NOTE 1 Regarding Bond Premiums: Payment for bond premiums in accordance with Clause 52.232-5, Payments under Fixed-Price Construction Contracts, shall not be in addition to the contract price. Include bond payments under 151.01 Mobilization.

NOTE 2: Payment will be made on actual work performed as described in FP-03 109.01 unless otherwise noted.

Description of Work

Furnish all labor, equipment, materials tools, transportation, and supplies to accomplish the Work under this contract. The work consists of clearing and grubbing, furnishing and installing two (2) precast pre- stressed concrete voided slab bridges (4 total members, per bridge site), bridge abutments, removing and disposing of the existing arch culverts offsite, installation of bridges and approach railings, construction of asphalt surfaced roadways, structural excavation and backfill, riprap and stream simulation placement and signage. The affected segment of NFS Road 31N17 will be closed with detour signage provided and maintained by the contractor. Traffic will be routed around the closed section of the road via an existing public road to the town of Viola. The North and South Forks of Bailey Creeks are perennial streams, so the project area for each crossing will be dewatered prior to removal of the culverts and re-watered after placement of the engineered stream bed and bridge riprap is completed.

The Contractor shall refer to the Schedule of Items, Project Area Map, and referenced Specifications when making estimates for quantities of work.

Project Location

State of California, County of Shasta, Lassen National Forest, Hat Creek Ranger District, Grays Peak 7.5 Minute Quadrangle, Township 31 North, Range 3 East, Section 34.

The Bailey Creek Aquatic Organism Passages project is located along FSR 31N17 (Forest Highway 17). All work is located on the Hat Creek Ranger District of the Lassen National Forest. The project site is located approximately 17 miles north of the Lassen Volcanic National Park Headquarters. From State Highway 36, turn northbound onto 31N17 (west of the town of Mineral, CA) and proceed on the road for approximately 17 miles until reaching the project site. The project can also be accessed from State Highway 44; from Highway 44, proceed approximately 5 miles southbound on 31N17 until reaching the project site. The coordinates for the South Fork bridge location is as follows: Latitude: 40°29'34.71"N; Longitude: 121°37'39.03"W. The coordinates for the North Fork bridge location is as follows: Latitude: 40°29'36.41"N; Longitude: 121°37'34.03"W.

Period of Performance

In conjunction with FAR clause 52.211-10 Commencement, Prosecution and Completion of Work, the following additional information is provided.

The period of performance of this contract shall take place within a 180 calendar day period, and with the expectation that all work be completed before the onset of winter conditions at the project site. Project time includes delays for weather, locating and transporting supplies and materials, fabrication of vital bridge components and final site cleanup.

Contractor shall immediately after award, plan and coordinate with the Contracting Officer the approximate project start dates.

Site Restrictions: Due to biological constraints no onsite work shall commence before July 1st, 2019. The contractor will be expected to execute all pre-planning needs, including submittals and procurement of materials, including fabrication of bridge components before July 1st, 2019.

Factors which will help determine the Approved Schedule, but are not limited to; Contractor's mobilization of equipment, employees, and vehicles to the project site, and road closures.

Contractor shall comply with the Approved Schedule, to finish all work under this contract.

Contractor shall immediately notify the Contracting Officer of any unforeseen delay or needed change to the Approved Schedule, so adjustments to the Period of Performance can be made in a timely manner.

SECTION 00 21 - 13 - Instructions to Bidders

Bid incorporates all amendments and Q&A's (if any) that have been posted to FBO. Submit Bids by the date and time stated in Block 13a or as amended.

Bidders are cautioned to carefully review the Standard and Supplemental Project Specifications prior to submission of bid. All specifications in the Standard Specifications for Construction of Roads and Bridges on Federal Highway Projects FP-03 (customary units) are binding on the parties.

Public Bid Opening (please refer to Block 13a of the SF1442 or as amended). Anyone wishing to attend the bid opening MUST notify the Contract Specialist (tracy.marino@usda.gov) by no later than 5 calendar days prior to the bid opening date with a firm commitment to attend. The bid opening will be held at the below location.

