The purpose of Amendment 0002 is to provide answers to questions posted by the industry.
Questions & Answers (Q&As) are on the succeeding pages 2-5 and revised Request for Proposal (RFP) pages are pages 6-7 for clarification purposes. The revised RFP pages pertain to pages 6 and 46 of the original RFP, now referenced as Amendment 0002, with only highlighted portions added as a result of the Q&A.
The proposal submission due date remains the same. Proposals are due no later than 22 July 2021, 2:00PM Eastern Time.
Except as provided herein, all terms and conditions of the document referenced in Item 9 A or 10A, as heretofore changed, remains unchanged and in full force and effect .

MC20 Full Field Survey
Q1: In Section C.4 of the RFP, there is reference to an acronym "RRS" in paragraph 1, final sentence.
Please clarify what RRS stands for?
A1: See Section C.1 paragraph 2 of the RFP.
Q2: In Section C.4.3 of the RFP, “The contractor shall secure a suitable vessel capable in the support of one or more ROV's and provide the ability to ensure the BML scanning tool is appropriate for subsea conditions”. This seems to be written to imply a specific device that is to be required to be mounted to an ROV? Is this necessary to scan from an ROV and not from a sonar mounted to or towed behind a vessel?
A2: The Government is not implying any specific device. The requirement is “shall secure a suitable vessel capable in the support”.
Q3: In Section C.4.3 of the RFP, “The contractor shall provide ROV video” - Can you advise water clarity conditions? Will images at the seabed be conveyed through video capture clearly?
A3: Water clarity conditions will likely change from day to day / week to week. Previous video from the seabed at MC-20 has been captured and the Government would like future images taken during the survey to be captured clearly, conditions pending.
Q4: In Section C.4.3 of the RFP, “The scanning sonar coverage, and/or any other scan result that is collected from each scan area as well as corresponding unmanned aerial vehicle (UAV) or drone video footage” - How does arial video play into performing bottom scans on and below the seabed?
A4: Aerial video is to capture any inadvertent hydrocarbon sheening on the surface during survey operations. Any sheening should be reported to the U.S. Coast Guard National Response Center (USCG NRC) as required by the Clean Water Act.
Q5: In Section C.4.3 of the RFP, “Government employees/representatives may board the vessel during operations” - COVID 19 protocols will be in place and may not allow for non-quarantined visitors to join vessel.
A5: Safety and health will always remain first and foremost in decisions. BSEE currently has a contract for COVID-19 testing and a process for quarantine in the Gulf of Mexico Region. BSEE will abide by the COVID protocol that the vessel operator has in place as long as it is as restrictive or more restrictive

DOI/BSEE policy is to follow the CDC guidance for masking and social distancing, which recommends that if an employee is fully vaccinated (at least 2 weeks past their final dose), they are no longer required to wear a mask and practice social distancing. BSEE will evaluate options based on COVID protocols on the vessel.
Q6: Will BSEE indemnify and defend the contractor against litigation from TEC?
A6: Generally, the Federal Government may not agree to an indemnification liability unless specifically authorized by statute. Uncapped indemnifications are a contingent liability that violates the Antideficiency Act (ADA). However, see US Court of Appeals for the Fifth Circuit ruling 30 June, 2021 Taylor Energy Co. vs FOSC for the MC 20 Unified Command et al. The contractor was found to have immunity from a lawsuit and the case was dismissed. In certain circumstances, a contractor cannot be sued when acting on the Government's behalf. Immunity is a bit different than indemnification. Indemnification is a contractual agreement to shield another party from liability by paying the other party's legal fees and damages and such an agreement generally constitutes an ADA violation. When authorized or otherwise found to be necessary, the Government may consider a capped indemnification liability.
Q7: In Section A Item 28 of the RFP, please confirm the schedule of the intended award date for this project. This will help determine a suitable vessel based on its availability. Please provide expected mobilization date of survey operations.
A7: Award date is anticipated to be in November 2021. Mobilization date will be subsequent to the actual award date, but not before Government approval of the Detailed Work Plan (Deliverable A.3) approximately 60 days after the Post Award Meeting (Deliverable A.1).
Q8: In Section C.4.3 Task 3 of the RFP, “The Contractor shall provide ROV video, scanning sonar coverage, and/or any other scan result that is collected from each scan area as well as corresponding unmanned aerial vehicle (UAV) or drone video footage, as weather conditions allow.” Client to clarify the purpose of UAV drone video, is this for sea surface oil slick analysis during survey operations where data acquisition unit touches the seabed?
A8: Sea surface oil sheening analysis is not part of this survey. However, if sheening does occur, the Government does want documentation and expects that it will be reported to USCG NRC. Please see answer to Q4.
Q9: In Section C.4.6 Task 6 of the RFP, “4. All collected data including but not limited to: scan results, location data for each scan, ROV videos and sonar images collected during each scanning equipment retrieval and relocation event, and UAV video footage;”. Deliverables based on compliant solution using deferent methodology may differ however will be detailed in proposal.
A9: Correct, solution should be detailed in Offeror’s proposal.

