QUESTION: Is only a price proposal sufficient for award of this requirement?

ANSWER: No, in accordance with the solicitation’s Section M, offerors must “addresses and meet all tasks, requirements and services set forth in this solicitation”. Offerors should provide a non-price proposal that addresses all tasks, requirements, and services set forth in the solicitation to be considered for award.

Examples of responses that might be considered as addressing and meeting all tasks, requirements, and services set forth in the solicitation include, but are not limited to on-site septic installer certification, state of Washington electrician license, and estimated schedule for delivery of work”. Offerors should provide a non-price proposal that addresses all tasks, requirements, and services set forth in the solicitation to be considered for award and providing the aforementioned example responses does not guarantee a firm will be selected for award or replace the offeror’s due diligence in preparing an adequate response to this RFQ.

Question No. 2

Buy-American

QUESTION: Does Buy American requirement apply to items commercially available off-the-shelf such as the pump and control box specified in the Onsite-septic Design?

ANSWER: Yes, the Buy-American Act applies. Clause 52.225-9(a) defines “Domestic construction material” as:

(1) An unmanufactured construction material mined or produced in the United States;

(2) A construction material manufactured in the United States, if—

(i) The cost of its components mined, produced, or manufactured in the United States exceeds 50 percent of the cost of all its components. Components of foreign origin of the same class or kind for which nonavailability determinations have been made are treated as domestic; or

(ii) The construction material is a COTS item. COTS is Commercial of the Shelf.

Question No. 3

Payroll

QUESTION: If the subcontractor is also the owner of his company:

a. Does the subcontractor submit payroll form WH-347 indicating that prevailing wages do not apply? or;

b. Does the Prime contractor include the subcontractor on the prime’s payroll form?

ANSWER: Self-Employed Subcontractors. The statutory language of Davis-Bacon Act (DBA) requires that all laborers and mechanics employed directly on the site of the work be paid no less than the predetermined wages “regardless of any contractual relationship which may be alleged to exist between the contractor or subcontractor and such laborers and mechanics.” (Reference 40 U.S.C. § 3142(c)(1)). Under DBA, the term “employed” is not necessarily limited to “employee” and, therefore, may encompass certain independent contractors or workers. Self-employed “independent contractors” (often referred to as “1099 workers”) who perform as laborers or mechanics on a covered project are subject to DBA. The prime contractor must ensure that the “independent contractor” receives no less than the applicable DBA wage rate for the hours worked on the site of the work, and must ensure that such worker is reported on the certified payroll each week. However, an exception may apply to bona fide business owners –defined as any employee who owns at least 20% equity interest in the enterprise AND who is actively engaged in its management – may be considered exempt under 29 CFR § 541, even though they are themselves performing the work of a laborer or mechanic on the covered project. DBA would, therefore, not apply to these workers. Prime contractors are cautioned to consider use of this exemption carefully, and, if they have questions, to seek advice from the nearest DOL Wage and Hour regional office (listed at http://www.dol.gov/whd/whdkeyp.htm). You may find the nearest office by going to the DOL website: https://www.dol.gov/whd/america2.htm.
