Synopsis of Solicitation [1333BJ24R00280002]

The United States Patent and Trademark Office (USPTO) has a requirement for Transformation, Innovation, Communication and Culture Solutions (TICCS), Product Coaching and Change Management Services (PCCMS). The objective of the services is to establish subject matter expertise in Agile, DevOps, and product management best practices along the expertise needed to implement strategic and transformative change and provide resources.

As a result of the USPTO’s exemption from the Competition in Contracting Act, the PCCMS requirement is being procured using the Alternate Competition Method in accordance with the Patent and Trademark Acquisition Guidelines (PTAG), 78 Fed. Reg. 61185, (October 3, 2013), and the Patent and Trademark Office Efficiency Act, 35 U.S.C. § 2(b)(4)(A).

The USPTO initially publicized this requirement on September 5, 2023, and conducted multi-phased market research by assessing market survey responses. Based on the market research conducted, USPTO determined that BNL, Inc (BNL) is the vendor most likely to successfully meet the agency’s needs.

The USPTO intends to negotiate and award a contract for the TICCS PCCMS (designated NAICS code 541512), to BNL, 608 S. King Street, Suite 102B, Leesburg, VA 20175, for a period of up to five years (one-year base period and four (4) one-year option periods). This requirement is set-aside for small business. The estimated value, including option periods and optional tasks, is $56,310,164.29 and the anticipated award date is March 1, 2024. The contract award number and the line item number will be determined after the award. The contract support under this contract shall be provided remotely.

If applicable, technical data required to respond to the solicitation will be provided directly to BNL. In accordance with the Alternate Competition Method defined by the Patent and Trademark Acquisition Guidelines (PTAG) and the Patent and Trademark Office Efficiency Act, 35 U.S.C. 2(b)(4)(A), BNL is the only vendor eligible for award as the offeror is already determined to be the most likely to successfully meet the agency’s needs through market research.

Closing response to the solicitation date will be determined once the solicitation is issued to BNL. This notice of intent is not a request for competitive proposals.
