B.2 GENERAL INFORMATION

PROPOSAL SUBMISSION

Offerors providing less than 60 calendar days for Government acceptance after the date proposals are due will not be considered and will be rejected.

Potential Offerors must be registered in the System for Award Management (SAM) to be eligible for an award (See Internet Site=https://www.sam.gov/portal/public/SAM/). Potential Offerors must also have a current Online Representations and Certification Application on file with SAM.

REQUESTS FOR INFORMATION (RFI)

To obtain clarifications and/or additional information concerning the contract requirements or specifications, submit a written RFI utilizing the RFI Submission Form included in this proposal request as an attachment, which is to be sent via email to daniel.lara@usda.gov. See RFI form for specifics.

RFI responses will be responded to as necessary in amendment.

Deadline for submission of RFIs for this solicitation is June 11, 2020 at 3:00PM PST. No questions will be answered after this date/time unless determined to be in the best interest of the Government as determined by the Contracting Officer. Telephone requests for information will not be accepted or returned.

SITE VISIT

Scheduled site visit is set for June 2nd @ 10:00 AM. Meet onsite at Oak Grove Fire Station (37560 Hwy 79 South, Warner Springs, CA 92086) followed by El Cariso Hotshot Camp (Gifford Pinchot Lane, Lake Elsinore, CA 92530) around 11:30 AM. Directions are available in section C. Silverado Fire Station site will not have a scheduled site vist. Offerors can visit site on their own.

Please send notification to Daniel.lara@usda.gov if you plan on attending site visit by June 1st.

In no event shall failure to inspect the site constitute grounds for a claim after contract award.

SECTION C--DESCRIPTION/SPECIFICATIONS/STATEMENT OF WORK

C.1 PROJECT DESCRIPTION

The project consists of work included here, but not limited to:

Base Bid: Oak Grove Fire Station Storage/Previous Engine Garage Building

Demolition of one storage/previous engine garage building, approximately 1575 square feet, built 1938.

Removal and disposal of storage building, all interior utilities and fixtures, concrete footing, concrete slab on grade, miscellaneous debris; disposal of hazardous materials (lead based paint); exterior utilities (water, sewer) to be cut and capped at both ends approximately eighteen inches below grade, backfilling and compaction of slab, footing, and utility areas with imported material to restore the site to its natural conditions, and patching of asphalt areas with concrete where needed. The contract work area is fifty feet beyond building footprint in all directions, with the exception of utility shut off locations.

No other ground disturbance shall take place.

The Oak Grove Fire Station is located on approximately eleven acres, and there are barracks, engine garage, offices, residences and storage buildings near the proposed work. These areas are not to be disturbed.

Option 1: Silverado Fire Station Mobile Home

Demolition of one double wide mobile home, approximately 1312 square feet, built 2002. Removal and disposal of mobile home, interior and exterior utilities and fixtures; exterior utilities (water, sewer) to be cut and capped at both ends approximately eighteen inches below grade. The contract work area is ten feet beyond the building footprint in all directions, with the exception of utility shut off locations. No other ground disturbance shall take place.

Option 2: El Cariso Hot Shot Camp Two Mobile Homes

Demolition of two double wide mobile homes, approximately 735 square feet each, built 1994.

Removal and disposal of mobile homes, interior and exterior utilities and fixtures; all exterior utilities (water, sewer) to be cut and capped at both ends approximately eighteen inches below grade. The contract work area is ten feet beyond the building footprint in all directions, with the exception of utility shut off locations. No other ground disturbance shall take place.

1.2 PROJECT LOCATION

Base Bid: Oak Grove Fire Station, 37560 Hwy 79 South, Warner Springs, CA 92086, San Diego County. From San Diego, California, travel north on Interstate 15 for approximately 50 miles to Temecula and take the Temecula Parkway/Highway 79 South exit. Turn right and travel east for approximately 20 miles to the Oak Grove Fire Station on the right (south) side of the highway.

Option 1: Silverado Fire Station, 27172 Silverado Canyon Road, Silverado, CA 92676, Orange County.

From San Diego, California, travel north on Interstate 5 for approximately 80 miles to the El Toro Road exit. Then turn right and travel east approximately 11 miles (El Toro Road turns into Santiago Canyon Road) to Silverado Canyon Road. Turn right and travel approximately one half mile to the Silverado Fire Station on the right (north) side of the road.

