About this file

This is a Bid Advertisement issued by Durham Public Schools (DPS) in North Carolina for a comprehensive life-safety compliance project targeting non-sprinklered elementary schools. DPS seeks a qualified contractor to inspect, inventory, document, report on, and perform limited repairs to fire-rated life safety systems across 20 facilities divided into two concurrent increments of 10 schools each. The scope of work encompasses fire-rated doors, smoke-rated doors, fire and smoke dampers, firestop systems, penetration seals, and other fire-resistance-rated barrier assemblies. The project is structured to run both increments simultaneously to maximize the district's response to safety-related repairs. The advertisement includes response deadlines, submission requirements, and notice of a pre-bid meeting or site visit opportunity for interested contractors to familiarize themselves with project conditions and specifications.

The project represents a critical infrastructure safety initiative for DPS to establish baseline compliance documentation and remediation across its elementary school portfolio. Pricing will be structured according to the bid specifications, and the contract may include provisions for phased implementation across the two increments. Contractors must demonstrate qualifications in life-safety systems inspection and repair, with particular expertise in fire-rated assemblies and compliance documentation. The concurrent execution of both increments indicates DPS's prioritization of expedited safety improvements, and bidders should be prepared to mobilize resources adequate to support parallel work across multiple facilities.

3.0 METHOD OF AWARD AND PROPOSAL EVALUATION PROCESS PROPOSAL

REVIEW AND AWARD

It is the intent of Durham Public Schools to award this RFP to the responsible bidder(s) who best matches the needs of Durham Public Schools. Durham Public Schools reserves the right to reject any and all bids. All qualified proposals will be evaluated, and awards will be made to the Vendor(s) meeting the RFP requirements and achieving the highest and best final evaluation.

While it is the intent of Durham Public Schools to award this RFP to a single Vendor, Durham Public Schools reserves the right to make separate awards to different Vendors for one or more line items, to not award one or more line items, or to cancel this RFP in its entirety without awarding a contract, if it is considered to be most advantageous to Durham Public Schools to do so.

The status of a Vendor’s E-Procurement Services account(s) shall be considered a relevant factor in determining whether to approve the award of a contract under this RFP. Any Vendor with an E- Procurement Services account that is in arrears by 91 days or more at the time of proposal opening may, at the State’s discretion, be disqualified from further evaluation or consideration.

Durham Public Schools reserves the right to waive any minor informality or technicality in proposals received.

3.1 CONFIDENTIALITY AND PROHIBITED COMMUNICATIONS DURING EVALUATION

During the evaluation period—from the date proposals are opened through the date the contract is awarded—each Vendor submitting a proposal (including its representatives, sub-contractors and/or suppliers) is prohibited from having any communications with any person inside or outside the using agency, issuing agency, other government agency office, or body (including the purchaser named above, department secretary, agency head, members of the general assembly and/or governor’s office), or private entity, if the communication refers to the content of Vendor’s proposal or qualifications, the contents of another Vendor’s proposal, another Vendor’s qualifications or ability to perform the contract, and/or the transmittal of any other communication of information that could be reasonably considered to have the effect of directly or indirectly influencing the evaluation of proposals and/or the award of the contract. A Vendor not in compliance with this provision shall be disqualified from contract award, unless it is determined in the State’s discretion that the communication was harmless, that it was made without intent to influence and that the best interest of the State would not be served by the disqualification. A Vendor’s proposal may be disqualified if its sub-contractor and supplier engage in any of the foregoing communications during the time that the procurement is active (i.e., the issuance date of the procurement to the date of contract award). Only those discussions, communications or transmittals of information authorized or initiated by the issuing agency for this RFP or general inquiries directed to the purchaser regarding requirements of the RFP (prior to proposal submission) or the status of the contract award (after submission) are excepted from this provision.

