(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records--Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e)(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial items. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause--

Specifications for Purchase of Stainless Plumbing Fixtures

Stainless Steel Toilets shall be Metcraft Toilet Fixture model# 4665 or approved equal that meets all the following specifications:

• Elongated design, front mounted fixture, wall outlet waste

• Integral seat, high polished finish

• Self-draining flushing rim

• Siphon jet type flush

• 3" (76mm) OD toilet waste tube with 5-1 /2" (140mm) diameter recessed gasket flange

• Fully enclosed trap

• Plated steel concealed anchor rods and fasteners

• 1-1/2" (38mm) MIPT top supply connection

• Toilet shall be constructed of heavy gauge type 304 stainless steel and welded to form a vandal resistant unit.

• Internal piping shall be stainless steel.

• Exposed stainless steel surfaces to be polished to a satin finish , except the integral seat should be polished to a bright mirror finish.

• Toilet unit to withstand 5,000 lb. loading without permanent deflection or damage.

• Fixture shall meet or exceed ASME A 112.19.3 / CSA B45.4 standards for "Stainless Steel Plumbing

Fixtures".

• The trap will pass a 2-1/8" (54mm) diameter ball.

• Minimum 1" (25mm) supply providing 35 psi flushing pressure is required.

• Fixtures to have four (4) 7/8" (22mm) diameter mounting holes to accept 5/8" (16mm) studs. Bottom studs shall be 5-1 /4" (133mm) in from the bottom edge of the toilet mounting flange. Top studs should be 5-1/4" (133mm) in from the top edge of the toilet mounting flange. Top and bottom studs shall be 7- 1/2" (191mm) apart. Studs shall be 9" (229mm) apart horizontally on the mounting flange. Top and bottom studs shall be 1-1/2" (38mm) in from each of the vertical sides of the mounting flange. See attached drawing.

• Toilet waste tube shall be located in the mounting flange at 5-1/4" (133mm) on center from the bottom edge of the mounting flange and 6" (152mm) on center from the side edges of the mounting flange.

• Four (4) tamper resistant cap nuts shall be provided with the fixture for mounting studs.

Stainless Steel Lavatory shall be Metcraft Lavatory Fixture model # 5681 or approved equal that meets all the following specifications:

• Wall mounted fixture, wall outlet waste

• Lavatory basin: rectangular, 1-5/8" (41mm) diameter die formed drain opening.

• Integral ribbed soap tray

• 4" (102mm) high back splash.

• Deck punched for faucets.

• Lavatory to be designed for a security setting and be durable and vandal resistant.

• Lavatory to be fabricated from heavy gauge type 304 stainless steel seamlessly welded to form one piece.

• Exposed surfaced to be polished to a satin finish.

• Fixture to meet ASME A 112.19.3 / CSA 845.4 standards for "Stainless Steel Plumbing Fixtures".

• Overall dimensions of lavatory shall be 18" (457mm) wide x 15" (381 mm) deep x 4" (102mm) tall without backsplash or 8" (203mm) tall including backsplash.

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
