JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
Revised 12/7/2017
6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subeart 5.2 and, if not, which.exception under 5.202.applies.
Market research on both Federal supply and other GWEAC vehicles indicates that there is only one responsible source for this brand of software/hardware. IAE FAR 5.2, this brand name requirement is being posted with the solicitation.
7. A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.
The Contracting Officer has reviewed the market prices for similar software programs and has evaluated the price of this software and determined that the price from the OEM is Fair and reasonable IAW FAR 13.106-3(a)(2) .
8. A description of the market research conducted (see Part 10) and the results or a statement of the reason market research was not conducted.
This requirement has been posted on the NASA SEWP enterprise and the GSA e-buy enterprise. All vendors that provided quotes indicated that they were resellers and needed to procure from the OEM and mark up the price.
9. Any other facts supporting the use of other than full and open competition, such as:
· i. Explanation of why technical data packages, specifications, engineering descriptions, statements of work, or purchase descriptions suitable for full and open competition have not been developed or are not available .
The agency has evaluated the effort required to develop Data packages on this capability and determined that the evolving nature of the threat that this product defends against requires an evolving software/hardware capability. The cost in manpower to test and integrate another unique software/hardware is not expected to be recovered by any potential discounts from introducing other unique branded technical solutions. The price for all procuring and integrating similar solutions included in market research was found to be more expensive than integrating this brand solution that is available from the OEM.
ii. When 41 U.S.C. 3304(a)(l) is cited for follow-on acquisitions as described in 6.302-l(a)(2)(ii), an estimate of the cost to the Government that would be duplicated and how the estimate was derived.
Testing and Integration of another brand solution is anticipated to require over $50,000 in time for planning, testing, communicating and troubleshooting, which would additionally effect the mission success of those customers that are served by this network.
iii. When 6.302-2 is cited, data, estimated cost, or other rationale as to the extent and nature of the harm to the Government.
10. A listing of the sources, if any, that expressed, in writing, an Interest in the acquisition.