3.2 PROPOSAL EVALUATION PROCESS

Durham Public Schools shall review all Vendor responses to this RFP to confirm that they meet the specifications and requirements of the RFP.

Durham Public Schools will conduct a One-Step evaluation of Proposals:

Proposals will be received from each responsive Vendor in a sealed envelope or package.

All proposals must be received by the issuing agency not later than the date and time specified on the cover sheet of this RFP.

At that date and time, the package containing the proposals from each responding firm will be opened publicly and the name of the Vendor and total cost offered will be announced. Interested parties are cautioned that these costs and their components are subject to further evaluation for completeness and correctness and therefore may not be an exact indicator of a Vendor’s pricing position.

At their option, the evaluators may request oral presentations or discussion with any or all Vendors for the purpose of clarification or to amplify the materials presented in any part of the proposal. Vendors are cautioned, however, that the evaluators are not required to request presentations or other clarification—and often do not. Therefore, all proposals should be complete and reflect the most favorable terms available from the Vendor.

Durham Public Schools reserves the right to reject all original offers and request one or more of the Vendors submitting proposals within a competitive range to submit a best and final offer (BAFO), based on discussions and negotiations with Durham Public Schools, if the initial responses to the RFP have been evaluated and determined to be unsatisfactory.

Upon completion of the evaluation process, Durham Public Schools will make Award(s) based on the evaluation and post the award(s) to IPS under the RFP number for this solicitation. Award of a Contract to one Vendor does not mean that the other proposals lacked merit, but that, all factors considered, the selected proposal was deemed most advantageous and represented the best value to Durham Public Schools.

3.3 INTERPRETATION OF TERMS AND PHRASES

This Request for Proposal serves two functions: (1) to advise potential Vendors of the parameters of the solution being sought by the Department; and (2) to provide (together with other specified documents) the terms of the Contract resulting from this procurement. As such, all terms in the Request for Proposal shall be enforceable as contract terms in accordance with the General Contract Terms and Conditions.

The use of phrases such as “shall,” “must,” and “requirements” are intended to create enforceable contract conditions. In determining whether proposals should be evaluated or rejected, the Department will take into consideration the degree to which Vendors have proposed or failed to propose solutions that will satisfy the Department’s needs as described in the Request for Proposal. Except as specifically stated in the Request for Proposal, no one requirement shall automatically disqualify a Vendor from consideration. However, failure to comply with any single requirement may result in the Department exercising its discretion to reject a proposal in its entirety.

4.0 REQUIREMENTS

This Section lists the requirements related to this RFP. By submitting a proposal, the Vendor agrees to meet all stated requirements in this Section as well as any other specifications, requirements and terms and conditions stated in this RFP. If a Vendor is unclear about a requirement or specification or believes a change to a requirement would allow for Durham Public Schools to receive a better proposal, the Vendor is urged and cautioned to submit these items in the form of a question during the question-and-answer period in accordance with Section 1.1.

The provisions of this paragraph shall also apply to any subcontractor utilized by Vendor to perform services under this contract.

Any personnel or agent of the Vendor performing services under any contract arising from this RFP may be required to undergo a background check at the expense of the Vendor, if so requested by Durham Public Schools.

Therefore, the parties agree that the Vendor shall be subject to amounts due as liquidated damages but not as a penalty, for each such failure, as follows:

6.0. SCOPE OF WORK

Introduction

Durham Public Schools (DPS) is seeking a qualified contractor to establish a comprehensive life-safety compliance baseline for non-sprinklered elementary schools through the inspection, inventory, documentation, reporting, and limited repair of fire-rated life safety systems. The project includes 20 facilities, divided into two increments (Increment 1/Increment 2) of 10 schools each, and includes fire-rated doors, smoke-rated doors, fire and smoke dampers, firestop systems, penetration seals, and other fire-resistance-rated barrier assemblies. It is intended that the scope for both Increment 1 and Increment 2 run concurrently to maximize the district’s response to safety related repairs.

