PART 1: GENERAL

1.1 WORK COVERED BY CONTRACT DOCUMENTS

A. Background: In the fall of 2017, Hurricane Harvey struck along the coast of Texas impacting the Aransas National Wildlife Refuge (among other refuges, and other states).

The storm surge washed ashore debris along the refuge coastal boundaries and severely damaged many buildings on the refuge.

B. Project Description/Identification: The work shall consist of labor, equipment, supplies, and materials to remove and dispose of the damaged buildings listed below and identified on the attached map.

C. All demolition sites shall be compacted and graded smooth. Revegetation will be accomplished by Refuge staff.

1) Demolish, remove and properly dispose of the MAINTENANCE SHOP BUILDING including the slab (3,000 SF, built in 1980). Constructed of CMU and Metal frame & stucco. Asbestos has been identified in a 1990 Asbestos Survey and has revealed asbestos in +/- 20 lf of pipe wrap, approximately 490 sf of floor tile & associated mastic and 3,100 sf of roofing felt.

2) Demolish, remove and properly dispose of the FIRE CACHE BUILDING including the slab (1,500 SF, built in 1940). Constructed of wood with 48” CMU stem walls and a wood roof structure.

3) Demolish, remove and properly dispose of the FUEL OIL/CHEMICAL BUILDING including the slab (714 SF, built in 1980). Constructed of CMU with steel roof structure.

4) Demolish, remove and properly dispose of the CHEMICAL PESTICIDE STORAGE BUILDING (400 SF, built in 2014). Prefabricated metal building on skids.

5) Demolish, remove and properly dispose of the MOBILE HOME BUILDING including the footings. (720 SF). Pre-manufactured wood frame building.

6) Demolish, remove and properly dispose of the VEHICLE STORAGE BUILDING including the slab (4,500 SF, built in 1980). Constructed of CMU with steel roof structure.

7) Remove existing concrete slab from previously demolished boat barn. Approximately

3,600 SF.

8) Remove existing concrete slab from previously demolished office building.

Approximately 2,000 SF.

9) Remove existing concrete slab from previously demolished 3 bay garage building.

Approximately 1,800 SF.

10) Remove existing 1,200 SF concrete slab from previously partially demolished YCC building to include the removal of 280 sf cooler building that is wood frame.

D. Protection of Existing Utilities and Services, which are not indicated as being removed are required to be protected from damage and disruption. NOTE: The existing septic systems will need to be demolished/removed.

1.2 USE OF PREMISES

A. Access to the Work: The Contractor shall coordinate the use of the premises with the Contracting Officer and Refuge Manager to avoid interruption of station operations. The Contractor is responsible for protection and safekeeping of the site and all furnished or constructed items until final acceptance by the Government. The Contractor may use existing roads for access to the site. The Contractor shall maintain existing roads and access ways affected by the Contractor’s operations. Any damage done by the Contractor’s operations shall be repaired or restored at the Contractor's expense. Speed limits and seat belt use shall be adhered to at all times.

B. Staging Areas: All operations of the Contractor, including storage of materials, on Government premises shall be confined to areas authorized or approved by the Government. Government premises adjacent to the construction area may be made available for use by the Contractor without cost whenever such use will not interfere with other Government uses or purposes. Areas used for staging shall be delineated by the Refuge Manager prior to commencement of work. Note that storage of Contractor’s equipment on Government premises is at its own risk and the Government assumes no responsibility for vandalism or theft.

C. Availability of Utilities: Power and potable water for construction is available at Aransas NWR for use at no cost to the Contractor.

1.3 SEQUENCING AND SCHEDULING

A. Work Schedule: The schedule shall be submitted at the pre-construction conference.

When requested, submit an updated schedule within 3 calendar days. As a minimum, the estimated start and completion dates shall be shown in the estimate.

B. Work Plan: Contractor shall provide a work plan that indicates qualifications of staff, sequence of work, working hours and equipment to be used during the course of this contract.

C. Safety Plan: The contractor will provide a site specific safety plan as a pre-construction submittal outlining the steps to ensure the personal safety of all personnel, equipment, and surroundings of the worksite.

D. Quality Control: The Contractor shall develop and maintain an effective Quality Control Program (QCP) to ensure work is performed in accordance with the SOW. The Contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The Contractor’s QCP is the means by which he assures himself that his work complies with the requirement of the contract. The QCP shall be included in the Technical Proposal. After QCP acceptance the Contractor shall receive the Contracting Officer’s acceptance in writing of any proposed change to the QCP.