Option 2: El Cariso Hot Shot Camp, Gifford Pinchot Lane, Lake Elsinore, CA 92530, Orange County.

From San Diego, California, travel north on Interstate 15 for approximately 65 miles to Elsinore and take the Highway 74 exit. Then travel west for approximately 23 miles to Long Canyon Road. Turn right and travel approximately 1.2 miles to the El Cariso Hot Shot Camp on the left (north) side of the road.

1.3 SPECIFICATIONS

The Construction Specification Institute (CSI) specifications are included by reference. The requirements contained in these specifications are hereby made a part of this solicitation and any resultant contract. CSI specifications applicable to this contract are listed below and are contained in this contract.

1.4 TIME OF PERFORMANCE

Contract time is limited to 52 calendar days from the issuance of the Notice To Proceed, and includes time for base bid and all option items, fire days, weather days, holidays, and weekend days.

1.5 CONTRACT ADMINISTRATION

Before beginning work, the Contracting Officer or the Contracting Officers Representative (COR) will meet with the Contractor. The meeting will be held at a time and place mutually agreeable to the Contrator and the Forest Service. The contract documents, the scope of the contract and the proposed work schedule will be thoroughly discussed to promote a better understanding between the Contractor and the Forest Service. The Contractor shall name and assign a responsible person as Project Manager and Site Superintendent. He/She shall maintain a project file to contain all correspondance and criteria pertinent to this project. During the process of the work, the Contractor shall confer with the COR, as required, to assure approval of the work completed.

1.6 FEES

The Contractor shall, without additional expense to the Government, pay all Federal, State, County, Municipal and utility company fees, applicable to the performance of the work.

1.7 APPLICABLE CODES AND REGULATIONS

The contractor shall comply with all applicable Federal, State, Interstate, County, local laws, and environmental regulations and requirements. This includes, but is not limited to, compliance with the National Contingency Plan (NCP), the Resource Conservation and Recovery Act (RCRA); the Comprehensive Environmental Restoration Compensation and Liability Act (CERCLA), 40 CFR Chapter 1, the California Health and Safety Code; California Code of Regulations (CCR) Title 22, Division 4.5; California Code of Regulations Title 24, Part 2; the San Diego and Orange County Air Pollution Control District, the Regional Water Quality Control Board, and the County Department of Public Health. The responsibility of the Contractor to comply with all current applicable laws, regulations and requirements takes precedence over any other duty or task described herein. Therefore, in the event that subsequent legislation or regulations conflict with prescribed procedures contained in this contract, said changes shall take precedence.

All work submitted and performed by the Contractor may be subject to the review and approval of Environmental Protection Agency (EPA) and/or the appropriate State and local regulatory agency.

Therefore, it is the responsibility of the Contractor to contact the appropriate regulatory agency(s) to determine their requirements for each individual project. The Contractor will be responsible for submitting reports to regulatory agencies unless other arrangements are approved by the Contracting Officer’s Representative (COR). It is the Contractor’s responsibility to find out from the regulatory agency(s) which guidance materials are current and applicable.

The Contractor shall, without additional expense to the Forest Service, be responsible for obtaining any necessary licenses and permits, and for complying with any applicable Federal, State and local laws, codes, and regulations in connection with the execution of the work. This includes ensuring project related hazardous or toxic wastes are sent to licensed, permitted, and approved disposal sites. The Forest Service will obtain, as necessary, the required temporary EPA Identification Number for site cleanup activities.

All work shall comply with the applicable requirements of the Code of Federal Regulations (29 CFR) and State (Title 8 CCR) OSHA. All work shall comply with applicable State and municipal safety and health requirements. Where there is a conflict between applicable regulations, the most stringent shall apply.

1.8 CONTRACTOR QUALIFICATIONS AND LICENSES

Contractor must possess the certifications listed below. All required certifications must be current at time of contract award. This is not all inclusive and is subject to change as new Federal, State, Interstate, County and local laws and regulations are implemented and existing Federal, State, Interstate, County and local laws and regulations are revised.

Lead Based Paint. Contractor must be California trained and certified to perform work involving lead based paint outlined in this contract.

