WBR 1406.303-1 Form 1 0040377287 (February 2017)

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

PR No: 0040377287 Solicitation No.: 140R8118Q0117 Project Name: Renewal of LA-DYNA Software In accordance with FAR 6.302, the proposed contractual action is pursuant to the statutory authority of for purchases not exceeding the simplified acquisition threshold (SAT). Contracting Officers may solicit from only one source if the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization).

1. Agency and Contracting Activity. Bureau of Reclamation, Acquisition Operations Branch, Denver, CO

2. Nature/Description of Action. Contract will be FFP with term of April 1, 2018 to March 31, 2019 and include four (4) option years with the flexibility to add/reduce the number of licenses at the time each option year is exercised. IT investment is identified as Reclamation Mission Support Services (RMMS).

3. Description of Supplies/Services. The Waterways and Concrete Dams Group 1 performs sophisticated non-linear dynamic analysis of concrete dams. The results from these analyses are used by the Dam Safety Office (DSO) to ensure that the risks associated with operating dams are within Reclamation’s Public Protection Guidelines.

As such, the analysis must be as realistic and accurate as possible and must incorporate all the aspects of the dam including: contraction joints, concrete material properties, reservoir hydrodynamic interaction, foundation mass, radiation damping effects, and jointing.

4. Statutory Authority Permitting Other than Full and Open Competition.

Authority FAR Coverage Application 41 U.S.C. 253(c)(1) FAR 6.302-1 Only one responsible source and no other supplies or services will satisfy agency requirements 41 U.S.C. 253(c)(2) FAR 6.302-2 Unusual and compelling urgency

41 U.S.C. 253(c)(3) FAR 6.302-3 Industrial mobilization; engineering, developmental or research capability; or expert services

41 U.S.C. 253(c)(4) FAR 6.302-4 International Agreement 41 U.S.C. 253(c)(5) FAR 6.302-5 Authorized or required by statute 41 U.S.C. 253(c)(6) FAR 6.302-6 National Security 41 U.S.C. 253(c)(7) FAR 6.302-7 Public Interest 41 U.S.C. 3304(a)(1) FAR 6.302-1(c) Application for brand-name descriptions

5. Demonstration of Contractor’s Unique Qualifications. LS-DYNA is a general-purpose finite element program capable of simulating complex real-world problems. LS- DYNA’s potential applications are numerous and can be used to model and simulate a wide range of physical events and engineering related problems. LS-DYNA consists of a single executable file and is entirely line driven which means that it only requires a command shell, an executable action, an input file, and enough free disk space to run the calculations. The Livermore Software Technology Corporation (LSTC) is the only developer of the LS-DYNA software that is currently being used by the Bureau of Reclamation. Failure to procure this software will lead to potential loss of Reclamation’s current data and increased cost of a new system. Financial losses to the government would include hundreds of thousands of dollars associated with having to abandon models currently being developed for ongoing projects as part of Reclamation’s Dam Safety Program. The ability to evaluate dams modeled with the LS-DYNA software over the last decade for revised or updated loading conditions would also be lost resulting in additional hundreds of thousands of dollars in financial losses to the government.

6. Description of efforts made to maximize competition. Livermore Software Technology Corporation (LSTC) is the sole proprietor of LS-DYNA, and is the only authorized provider of LS-DYNA software to Government agencies within the United States as indicated in the attached certified letter from LSTC. Based upon market research, there are two other vendors who are authorized by LSTC to sell LS-DYNA products; however, each vendor is assigned to market to a specific niche market such as automotive, sheet metal forming, vehicle crash analysis, forging, extrusion, rolling, and optimization of designs.

7. Determination of Fair and Reasonable Cost. Reclamation has used the LS-DYNA software for many years. Since FY10, the price of the software licenses has remained unchanged at $XXXX per license. The FY16 and FY17 contracts were awarded for 74 licenses at $XXXX each for the first 70 licenses, with the remaining 4 licenses awarded at a price of $XXXX each, for a total of $XXXXXX.

8. Description of Market Research Conducted. There are other finite element analysis software packages on the market including ABAQUS and ANSYS. These products can also complete high-end finite element analyses but are focused on implicit analysis for mechanical applications as opposed to LS-DYNA that is an explicit focused product more consistent with the types of dynamic analyses Reclamation completes for concrete dams and spillway soil-structure interaction problems. More importantly, if Reclamation were to consider using a different finite element package, Reclamation would have to acquire an entirely new software system, incurring a new start-up cost for the software, install, and training in using the new system. Reclamation will also incur financial losses that could not be recuperated and loss of the following, including and not limited to:

• Having to abandon models currently being developed for existing projects requiring complete new project start-ups with a different software application.

• Losing the ability to use completed models developed for previous projects for new or revised loading conditions.

• Having to re-train the group’s analysts to use a new finite element software which would require many days of classroom training in addition to many hours of on-the-job training to gain a similar level of efficiency required to use these complex software packages.

• Having to purchase new pre- and post-processing software packages for developing model geometry and post-processing analysis results.

• Having to complete additional training for the new pre- and post-processing software applications.

9. Any Other Supporting Facts. Livermore Software Technology Corporation is the only provider of LS-DYNA software for Government agencies within the United States as indicated in the attached certified letter from LSTC.

10. Listing of Interested Sources.

Livermore Software Technology Corporation 7374 Las Positas Rd Livermore, CA 94551-5110

11. Actions Taken to Remove Barriers to Competition. Livermore Software Technology Corporation is the only provider of LS-DYNA software for Government agencies within the United States as indicated in the attached certified letter from LSTC.
