About this file

This notice of intent announces the National Park Service's plan to sole source a contract to CH2M Hill for architect-engineer construction services related to stabilizing the Ellis Island Seawall at the Statue of Liberty National Monument. The services required from CH2M Hill include action submittal review, request for information review, coordination of sustainability requirements, office services, as-built drawings, site visits, and fuel dock design. CH2M Hill is being sole sourced because it was previously selected as the designer of record in accordance with Brooks Act procedures and has existing knowledge and information about the project as the incumbent, which no other firm possesses. Soliciting a new contractor would result in unnecessary delays and costs to the government. The estimated value of the contract is above the simplified acquisition threshold, and award is expected to be made before October 15, 2020. Interested parties have 30 days to respond to the notice before award is issued.

NPS Solicitation 140P2020R0135 Stabilize Ellis Island Seawall

(GATE-201035)

Statue of Liberty National Monument, Ellis Island, Hudson County, New Jersey, and New York County, New York Architect-Engineer Construction (Title III) Services

NOTICE OF INTENT

Notice of intent to solicit and negotiate with only one source under the authority of 6.302. In accordance with FAR 5.203(a), the NPS hereby allows a 30-day response time from the date this notice is posted before issuance of award for architect-engineer services. All responsible sources may submit a capability statement, proposal, or quotation, which shall be considered by the agency.

The National Park Service, Denver Service Center, 12795 W. Alameda Pkwy, Lakewood, CO 80227 intends to solicit and negotiate a sole source requirement with CH2M Hill, Inc. (CH2M Hill), 9191 S. Jamaica St., Englewood, CO 80112-5946, under the FAR Authority 6.302-1 Only one responsible source and no other supplies or services will satisfy agency requirements. The requirement is contract administration services (formerly called Title III) for the stabilization of the Ellis Island Seawall at the Statue of Liberty National Monument, Ellis Island.

This requirement for architect-engineer construction services for the project identified in the preceding paragraph by to be performed by CH2M Hill include action submittal review, Request for Information (RFI) review, coordination of sustainability requirements, office services, as-constructed drawings, site visits, and fuel dock design. CH2M Hill was previously selected the designer of record in accordance with Brooks Act procedures and previously furnished services under a recently expired A-E IDIQ contract. As the designer of record, this is the only firm with knowledge and information to perform required follow-on contract administrative eservices while also maintaining contractual responsibility as the designer of record. Another firm would be required to duplicate the entire design effort, creating unnecessary and substantial delays and costs to the Government that are not warranted or recoverable. In addition, the seawall continues to erode costing the Government additional costs for operations, maintenance and repairs. The time it would take a new firm to design the seawall would create unacceptable delays in fulfilling the agency’s requirements. The estimated costs are greater than the simplified acquisition threshold and award is expected to be completed prior to October 15, 2020.