Hazardous Waste Transportation. Contractors transporting hazardous waste must be registered with the State. Statutory requirements governing hazardous waste transportation in California require any person who transports hazardous waste in a vehicle to have a valid registration issued by the Department of Toxic Substances Control (DTSC) in his or her possession while transporting the hazardous waste.

Hazardous Waste Operations (HAZWOPER). Contractor shall maintain current 40 hour HAZWOPER certification.

Contractor shall possess a current A or C-21 class license issued by the State of California.

1.9 PERMITS

The contractor shall obtain all special permits and licenses and give all notices required for the performance and completion of the demolition and removal work, hauling, and disposal of debris.

Demolition of structures covered under this Statement of Work may also require a permit from Cal/OSHA if the structure to be demolished is higher than three stories of 36 feet, or the demolition work would require a 5 foot or deeper excavation into which a person needs to descend. To prevent delays in accomplishing the work identified in this Statement of Work, the Contractor shall review the list of structures to be demolished and identify structures requiring both permits. The Contractor is responsible for obtaining all permits and requesting permit extensions.

1.10 NOTIFICATIONS AND INSPECTIONS

The Contractor shall be responsible for completing all notifications required to perform the activities covered in this Statement of Work.

The Contractor shall be responsible for scheduling all required inspections within the time frame specified to prevent delays in accomplishing the activities covered in this Statement of Work.

1.11 HEALTH AND SAFETY PLAN

The Contractor shall perform all operations in a prudent, conscientious, safe and professional manner.

At a minimum, the Contractor’s personnel and equipment shall comply with applicable Federal, State, County and local laws, safety and health regulations and procedures, a well as Forest Service regulations, rules and procedures. The Contractor shall ensure that its agents, employees and subcontractors perform in a safe manner. The Contractor shall ensure that all personnel involved in handling hazardous materials/waste and conducting emergency response and site cleanup activities are trained in the level of expertise required for the proper performance of the work activities.

The Contractor shall erect and maintain temporary bracing, shoring, fences, warning lights, barricades, signs, and other measures as necessary to protect the public, workers, and adjoining property from damage from demolition work, all in accordance with applicable codes and regulations.

Open depressions and excavations occurring as part of this work shall be barricaded and posted with warning lights.

A Master Health and Safety Plan is required prior to initiation of work under this contract. The Health and Safety Plan, and amendments thereto, submitted under requirements of this contract shall be prepared by the Contractor’s health and safety manger. Plan shall include procedures for accident and follow up.

1.12 MATERIAL WASTE/SEGREGATION

The Contractor is responsible for ensuring that all hazardous and non-hazardous materials and wastes generated during activities undertaken pursuant to this contract are segregated so as to minimize the volume of hazardous wastes. Ninety (90) percent (determined by weight) of the inert material and seventy (70) percent (determined by weight) of the remaining material generated must be recycled, salvaged or reused. The Contractor is responsible for preparing the Debris Management Plan that may be required by San Diego and Orange County. Containers must be marked so that they are readily identified. In addition, the Contractor must ensure that there is a clear audit trail for all items until the final recycling or treatment/disposal is accomplished.

The Contractor is responsible for maintaining a daily log of all construction and demolition debris that leaves the site. The log and receipts must contain the weight of the debris the facility accepted and whether the material was disposed in a landfill or recycled. The log must be available onsite during demolition activities.

1.13 PACKAGING AND CONTAINER MARKING

The contractor shall package, mark, label and load all items in such a manner that all applicable Federal, state and local EPA and DOT regulations are met. Packaging, shipping names, marking, labeling, placarding, etc., under the terms of this contract will be in accordance with 49 CFR and 40 CFR. All hazardous waste containers shall be labeled in accordance with the requirements of 40 CFR Part 262, Subpart C, Part 264, Subpart I and Part 265, Subpart I and California CCR, Title 22, Division

4.5. If items must be repackaged for proper shipment the contractor shall perform such repackaging and furnish all required materials. When repackaging is necessary, the contractor shall be responsible for disposal of the original container and placarding in a manner that complies with all applicable federal, state, and local EPA and DOT regulations. The Contractor shall also provide and affix the appropriate placards to each vehicle prior to leaving specific project sites.

The Contractor shall ensure that all containers used for the packaging and repackaging of hazardous wastes are compatible with the materials they will hold. The Contractor is also responsible for ensuring that the containers they provide for the management of wastes comply with the requirements of 40 and 49 CFR and applicable state and local regulations.