The selected contractor will perform detailed field inspections to identify and inventory all applicable assets, assess compliance with applicable NFPA standards and building codes, document deficiencies with photographs, assign asset identifiers, and provide comprehensive reporting. Minor repairs that can be completed during the inspection process shall be performed to improve compliance and functionality.

Deficiencies requiring more extensive corrective action will be identified, prioritized, and documented for future remediation.

In addition to inspections, the contractor shall develop Rough Order of Magnitude (ROM) repair cost estimates to support DPS maintenance planning, capital improvement budgeting, and long-term compliance efforts. All identified deficiencies will be classified as High, Medium, or Low Priority based on life-safety impact, code compliance risk, and urgency of corrective action. Major repair recommendations shall include supporting documentation, photographs, corrective action recommendations, and budgetary cost estimates.

Upon completion of the work, the contractor shall provide facility-level reports for each school, a district-wide program summary, and sortable electronic asset inventories in PDF and Excel formats. All inspection data, deficiencies, repair documentation, photographs, and associated records must also be uploaded to the DPS Fire Marshal's LiveSafe platform.

The overall objective of this project is to provide DPS with a complete and accurate inventory of life-safety assets, improve compliance through completion of minor repairs, identify and prioritize major deficiencies, and create a data-driven framework for future maintenance, capital planning, and regulatory compliance initiatives.

Project Intent

The intent of this project is to establish a comprehensive life-safety compliance baseline for selected DPS facilities through inspection, inventory, deficiency identification, reporting, and completion of appropriate minor repairs related to fire-rated doors, fire/smoke dampers, and fire-rated penetrations and barrier assemblies.

The completed project shall provide Durham Public Schools with:

A complete inventory of inspected assets

Documentation of compliance and non-compliance conditions

Correction of appropriate minor deficiencies during the inspection process

Identification and prioritization of major deficiencies requiring future corrective action

Budgetary information and cost data to support future maintenance planning, capital planning, and compliance efforts

B. Rough Order of Magnitude (ROM) Repair Cost Estimates

As part of the proposal, the Contractor shall provide Rough Order of Magnitude (ROM) repair cost estimates based on the historical inspection reports provided by Durham Public Schools (2022 and 2023 inspections for fire-rated doors, fire/smoke dampers).

The purpose of these estimates is to assist Durham Public Schools with future maintenance planning, capital improvement budgeting, and prioritization of corrective work.

The Contractor acknowledges and understands that:

The historical inspection reports were prepared by previous inspection firms and may not reflect current field conditions.

Conditions observed during the Contractor's inspections performed under this Contract will likely differ from the historical reports due to completed repairs, facility modifications, deterioration, changes in occupancy, differing inspection methodologies, and professional judgment.

The ROM pricing submitted with the proposal shall be considered budgetary estimates only and shall not constitute a commitment to perform repairs at the proposed pricing.

Upon completion of the inspections, Durham Public Schools will request updated ROM repair estimates based on the Contractor's actual inspection findings.

C. Deficiency Priority Classification

The Contractor shall assign a priority level to every identified deficiency for fire-rated doors, fire/smoke dampers, and fire-rated penetrations. Priority classifications shall be based on the severity of the deficiency, its impact on life safety and code compliance, and the urgency of corrective action.

High Priority (Critical)

Deficiencies that significantly impair or eliminate the intended fire- or smoke-resistance performance of the assembly or create a substantial life-safety concern.

Examples include, but are not limited to:

Fire-rated doors that cannot positively latch or self-close

Missing or damaged fire door components required for code compliance

Damaged or inoperable fire/smoke dampers that fail operational testing

Dampers obstructed or prevented from closing

Missing fire/smoke dampers where required

Unsealed or improperly sealed penetrations that compromise a fire-rated wall, floor, or smoke barrier

Large openings or damaged fire-resistance-rated assemblies

Deficiencies that would likely result in failure of the rated assembly during a fire event

Conditions representing significant non-compliance with applicable NFPA standards or the adopted building and fire codes

Medium Priority (Important)

Deficiencies that reduce the effectiveness or reliability of the fire-rated assembly but do not completely compromise its intended life-safety function.