E. The Contractor’s normal work schedule on the Refuge shall be 8:00 a.m. to 4:30 p.m., Monday through Friday. No work shall be performed on Saturdays, Sundays, or federal holidays, unless authorized in writing by the Contracting Officer.

F. The Contractor shall comply with all applicable safety codes and regulations including but not limited to Occupational Safety and Health Administration regulations, 29 CFR, Part 1926. The Contractor shall perform his operations so as to ensure safety of his workers, the public, and Government personnel.

G. NOTE: Building demolition shall be coordinated with the new construction, and shall also be coordinated with the refuge manager.

H. NOTE: The contractor shall be responsible for any and all permitting fees that may be required to complete the demolition.

I. Period of Performance shall not exceed 580 days and shall be coordinated with the new construction to take place in stages throughout the construction period. Government and Contractor will determine a schedule after award.

PART 2 – EXECUTION

2.1 DELIVERABLES

A. Deliverables:

1) Level and compacted site in areas were buildings/assets were removed as listed in Section 1.1 above. NOTE: The refuge staff will revegetate the site.

2) Two copies of a final report which provides all chain of custody forms, approximate quantities of waste removed, manifests of the waste that is disposed or recycled, as appropriate, and any other pertinent materials regarding the waste. The report and all documentation shall be submitted to the Contracting Officers Representative (COR) Robert Rayner, RA Robert_Rayner@fws.gov.

2.2 PROJECT METINGS

A. Pre-Construction Conference Call:

1) Pre-Construction Conference call will be held prior to the start of work.

The Contractor will be notified in advance of meeting time, date and place. The purpose will be to review required work, construction schedules, payroll and payments, and administrative provisions of the Contract.

2) The Contractor, subcontractors and the persons responsible for coordination of the work shall be present at the meeting.

3) Be prepared to summarize and explain procedures planned for the project.

B. Progress Meeting:

1) Weekly progress meetings will be held at the project site or as determined by the Contracting Officer.

2) Contractor shall provide a weekly progress report in order to identify time

(schedule update), equipment, safety, or money issues. In addition the report shall include a summary of demolition materials, in weight, which have been removed from the site. Progress meeting will be held at the project site or as determined by the Contracting Officer.

3) Progress meetings may be called by either the Contracting Officer or the Contractor. Request shall state who should attend and include an agenda.

C. Final Inspection:

1) Final Inspection will be held at the project site, or as determined by the

Contracting Officer.

2) Notify the Contracting Officer in writing at least 10 working days before the completion date to allow the Government to schedule a final inspection.

2.3 COORDINATION

A. Coordinate all work with the Project Leader and Contract Inspector (Point of Contact – POC). Keep POC informed of all work progress and work plans to allow facility to manage its operations effectively.

B. The Contractor shall be responsible for safeguarding all Government equipment, information and property provided for Contractor use. At the close of each work period, Government facilities, gates, equipment, and materials shall be secured.

C. The Contractor shall establish and implement methods of making sure all keys or key cards issued to the Contractor by the Government are not lost or misplaced and are not used by unauthorized persons. NOTE: All references to keys include key cards. No keys issued to the Contractor by the Government shall be duplicated. The Contractor shall develop procedures covering key control that shall be included in the Quality Control Plan. Such procedures shall include turn-in of any issued keys by personnel who no longer require access to locked areas. The Contractor shall immediately report any occurrences of lost or duplicate keys/key cards to the Contracting Officer.

D. Contracting Officer Representative: The (COR) will be identified by separate letter. The COR monitors all technical aspects of the contract and assists in contract administration The COR is authorized to perform the following functions: assure that the Contractor performs the technical requirements of the contract: perform inspections necessary in connection with contract performance: maintain written and oral communications with the Contractor concerning technical aspects of the contract: issue written interpretations of technical requirements, including Government drawings, designs, specifications:

monitor Contractor's performance and notifies both the Contracting Officer and Contractor of any deficiencies; coordinate availability of Government furnished property, and provide site entry of Contractor personnel. A letter of designation issued to the COR, a copy of which is sent to the Contractor, states the responsibilities and limitations of the COR, especially with regard to changes in cost or price, estimates or changes in delivery dates. The COR is not authorized to change any of the terms and conditions of the resulting order.

2.4 QUALIFICATIONS

A. Special Qualifications: The Contractor is responsible for ensuring that appropriate employees possess and maintain current training/certification/licensing in hazardous materials awareness, crane operations, motor boat operations, commercial driving licenses, waste hauling, or other training/certification/licensing required in the performance of this SOW.