Q10: In Section C.4 of the RFP, “The Contractor shall perform all necessary work to conduct a full field survey of the MC20 site”. What is the Client’s definition/expectation of the term ‘full field survey’ as described in the RFQ?
A10: The expected full field survey covers the area outlined by the rectangular area included in the solicitation. During the survey, field dimensions may be modified by data received and will be negotiated in the morning briefings.
Q11: In Section C.4 of the RFP, “The Contractor shall perform all necessary work to conduct a full field survey of the MC20 site”. Is the area referred to as ‘MC20 site’ as stated in the RFQ “the dashed outlined polygon” as shown in Figure 1-Depiction of potential Field Scan Scenario on page 7 of the RFQ?
A11: Yes, that is the expected field (however, that image is not drawn to scale). Please see answer to Q10. Section C.4 of the RFP has been updated to reflect that “image not being drawn to scale as well as field dimension may be modified by data received and will be negotiated in the morning briefings”.
Q12: In Section L.10.2 of the RFP, “The written technical proposal is limited to no more than 25 pages of text.” Is a page defined as printed on single sided sheet or is it acceptable to print on both sides of a sheet and this be considered ONE PAGE? (i.e. 25 single sided sheets or 25 double sided sheets.)
A12: A page is defined as single sided. Section L.10.2 of the RFP has been updated to reflect such.
Q13: In Section L.10 of the RFP, is there a limit to the size of the Commercial proposal?
A13: Section L.10 refers to the entire proposal to include both Technical Volume and Business/Cost Volume. The Technical Volume is limited to no more than 25 pages as stated in Section L.10.2. There is no limit set for the Business/Cost Volume.
Q14: In Section B of the RFP, has an anticipated Award date post bid submittal been set and if so could you advise offeror of this date?
A14: Please see answer to Q7.
Q15: In Section F.1 of the RFP, “The period of performance (POP) of this contract is 12 months from the date of award.” What is the anticipated execution window?

Q16: In Section C.3.2 of the RFP, “The proposed survey will provide the United States Government (USG) with data from the best available technology.” Is there any technology of Marine Geophysical BML survey mythology that is not acceptable for the terms of this contract?
A16: The Government expects Offerors to submit proposals utilizing available and proven technology, as stated in Section C.3.2 and C.4 of the RFP.
Q17: In Section C.3.2 Task 3 paragraph 1 of the RFP, “The Contractor shall secure a suitable vessel.”
Contractor may opt for more than one mobilization to optimize the site survey. Is this acceptable?
A17: Offeror should include information like such in their proposal submission, which the Government will assess during technical evaluations.
Q18: In Section C.3.2 Task 3 paragraph 2 of the RFP, “Contractor shall secure a suitable vessel capable in the support of one or more remotely-operated vehicles (ROVs).” Are the ROV(s) mandated if the Contractor can provide the required survey without the use of them?
A18: Alternatives to the proven technological capabilities of an ROV will be considered in the technical evaluation of the proposal.
Q19: In Section C.3.2 Task 3 paragraph 2 of the RFP, “…each scan area as well as corresponding unmanned aerial vehicle (UAV) or drone video footage”. What is the area covered and type of UAV/drone video required? What is the total scope of work for the UAV/Drone?
A19: Scope of work for the UAV/drone is to adequately monitor the sea surface in the vicinity of the full field survey and document surface conditions, including oil sheening. Please see answers to Q4 and Q8.
Q20: In Section C.4.3 Task 3 of the RFP, “Government employees/representatives may board the vessel during operations but will seek approval from the BSEE CO or COR prior to doing so, so it can be coordinated with the Contractor”. What is the maximum Government employees/representatives that will be onboard at any one time?
A20: This will be coordinated between the Government and the contractor on a case by case basis and subject to safety, health (COVID protocols) and space availability on the vessel. Please see answer to Q5.
Q21: Where is the location of the survey work for Solicitation No. 140E0121R0005 | MC20 Full Field Survey?