If the Contractor elects to package compatible items in the same container, then the contractor must provide an all-inclusive packing list showing each item and its respective quantity. This list shall be placed outside the outermost container. A copy of the packing list must be attached to the manifest.

The Contractor is responsible for ensuring that all contaminated media (soil, water, etc.) are placed into the appropriate containers in compliance with applicable Federal and State environmental laws and regulations.

1.14 MANIFESTING

A uniform hazardous waste manifest is required for the removal of regulated hazardous wastes from National Forest Lands under this contract. Manifests and land disposal restriction notifications will be prepared by the Contractor in accordance with 40 CFR Part 262 Subpart B, Part 263 Subpart B, Part 264 Subpart E, Part 265 Subpart E and Part 268 as well as California CCR, Title 22, Division 4.5. A Forest Service representative shall sign the manifests as the generator. The Contractor shall review all manifests for completeness and accuracy prior to presenting them to the Forest Service for signature.

Completed copies of all manifests shall be furnished to the Forest Service office whose address appears on the manifests, as well as submitted as attachments to all invoices. Manifests shall be submitted in such a manner as to comply with the timeliness prescribed by the state and EPA regulations. Each manifest, as well as all other documentation required herein shall be clearly and distinctly marked with the contract number and delivery order number as applicable. If blocks are not provided, the contract and delivery order information shall be placed in the upper right hand corner of each document.

1.15 MATERIAL/WASTE MANAGEMENT ON NATIONAL FOREST LANDS

The Contractor(s) is responsible for ensuring that all materials and wastes generated during the activities of this contract are managed in compliance with Federal, state and local environmental laws and regulations. This includes ensuring that all excavated contaminated soils are immediately placed into appropriate containers upon excavation and not stored directly on the ground. In those instances where contaminated soil stockpiling is necessary, soils shall be placed on a liner for containment purposes.

The Contractor(s) is responsible for ensuring that all containers of hazardous waste generated under the activities of this contract are removed from National Forest lands within 60 days of generation.

The Contractor shall dispose of removed materials, waste, trash, and debris in a safe, acceptable manner, in accordance with applicable laws and ordinances and as prescribed by authorities having jurisdiction.

Burying of trash and debris on the site will not be permitted. Burning of trash and debris at the site will not be permitted.

The Contractor shall remove trash and debris from the site at frequent intervals so that their presence will not delay the progress of the work or cause hazardous conditions for workers or the environment.

Removed materials, trash, and debris shall become the property of the Contractor and shall be removed from the Forests’ property and disposed of in a legal manner. Location of disposal site and length of haul shall be the Contractor's responsibility.

1.16 TRANSPORTERS

For all hazardous wastes transported under this contract, the Contractor shall present at time of offer, all applicable state waste hauler licenses and hauler numbers. Only experienced, licensed, transporters shall be used to haul hazardous wastes under this contract. The Contractor shall also provide and affix appropriate placards to each vehicle prior to leaving Forest Service premises and ensure that all EPA, DOT and State transporter requirements are met.

The contractor will comply with, and ensure that all applicable subcontractors comply with, all requirements of 49 CFR 100-199, regarding waste transportation under this contract. Complete compliance with these regulations shall include, but not be limited to, ensuring that emergency response information is carried on transport vehicles and maintained at facilities where hazardous materials are received, stored, or handled during transportation. Shipping papers will contain an emergency response telephone number supplied by the disposal contractor which is monitored 24 hours a day in order to provide immediate, detailed emergency information to personnel reacting to emergencies. 1.17 OFF-SITE RECYCLING AND TREATMENT/STORAGE/DISPOSAL FACILITIES

The Contractor shall identify each recycling and/or Transfer, Storage and Disposal (TSD) facility, which may receive hazardous wastes under this contract. Each TSD facility must have, as a minimum;

EPA RCRA permitted or state approval as a treatment or disposal facility and is in good standing with the regulatory community. The Contractor agrees that no facility other than those initially accepted by the Government in the award process will be used. The Forest Service on a case-by-case basis may accept additional TSD facilities.

In an effort to reduce the Region’s future liability for the wastes it generates, ALL wastes and contaminated media managed under this contract shall be sent to only those treatment/ storage/disposal facilities that are in compliance with EPA’s “Off-Site Rule” (40 CFR 300.400 on the U.S.