Inquiries

Any prospective bidder desiring an explanation or interpretation of the solicitation, drawings, specifications, etc., must request it in writing, not later than 5 calendar before the closing date, to allow a reply to reach all prospective bidders before submission of their bids. Oral explanations or instructions given before the award of a contract will not be binding. In no event shall failure to inspect the site constitute grounds for a claim after contract award.

Instructions for the Preparation/Submission of Bids

(a) Northern California Acquisition Service Area solicitations will be publicized on the Federal Business Opportunities website (https://www.fbo.gov). Any additional attachments, will be separate attachments or links embedded in the solicitation.

(b) Bids must be submitted electronically. When submitting your bid electronically, the bid and any supplemental information (such as spreadsheets, backup data, technical information, bid bond), can be submitted using any of the following electronic formats:

(1) Files in Adobe Portable Document Format (pdf);

(2) Microsoft Office Products; Word, Excel, or PowerPoint;

(3) Files in Hypertext Markup Language (HTML) must not contain active links to live Internet sites or pages. All linked information must be contained within your electronic bid/offer and be accessible offline.

(c) Transmission shall be by email, to Tracy Marino at tracy.marino@usda.gov.

(1) The subject line of the email shall include the solicitation number as a minimum and may also include the company name and closing date (i.e. 129AC719B0001-Company Name-April 3, 2019

(2) Maximum size of each e-mail shall be 5 megabytes. You may use multiple e-mail messages for each submission, however, you must annotate the subject lines as described above for each message, and number them in this manner:

(d) Timely receipt of bids:

(1) Your attention is called to the solicitation closing date and time on the solicitation is local time for the Northern California Acquisition Service Area. Lateness rules for electronic submissions for bids are outlined in FAR 52.214- 7, "Late Submissions, Modifications, and Withdrawal of Bids".

(2) NOTE: There is no "expected" or "target" length of time for proposal submission; size and content may be factors, therefore bidders are strongly cautioned to submit their bids allowing adequate time for submission.

(e) Electronic bids must include, as a minimum:

(1) E-mailed bids must include a signed SF 1442 and a copy of the Bid Schedule, this would include Section 00 10 00.

(2) All applicable fill-in provisions. For solicitations issued on an SF 1442, this would include Sections 00 45 00.

(3) Bid guarantee (scanned copy). Please ensure the scanned document shows enough detail to verify it's initial validity at time of bid opening (i.e. any seals, signatures). Apparent low bidder will be required to provide an original copy.

(4) Any other information required by the solicitation.

(f) See FAR 14.406 for a description of the steps the Government shall take with regard to unreadable electronic bids received via the media described in paragraphs (c) above.

System for Award Management (SAM) and Annual Representations and Certifications

To be considered for award all bidders must be successfully registered in the SAM database (www.sam.gov) AT THE TIME A BID IS SUBMITTED. See FAR Clause 52.204-7, System for Award Management, as applicable for requirement information.

Effective June 29, 2018, all non-Federal entities who create or update their registration in SAM.gov will no longer need to have an approved Entity Administrator notarized letter on file before their registration is activated. All non- Federal entities still must mail the original, signed copy of the notarized letter to the Federal Service Desk. Failure to do so within 30 days of activation may result in the registration no longer being active. Contractors who are new to the SAM registration process are highly encouraged to begin registering as soon as possible to avoid any possible delays prior to submission of bid. Remember, there is no cost to use SAM. (a) The contracting officer shall make a contract award (1) by written or electronic notice; (2) within the time for acceptance specified in the bid or an extension; and (3) to that responsible bidder whose bid, conforming to the invitation, will be most advantageous to the Government, considering only price and the price-related factors included in the invitation.

(b) To be determined responsible, a prospective contractor must --

(1) Have adequate financial resources to perform the contract, or the ability to obtain them;

(2) Be able to comply with the required or proposed delivery or performance schedule, taking into consideration all existing commercial and governmental business commitments;

(3) Have a satisfactory performance record. A prospective contractor shall not be determined responsible or non-responsible solely on the basis of a lack of relevant performance history;

(4) Have a satisfactory record of integrity and business ethics;

(5) Have the necessary organization, experience, accounting and operational controls, and technical skills, or the ability to obtain them (including, as appropriate, such elements as production control procedures, property control systems, quality assurance measures, and safety programs applicable to materials to be produced or services to be performed by the prospective contractor and subcontractors).