Examples include:

Fire door hardware requiring adjustment or replacement

Damaged gasketing or edge seals

Minor frame or leaf damage not affecting structural integrity

Dampers requiring cleaning, lubrication, or minor mechanical adjustment

Missing identification labels where performance can otherwise be verified

Firestop systems requiring localized repair or replacement

Moderate deterioration that could worsen if not addressed

Low Priority (Routine Maintenance)

Minor deficiencies that have little or no immediate impact on the fire-resistance performance of the assembly should be corrected to maintain long-term compliance.

Examples include:

Minor cosmetic damage

Missing documentation or labeling

Housekeeping items affecting accessibility for future inspections

Minor preventative maintenance recommendations

Conditions suitable for correction during routine maintenance activities

Contractor Deliverable

The Contractor shall assign a priority level to each identified deficiency and provide sufficient documentation to support the recommended classification. Documentation shall include:

Deficiency description

Applicable code or NFPA reference (when applicable)

Building and room location

Photographs

Recommended corrective action

Estimated ROM repair cost

DPS reserves the right to review and modify the assigned priority classifications as part of its maintenance and capital planning process.

D. Minor and Major Repairs

The Contractor shall evaluate each deficiency and determine whether corrective action constitutes a minor repair or major repair.

Historical Minor Repair Targeting

Fire Doors

Contractor shall use documents provided in Exhibit B to determine the value of minor repairs that can be completed to fire door assemblies during inspection and survey. See section 4.2 regarding targeted minor repairs.

o Note that no minor repairs should be completed to any one asset if a major repair will supersede the repairs made.

Dampers

Contractor shall use documents provided in Exhibit B to determine the value of minor repairs that can be completed to damper assemblies during inspection and survey. See section 4.2 regarding targeted minor repairs.

o Note that no minor repairs should be completed to any one asset if a major repair will supersede the repairs made.

Project Repair Classifications – Major and Minor

Fire Doors

Minor Repairs Adjustments, hardware replacements, and code-compliance corrections that can be completed without replacing the door or frame. Examples include door and hardware adjustments, hinge and closer repairs/replacements, gasket and sweep replacement, fastener installation, latch adjustments, gap corrections, relabeling, and other minor compliance-related repairs.

Major Repairs

Requires replacement of primary fire-rated components or significant modifications to the opening. Examples include door or frame replacement, fire-rated glazing replacement, complete hardware replacement, rolling fire door replacement, opening reconstruction, specialty fabrication, structural modifications, field labeling, or conditions requiring engineering review.

Dampers

Minor Repairs Routine maintenance and adjustments that restore proper damper operation without replacing the damper assembly. Examples include cleaning, debris removal, fusible link replacement, linkage adjustments, damper resets, fastener or label replacement, tagging, actuator adjustments, and minor access panel hardware repairs.

Major Repairs

Replacement of damper assemblies or significant modifications to associated building systems.

Examples include actuator replacement, fire/smoke/combination damper replacement, new access door installation, ductwork modifications, sleeve replacement, electrical or fire alarm interface modifications, structural alterations, and damper relocation.

General Note for Fire Doors and Dampers

Minor repairs should be excluded when a major repair is required for the same asset, as the major repair will supersede and incorporate any associated minor corrective work.

Examples include replacing hardware on a door requiring replacement, replacing seals on a frame requiring replacement, or performing repairs to components that will be removed as part of a larger corrective action.

E. Deliverables and Reporting Requirements

Upon completion of all inspections, surveys, and testing, the Contractor shall provide a comprehensive final report for each school and an overall program summary within 30 days of completion.

The final report shall include:
