf of the

Office of the Chief Information Officer (OCIO).

2. The nature and/or description of the action being approved, i.e., sole source, limited competition, establishment of a new source, etc.

The FBI anticipates the issuance of a one year Firm-Fixed Price contract to In2itive, LLC for the acquisition of Enterprise Architecture, Portfolio Management, and Technology Business

Management software term licenses, and associated implementation services, Tier 2 telephonic technical support, and user training.

3. A description of the supplies or services required to meet the agency’s needs.

The FBI has been using In2itive software since 2017 and requires the renewal of software, as well as additional licenses, support services, and training. The requirement is to provide the

FBI’s OCIO, Finance Division (FD), and IT Branch (ITB) with In2itive’s three primary products of Enterprise Architecture, Portfolio Management, and Technology Business Management software, including implementation services, telephonic Tier 2 technical support, and end-user training. The three products provide the following functions:

1. Enterprise Architecture – provides developing and collaborating on the artifacts & architectural models that help communicate the desired changes with the enterprise needed to achieve the strategic vision.

2. Portfolio Management - works on defining and managing portfolios of IT resources across the enterprise.

3. Technology Business Management – applies Technology Business Management (TBM) methodologies in support of investment planning & decision making across a large scale enterprise.

The FBI OCIO has a one-year term license agreement, and this contract expands to the anticipated full primary user community of approximately 35 individuals within the OCIO, FD, and ITB organizations.

The requirements include software term licenses, implementation services, telephonic tier 2 support and training classes.

4. The statutory authority permitting other than full and open competition.

The statutory authority permitting other than full and open competition is 41 U.S.C.253(c)(1) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1entitled, “Only One

Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.”

5. Demonstrate the unique qualifications of the proposed contractor or the nature of the action requiring the use of the authority.

The FBI OCIO requires three critical IT management and analytical oversight functions -

Enterprise Architecture (EA), Portfolio Management (PFM), and Technology Business

Management (TBM) – to be conducted on behalf of the FBI on an integrated basis. Key capabilities include:

Customizable software to provide accurate data for enterprise architecture strategies;

portfolio management strategies for software/hardware management and, IT acquisition processes; and technology business lifecycle management

The ability to provide data reporting, perform accurate budget forecasting, and informative dashboards for executive and division management

Support for frameworks, taxonomies, and ontologies including:

o Technology Business Model (TBM), o Federal Enterprise Architecture (FEA), o Department of Defense Architecture Framework (DoDAF), o Open Group Architecture Framework (TOGAF), o Integrated Computer Aided Manufacturing Definition for Function Modeling

(IDEF0),

o Business Process Model Notation (BPMN) o Interchangeably develop views and reports based on TBM, FEA, or DoDAF

As explained in Paragraph 8, market research determined that only In2itive can currently provide the three functions of EA, PFM, and TBM in one integrated software suite. Other

Requisition Number: DJF-18-1200-PR-0003025 Version 1.0 Page 3 of 5 vendors can only provide one of the three functions as standalone capabilities, but not all three together.

6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies.

An announcement will be posted on FedBizOps.

7. The anticipated dollar value of the proposed acquisition, including options if applicable, and a determination by the Contracting Officer that the anticipated cost to the

Government will be fair and reasonable.

The anticipated dollar value totals $415,500.00. The Contracting Officer (CO) will perform a price analysis to reach the determination that the pricing proposed is fair and reasonable. Data at the disposal of the CO, such as a corporate commercial price list and previous acquisition history will be tools utilized to determine fair and reasonable pricing.

8. A description of the market research conducted and the results.

Market research identified potential vendors which have at least one of the three EA, PFM, and TBM functions. In2itive was assessed to be the only vendor that could provide the three functions in one software product suite to provide the critical capabilities described in paragraph 5 above.

9. Any other facts supporting the use of other than full and open competition.

There are three critical reasons performing the three functions together is of great value to the

FBI OCIO:

The OCIO oversees an annual IT budget in excess of $1.5 billion, and managing the associated integrated details of EA, PFM, and TBM in a logical and coherent manner has a high intrinsic value to the executive management that requires supporting integrated information and supporting details to make more effective and efficient decisions and implementation plans.

The alternative cost of buying software from each of three vendors, inclusive of conducting the software development to integrate three vendor products would far exceed the cost of buying an integrated software product suite.

The time to develop the integration of three separate vendor products would delay the implementation of capability to conduct the three functions on an integrated basis.

Furthermore, only In2itive is authorized to provide implementation services for its software products, telephonic Tier 2 technical support, and certified training classes.

10. A listing of any sources that expressed a written interest in the acquisition.

Since the procurement was not advertised, no other companies have expressed an interest either orally or in writing.

11. A statement of any actions the agency may take to remove or overcome any barriers to competition, if subsequent acquisitions are anticipated.

The OCIO will continue to consider current products and always ensure competition to the greatest extent practical.