B. The Contractor shall provide a contract manager who shall be responsible for the performance of the work. The name of this person and an alternate who shall act for the Contractor when the manager is absent shall be designated in writing to the Contracting Officer. The contract manager or alternate shall have full authority to act for the Contractor on all contract matters relating to daily operation of this contract. The contract manager or alternate shall be available between 8:00 a.m. to 4:30 p.m., Monday thru Friday except federal holidays or when the Government facility is closed for administrative reasons.

C. The contractor will employ a qualified archaeological monitor to observe the removal of vegetation, building slab(s), foundations, and utilities during the demolition phase of the contract. See attachment 1.4 GOVERNMENT

2.5 PROJECT SAFETY

2.51 The DB shall have the ultimate responsibility for safety on the project site at all times, from issuance of the Notice to Proceed until completion and acceptance of the project by the Contracting Officer. See Section H of the solicitation /contract and Federal Acquisition Regulation 52.236-13.

2.5.2 Initiate and maintain, throughout the performance of this contract, an effective site specific safety and health program that provides adequate policies, procedures, and practices to protect employees from, and allow them to recognize, job-related safety and health hazards. The program shall include provisions for the identification, evaluation, prevention and control of general work site hazards, specific job hazards, and potential hazards that may arise from foreseeable construction methods and conditions, as well as providing a competent person to conduct frequent and regular inspections. Each employee (DB and subcontractors) must be instructed in the recognition and avoidance of unsafe conditions and the regulations applicable to the work environment.

2.5.3 Provide barricades and warning devices as necessary to safeguard the public, workers, and government personnel. Where project work affects public roads, provide signage in accordance with the current edition of the Manual on Uniform Traffic Control Devices (MUTCD) as published by the US Department of Transportation, Federal Highway Administration.

2.5.4 Rollover Protection and Seat Belts: In addition to the Safety and Health requirements of clause FAR 52.236-13 of Part 2, Section I of this Contract, rollover protection and seat belts required by 29CFR 1926 (OSHA) shall be extended to include equipment regardless of the year of manufacture.

2.6 WORK HOURS: See Section H of the solicitation /contract.

2.7 PROTECTIONS

2.7.1 Comply with all applicable federal, state, and local environmental laws and regulations. This condition applies to, but is not limited to, laws and regulations governing noise levels, air and water quality standards, erosion control, surface runoff, and cultural resources.

2.7.2 Provide erosion control methods (such as watering dry soils) and appurtenances (such as silt fence) as necessary to prevent wind-borne dust and water-borne silt from leaving the immediate work area.

2.7.3 If paleontological, archaeological or historical remains (including burials or skeletal material) are encountered, immediately stop the work and notify the Construction Representative, COR, or Contracting Officer. The Contracting Officer will notify the Regional Archaeologist so the provisions of 36 CFR 800.7 (Resource Discovered During Construction) and other relevant laws are followed. Work will cease in the immediate vicinity until permitted to resume by written order from the Contracting Officer. Work in other areas may proceed as approved by the Contracting Officer.

2.7.4 Heavy equipment operated on FWS roads and parking areas shall comply with highway-legal load limits unless explicitly approved otherwise.

2.7.5 Clearing and working limits shall be no greater than 100 feet from the affected construction areas and no greater than 50 feet from road edges. Any additional clearing needed to complete the project in excess of the outlined limits, will require approval by the COR.

2.8 PERMIT RESPONSIBILITY

2.8.1 NOTE: The contractor shall be responsible for any and all permitting fees that may be required to complete the demolition.

PART 3 – MEASUREMENT AND PAYMENT

3.1 METHOD OF MEASUREMENT

B. Progress payments will be allowed in accordance with construction payments.

PART 4 – GOVERNMENT RESPONSIBILITIES

4.1 DUTY TO COOPERATE

4.1.1 Government will, throughout the performance of the Work, cooperate with DB and perform its responsibilities, obligations, and services in a timely manner to facilitate DB's timely and efficient performance of the Work and to not unreasonably delay or interfere with DB's performance of its obligations under the Contract Documents.

4.1.2 Government will provide timely reviews and approvals of interim design submissions and Construction Documents consistent with the turnaround times set forth in DB's approved schedule. Contractor agrees to revise the design submittals and construction documents at no cost to the Government until the documents are acceptable to the Government in its reasonable judgment.
