Abbott Informatics owns all the intellectual property associated with all STARLIMs products and is the only authorized source to provide the maintenance and support services to the baseline software. In accordance with FAR 6.302-1, Abbott has therefore been determined to be the only responsible source for the SOW described in this order.
6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies.
A Federal Business Opportunities (FBO) notice has been published for this sole source acquisition in accordanc~ with Federal Acquisition Regulation (FAR) Sub-Part 5.2.
7. A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.
The Contracting Officer has determined the price of this order to be fair and reasonable in accordance with FAR 13.106-l(a) (2) based on a comparison of the order SOW, labor categories and level of effort with similar requirements procured using GSA schedule rates.
8. A description of the market research conducted {see Part 10) and the results or a statement of the reason market research was not conducted.
The DEA program office reviewed technology on the open market under RFI 15DDHQ18N00000002 and determined that no other sources exist that are capable of satisfying the DEA's needs for this requirement without a lengthy competitive acquisition. This six month period of performance for this order is intended to provide the time required to obtain the best value technical solution.
9. Any other facts supporting the use of other than full and open competition, such as:
i. Explanation of why technical data packages, specifications, engineering descriptions, statements of work, or purchase descriptions suitable for full and open competition have not been developed or are not available.
This requirement has evolved using the Starlims brand COTS software as a baseline. As a commercial item procurement, the Government does not own the baseline data, but does own the Agency-specific information resulting from years of integration. The Government is developing specifications for an enterprise baseline that will be obtained via a competitive solicitation in the future.
ii. When 41 U.S.C. 3304{a)(1) is cited for follow-on acquisitions as described in 6.302-1(a)(2)(ii), an estimate of the cost to the Government that would be duplicated and how the estimate was derived.
N/A
iii. When 6.302-2 is cited, data, estimated cost, or other rationale as to the extent and nature of the harm to the Government.
N/A

10. A listing of the sources, if 13ny, that expressed, in writing, an interest in the acquisition.
Abbott Informatics is the only vendor fund responsible to deliver the requirement at this time. Multiple vendors have expressed an interest in the competitive acquisition that will follow this sole source acquisition.
11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.
The Agency intends to immediately begin the process of soliciting for competitive proposals. As such, there are no barriers to overcome.