C.3 OBJECTIVES
C.3.1 SOO Objective: A major intent of this SOO is to have the Contractor submit a Performance Work Statement (PWS), in response to the SOO, that supports an open, agile, professional, interactive, supportive, and customer-oriented contractual relationship.
Performance by the Contractor will be determined by the extent to which its services directly and indirectly advance superior BSEE mission accomplishments while meeting the performance objectives.
C.3.2 Project Objectives: The objective of this full field survey is to determine the extent, expanse, orientation and characteristics of the conductors and other well components from the MC20 Platform A and other BML objects, so that the government can identify the full extent of the field from the platform’s former well bay location to the erosional pit adjacent to the downed jacket. The proposed survey will provide the United States Government (USG) with data from the best available technology to allow for continued, effective response and the eventual cessation of the ongoing pollution event. The USG intends to utilize the services of the selected Contractor as project integrator, and to plan for and direct subsurface scans as well as the required post-processing of the collected data for reporting and use during subsequent response efforts.
C.4 CONTRACT GOALS TO BE ACHIEVED
The Contractor shall perform all necessary work to conduct a full field survey of the MC20 site, including but not limited to furnishing all personnel, facilities, equipment, materials, supplies, and services, within the stated period of performance. The scope of this effort includes employing an innovative but proven concept, response technology in order to complete a sub-bottom/BML survey of the MC20 site. The survey will include up to 60 BML scans, or as many scans needed to determine the full expanse of the well conductors and associated tubulars. As noted above and represented in Figure 1, the survey will commence from the north western most location near the site of the former well bay and proceed south east down to the RRS.
Figure 1 represents the site field for planning purposes and may be adjusted, laterally or longitudinally, during the course of the survey based on the review of data as the scans are conducted. Such a review may warrant a shift in scan placement, depending on target identification or other BML objects, as the scanning progresses from the northernmost location scan to the containment system. Note: Image is not drawn to scale. Field dimension may be modified by data received and will be negotiated in the morning briefings (see Section C.4.4 - Task 4).

(f) A statement that your proposal is valid for a minimum of 120 calendar days after the date specified for the receipt of proposals.
(g) A statement confirming that your organization is registered with the System for Award Management (SAM) (see http://www.sam.gov for more details). Additionally, your Representations and Certifications must be updated in SAM in accordance with FAR 4.12. Failure to adhere to this requirement may result in your proposal being determined to be ineligible for award.
L.10.2 Technical Proposal
The written technical proposal is limited to no more than 25 pages of text. Documentation submitted may use any font, and will use pitch size 12, single spaced, on 8.5x11 inch sized pages. A page is defined as single sided. Any pages larger than 8.5x11 will be considered 2 pages. Any pages in excess of 25 pages will not be evaluated. The Technical proposal limitation of 25 pages excludes the following documents: cover page, resumes/qualifications of key personnel, the Project Management and Quality Assurance Plans, and Past Performance forms. The cover page is limited to one (1) page. Resumes are limited to two
(2) pages each. These documents must be included and clearly identified in the Technical Proposal volume of your proposal package.
The technical proposal must state in detail how the Offeror intends to comply with the work requirements in the Statement of Objectives (Section C) and Deliverables or Performance (Section F) of this RFP, not merely that the Offeror intends to do so. No proposal that offers less than the total required effort will be considered for award.
In order for the submission to be evaluated strictly on the merit of the technical quotation, no cost or pricing information shall be included in the Technical Proposal volume.
The Offeror should read the evaluation criteria in Section M closely. Technical proposals will be evaluated based on the information provided in the written technical proposal as follows.
L.10.2.1 Technical Approach and Understanding (Factor A)
The Offeror shall provide a comprehensive performance work statement that identifies the services and supplies to be delivered to meet the performance objectives, tasks, and considerations set forth in the SOO, Section C. The PWS will be incorporated into the resultant contract and replace the SOO at the time of award. The Offeror shall demonstrate its ability spearhead a full field survey utilizing technologies and methodologies that will effectively determine the extent, expanse, orientation and characteristics of the conductors and other well components from the MC20 Platform A and other below mudline (BML) objects, including their ability to translate project findings and results into high quality deliverable reports with practical usefulness. The Offeror shall exhibit that it has a thorough understanding for addressing BSEE’s needs and describe in detail how each task in Section C will be performed.
