About this file
This justification document approves a sole-source award for telecommunication and maritime specialist services. The Federal Bureau of Investigation intends to award a six-month bridge contract valued at $411,841.67 to the incumbent, Special Electronics, Inc., to provide tactical communication support and maritime program specialist services to the FBI's Critical Incident Response Group Hostage Rescue Team. These services include developing communication plans and operating tactical communications systems. The bridge contract is necessary to prevent a lapse in services between the existing contract and a new follow-on contract currently being recompeted, for which these requirements will be included.

FEDERAL BUREAU OF INVESTIGATION
FINANCE DIVISION I PROCUREMENT SECTION
JUSTIFICATION AND ApPROVAL (J&A) FOR OTHER THAN FULL AND
OPEN COMPETITION
JUSTIFICATIONFOROTHERTHANFULLANDOPENCOMPETITIONINACCORDANCEWITH 41
U.S.C. 3304 (A) (X)
Requisition Number: DJF-22-2200-PR-0001595
Date: 03107122
Estimated Contract Dollar Value: $411,841.67
1. Identification of the agency and contracting activity.
The u.s. Department of Justice, Federal Bureau of Investigation (FBI), Finance and Facilities Division (FFD)'s Professional Services Acquisition Unit (PSAU), has prepared this justification for other than full and open competition for Telecommunication, Maintenance and Logistic support services on behalf of the Critical Incident Response Group (CIRG) Hostage Rescue Team
(HRT).
2. The nature and/or description of the action being approved, i.e., sole source, limited competition, establishment of a new source, etc.
It is the intent of the PSAU to acquire a labor-hour contract, at firm-fixed price labor rates, for a period of performance of six (6) months. The Federal Bureau ofInvestigation (FBI) CIRG HRT is contemplating awarding a sole-source, labor hour purchase order to Special Electronics, Inc.
(SEI) in accordance with Federal Acquisition Regulations (FAR) 6.302-1 (2). The requirement is for Tactical Communicators/Telecommunication Specialists and Maritime Program Specialists and the solicitation and subsequent award will be based on the unique qualifications of the vendor to meet the needs of the FBI's CIRG HRT.
3. A description of the supplies or services required to meet the agency's needs.
The requirement is to provide contractor support in Telecommunication and Maritime Program services to develop communication plans and deploy/operate tactical communications systems to include but not limited to, satellite equipment, satellite antenna, TACSA T radio, and Mobile Ad- Hoc Networks. In addition, the contractor will provide overall coordination of Maritime training (including the setting up of training events, providing instruction and Diving Supervision). The Maritime Program specialist (MPS) will provide overall systems expertise (including maintenance and repair) and deployable expertise on all dive equipment. The primary responsibilities of the Maritime Program specialist shall be planning, assisting the Maritime Program Manager in budgetary and program management as well as systems integration functions required to procure, operate, and provide life cycle support to the specified technology-based systems and projects. The services will be performed at FBI locations in Quantico, Virginia at an estimated cost of $411 ,841.67 for a period of six months. This will allow the CIRG HRT to accomplish its mission.
4. The statutory authority permitting other than full and open competition.
The statutory authority permitting other than full and open competition is 41 U.S.C. 3304 (a)(1) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1 entitled, "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements."
5. Demonstrate the unique qualifications of the proposed contractor or the nature of the action requiring the use of the authority.
The requirement is for a "bridge" contract to allow services to continue during the acquisition process for a new contract. The requirement is to be included in the new Eagle Security contract recompete thus a "Bridge" contract is needed to ensure services are not interrupted during the acquisition process. Special Electronics, Inc. is the current incumbent and has performed the services for over two years. Any attempt to use procedures other than those under the authority would significantly interrupt CIRG HRT' s mission. Procedures other than those under the authority require significant time to solicit and award and staff; meanwhile, without the bridge contract contractor services would be removed and CIRG HRT's capabilities would suffer.
6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies.
The requirement is for a "bridge" contract to allow services to continue during the acquisition process for a new contract. The requirement is to be included in the new Eagle Security contract recompete thus a "Bridge" contract is needed to ensure services are not interrupted during the acquisition process. The Contracting Officer will perform all procedures to determine that offers are solicited from as many potential sources as is practicable. No apparent barriers exist to restrict consideration for a new contract.
7. The anticipated dollar value of the proposed acquisition, including options if applicable, and a determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
The anticipated dollar value based on the awarded market labor rates is $411,841.67 (inclusive of $30,000 in ODC/Travel cost). The Contracting Officer will compare pricing to the current labor rates with expected percentage increases to determine fair and reasonable.
8. A description of the market research conducted and the results.
Market research will be performed to determine available resources for the procurement of the new Eagle Security contract for which the subject services are to be included.
9. Any other facts supporting the use of other than full and open competition.
The current requirement is to be included in the award of a new security contract. However, the FBI is awarding a sole source "bridge" contract to mitigate any gaps in support, while acquisition procedures are followed in the award of a new, long-term, contract.
10. A listing of any sources that expressed a written interest in the acquisition.
Since the procurement was not advertised, no other companies have expressed an interest either orally or in writing.
11. A statement of any actions the agency may take to remove or overcome any barriers to competition, if subsequent acquisitions are anticipated.
There are no barriers to competition other than those mentioned, previously, in the justification.
