JUSTIFICATION & APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION

for SIMPLIFIED ACQUISITIONS OVER THE MICROPURCHASE THRESHOLD (See FAR

Part 2) UP TO SAT (See FAR 13.106-1)

Date: _____04 APR 2025___________

PR Number: 44013073_____________

1. Nature and/or description of the item/service being procured and its intended use (include the anticipated cost):

This procurement is for the emergency structural repair and maintenance of a 100,000-gallon prestressed concrete Ground Storage Tank (GST) located at the Park Entrance Plant (TCEQ Facility ID TP18276). The GST is a critical component of the park’s potable water distribution system. A Level 1 Assessment conducted on October 10, 2024, identified significant concrete deterioration at the vent, spalling damage on the tank exterior, and failed sealing at conduit entry points. The required work includes: Vent Cap Curb Collar Replacement & Sealing, Conduit Perimeter Resealing, Exterior Concrete Spalling Repairs, Tank Draining, Cleaning, and Disinfection in Accordance with AWWA C652 The contractor must perform all repairs in compliance with AWWA D110-13, NSF/ANSI 61, and Texas Commission on Environmental Quality (TCEQ) 30 TAC §290.46(m) regulations to ensure potable water safety. The anticipated cost for this procurement is $93,000.

2. Sole Source Justification rationale (Check one and explain below):

______ Only one responsible source.

_X___ Urgent and compelling circumstances exist. Include critical delivery or performance dates, and when you became aware of the requirement. Provide a specific statement of the impact on Government operations, financial or otherwise, if the required delivery or performance dates are not met.

______ Other _____________________________________________________

Explain:

The GST is a critical water infrastructure component supplying potable water to the park, administrative buildings, and visitor facilities. The structural deficiencies identified in the Level 1 Assessment present an immediate risk to water quality and compliance with TCEQ regulations. The identified spalling damage, failing vent seals, and conduit deterioration could lead to contamination or structural failure if not repaired promptly.

On 02 FEB 2025 Padre Island National Park received the attached Initial Assessment Letter and

An assessment found that Storage Tank ST0004 (Park Entrance – 0.1 MG) is not being properly maintained, violating 30 TAC §290.46(m). The tank vent shows significant concrete damage. Repairs due by May 29, 2025 for the “Failure to Properly Maintain a Tank”.

Delays in this repair could result in: Health and safety risks due to potential water contamination.

Regulatory noncompliance with TCEQ and AWWA standards, leading to possible fines or operational restrictions. Operational disruptions requiring alternative water sources, increasing costs and logistical challenges. The park became aware of this requirement upon completion of the Level 1 Assessment on October 10, 2024, with recommendations for immediate action. The work must be completed without delay to maintain compliance and prevent further deterioration. Delays in this repair could lead to the inability to provide adequate water supply for essential services and emergency situations.

3. Market Research. Please explain the results or why one was not performed. State whether any other offers were received or anyone expressed interest:

Market research was limited due to the urgent and highly specialized nature of the repairs. The park solicited a consultation from SealBoss, a recognized industry leader in concrete repair solutions. SealBoss assessed the scope and recommended Mobile Enterprises Inc. (MEI) as the contractor with the required expertise and capability for this specialized work.

MEI has prior experience with TCEQ and AWWA D110-13-compliant water tank repairs. MEI is a certified applicator for NSF 61-approved materials required for potable water infrastructure. Due to the complex repair requirements, no other vendors expressed interest or submitted quotes for this specialized work.

Given the critical timeline and technical expertise required, competing this procurement would introduce unacceptable delays and risk noncompliance with TCEQ regulations. Sole-sourcing to MEI ensures the most expedient and compliant resolution to these urgent repairs.