(6) Have the necessary production, construction, and technical equipment and facilities, or the ability to obtain them;

and

(7) Be otherwise qualified and eligible to receive an award under applicable laws and regulations.

(c) To be determined responsive in accordance with sealed bidding procedures at FAR 14.301 a responsive bid must comply in all material respects with the invitation for bid. Examples of solicitation requirement that could determine responsiveness include:

- sufficient bid guarantee;

- acknowledgement of amendments (if any);

- completed representations and certifications; and

- determination of timely bid/amendments to bid

- Bidders shall furnish unit prices for each item listed in the Schedule requiring a unit price. If the bidder fails to insert a unit price in the appropriate blank for required item(s), but does furnish an extended total, or an estimated amount for such item(s), the Government shall deem the unit price to be the quotient obtained by dividing the extended amount for that line item by the quantity. Should any mathematical check made by the Government show a mistake in the extended amount bid, the corrected unit price extension shall govern. IF A BIDDER OMITS BOTH

THE UNIT PRICE AND THE EXTENDED TOTAL OR ESTIMATED AMOUNT FOR ANY ITEM, ITS BID

SHALL BE DECLARED NON-RESPONSIVE AND THEREFORE INELIGIBLE FOR AWARD. Pricing must be submitted for all items.

- If a bidder uses its own bid form or a letter to submit a bid, the bid may be considered only if 1) a statement of agreement to all the terms, conditions, and provisions of the solicitation; and 2) award on the bid would result in a binding contract with terms and conditions that do not vary from the terms and conditions of the invitation.

(d) Award will be made as a whole to one bidder.

(a)(1) The offeror shall notify the Government if the offeror intends to perform work at any secondary site of the work, as defined in paragraph (a)(1)(ii) of the FAR clause at 52.222-6, Construction Wage Rate Requirements, of this solicitation.

(2) If the offeror is unsure if a planned work site satisfies the criteria for a secondary site of the work, the offeror shall request a determination from the Contracting Officer.

52.222-23 Notice of Requirement for Affirmative Action To Ensure Equal Employment Opportunity for Construction. (FEB 1999)

(a) The offeror's attention is called to the Equal Opportunity clause and the Affirmative Action Compliance Requirements for Construction clause of this solicitation.

(b) The goals for minority and female participation, expressed in percentage terms for the Contractor's aggregate workforce in each trade on all construction work in the covered area, are as follows:

These goals are applicable to all the Contractor's construction work performed in the covered area. Goals are published periodically in the Federal Register in notice form, and these notices may be obtained from any Office of Federal Contract Compliance Programs office.

(c) The Contractor's compliance with Executive Order 11246, as amended, and the regulations in 41 CFR 60-4 shall be based on (1) its implementation of the Equal Opportunity clause, (2) specific affirmative action obligations required by the clause entitled Affirmative Action Compliance Requirements for Construction, and (3) its efforts to meet the goals. The hours of minority and female employment and training must be substantially uniform throughout the length of the contract, and in each trade. The Contractor shall make a good faith effort to employ minorities and women evenly on each of its projects. The transfer of minority or female employees or trainees from Contractor to Contractor, or from project to project, for the sole purpose of meeting the Contractor's goals shall be a violation of the contract, Executive Order 11246, as amended, and the regulations in 41 CFR 60-4. Compliance with the goals will be measured against the total work hours performed.

(d) The Contractor shall provide written notification to the Deputy Assistant Secretary for Federal Contract Compliance, U.S. Department of Labor, within 10 working days following award of any construction subcontract in excess of $10,000 at any tier for construction work under the contract resulting from this solicitation. The notification shall list the-

(1) Name, address, and telephone number of the subcontractor;

(2) Employer's identification number of the subcontractor;

(3) Estimated dollar amount of the subcontract;

(4) Estimated starting and completion dates of the subcontract; and

(5) Geographical area in which the subcontract is to be performed.

(e) As used in this Notice, and in any contract resulting from this solicitation, the covered area is

52.225-10 Notice of Buy American Requirement - Construction Materials. (MAY 2014)

(a) Definitions. "Commercially available off-the-shelf (COTS) item," "construction material," "domestic construction material," and "foreign construction material," as used in this provision, are defined in the clause of this solicitation entitled "Buy American-Construction Materials" (Federal Acquisition Regulation (FAR) clause 52.225- 9).

(b) Requests for determinations of inapplicability. An offeror requesting a determination regarding the inapplicability of the Buy American statute should submit the request to the Contracting Officer in time to allow a determination before submission of offers. The offeror shall include the information and applicable supporting data required by paragraphs (c) and (d) of the clause at FAR 52.225-9 in the request. If an offeror has not requested a determination regarding the inapplicability of the Buy American statute before submitting its offer, or has not received a response to a previous request, the offeror shall include the information and supporting data in the offer.

(c) Evaluation of offers. (1) The Government will evaluate an offer requesting exception to the requirements of the Buy American statute, based on claimed unreasonable cost of domestic construction material, by adding to the offered price the appropriate percentage of the cost of such foreign construction material, as specified in paragraph (b)(3)(i) of the clause at FAR 52.225-9.

(2) If evaluation results in a tie between an offeror that requested the substitution of foreign construction material based on unreasonable cost and an offeror that did not request an exception, the Contracting Officer will award to the offeror that did not request an exception based on unreasonable cost.

(d) Alternate offers. (1) When an offer includes foreign construction material not listed by the Government in this solicitation in paragraph (b)(2) of the clause at FAR 52.225-9, the offeror also may submit an alternate offer based on use of equivalent domestic construction material.

(2) If an alternate offer is submitted, the offeror shall submit a separate Standard Form 1442 for the alternate offer, and a separate price comparison table prepared in accordance with paragraphs (c) and (d) of the clause at FAR 52.225-9 for the offer that is based on the use of any foreign construction material for which the Government has not yet determined an exception applies.

(3) If the Government determines that a particular exception requested in accordance with paragraph (c) of the clause at FAR 52.225-9 does not apply, the Government will evaluate only those offers based on use of the equivalent domestic construction material, and the offeror shall be required to furnish such domestic construction material. An offer based on use of the foreign construction material for which an exception was requested-

(i) Will be rejected as nonresponsive if this acquisition is conducted by sealed bidding; or

(ii) May be accepted if revised during negotiations.

52.228-1 Bid Guarantee. (SEP 1996)

(a) Failure to furnish a bid guarantee in the proper form and amount, by the time set for opening of bids, may be cause for rejection of the bid.

(b) The bidder shall furnish a bid guarantee in the form of a firm commitment, e.g., bid bond supported by good and sufficient surety or sureties acceptable to the Government, postal money order, certified check, cashier's check, irrevocable letter of credit, or, under Treasury Department regulations, certain bonds or notes of the United States.

The Contracting Officer will return bid guarantees, other than bid bonds, (1) to unsuccessful bidders as soon as practicable after the opening of bids, and (2) to the successful bidder upon execution of contractual documents and bonds (including any necessary coinsurance or reinsurance agreements), as required by the bid as accepted.

(c) The amount of the bid guarantee shall be 20 percent of the bid price or $3,000,000.00, whichever is less.

(d) If the successful bidder, upon acceptance of its bid by the Government within the period specified for acceptance, fails to execute all contractual documents or furnish executed bond(s) within 10 days after receipt of the forms by the bidder, the Contracting Officer may terminate the contract for default.

(e) In the event the contract is terminated for default, the bidder is liable for any cost of acquiring the work that exceeds the amount of its bid, and the bid guarantee is available to offset the difference.

(a) Definitions. As used in this provision-

Administrative proceeding means a non-judicial process that is adjudicatory in nature in order to make a determination of fault or liability (e.g., Securities and Exchange Commission Administrative Proceedings, Civilian Board of Contract Appeals Proceedings, and Armed Services Board of Contract Appeals Proceedings). This includes administrative proceedings at the Federal and State level but only in connection with performance of a Federal contract or grant.