Environmental Protection Agency’s “Off-Site Rule” list). The Contractor shall provide confirmation that the proposed off-site facility is Off-Site Rule compliant prior to the initiation of any shipment.

1.18 WORK PLAN

The Contractor(s) shall provide the Government with three (3) copies of the Work Plan for the project.

This Work Plan shall include, but is not limited to, the following:

A listing of personnel, including subcontractor(s), working on the project. Training, certification and licensing requirements for personnel performing demolition. Qualifications and experience of personnel and subcontractors including the registered civil engineer that will be overseeing the work to be performed. Documentation of Hazardous Waste Operations Training, Lead-Based Paint Certification for on-site personnel as well as license and registration for personnel involved in transporting hazardous waste generated by activities covered under this contract.

Detailed description of how the demolition activities will be performed.

Quality Assurance and Quality Control Plan.

Waste storage and disposal methods.

Site Specific Safety & Health Plan.

Site Specific Emergency Response Plan.

Procedures for protecting soils, vegetation and watersheds during demolition and excavation.

Specific exclusions/assumptions regarding the specific work to be performed.

List of equipment to be used on the project.

List of supplies to be provided.

Permit and notification requirements.

Utility abandonment requirements.

Storm water pollution prevention measures.

Dust control.

Debris Management Plan.

A hazardous material/waste management plan, which includes waste identification protocol, an explanation for reuse/disposal chosen, identification of the selected recycling facility or TSD facility.

Documentation and certification of the facility’s ability to accept hazardous materials/wastes shall be provided as an attachment to the work plan.

Backfill and compaction of depressions caused by excavation, demolition or removal.

Project Work Schedule.

Detailed cost estimate of work to be performed.

During field work, if substantial or unexpected latent materials or improvements are encountered on the site, Contractor shall immediately notify the Forest Contracting Officer for direction. Proceeding with cleanup or removal work without Forest Contracting Officer approval will be at the Contractors expense.

All work plans must be approved in writing by the Government prior to the commencement of that phase of work. All work plans shall include a wet ink signature and seal by one or more of the following California Registered professionals who have a minimum of five years of experience in the environmental field and demolition of structures:

1.19 CONTRACTOR DESIGNATION

The Contractor shall designate in writing a Site Superintendent to coordinate all activities during construction and to liase with the Contracting Officers Representative and Project Engineer for the Forest Service. Contractors Site Superintendent shall be on site at all times any work is being performed.

1.20 STORMWATER POLLUTION PREVENTION PLAN

The Contractor shall prepare a stormwater pollution prevention plan in accordance with Specification Section 01 57 24, Stormwater Pollution Control, prior to commencing work. The plan shall be submitted to the Contracting Officer for review and approval prior to submitting it for regulatory review.

1.21 FIRE PLAN

Contractor is responsible to complete and abide by the enclosed Forest Fire Plan. All welding and cutting (spark producing) activities will require a permit from the Palomar Ranger Station and/or Trabuco Ranger Station. All equipment must have approved spark arrestors and be inspected by a Forest Service Fire Prevention Officer.

The period of performance of this contract is from 52 Calendar Days with an estimated start work date of August 1st, 2020.

F.3 WORK TIMING

No work may begin on this contract until the Contracting Officer has issued a Notice to Proceed.

The Contractor shall begin work within 10 calendar days after the effective date of the Notice to Proceed and shall prosecute the work at a rate that will result in completion of all work within the following time frame:

Failure to begin work on schedule will make the contract subject to immediate termination for default.

Delays due to normal adverse weather, weekends, and holidays have been included in the calculation of contract time. The Government reserves the right to set the priority of items or sub-items. Contractor shall complete all work on one sub-item before proceeding to another.

SECTION G--CONTRACT ADMINISTRATION DATA

G.1 FAR 52.236-26 PRECONSTRUCTION CONFERENCE (FEB 1995)

If the Contracting Officer decides to conduct a preconstruction conference, the successful offeror will be notified and will be required to attend. The Contracting Officer’s notification will include specific details regarding the date, time, and location of the conference, any need for attendance by subcontractors, and information regarding the items to be discussed.

G.2 GOVERNMENT-FURNISHED PROPERTY (GFP)

The Government will provide the following item(s) of Government property to the Contractor for use in the performance of this contract: (No GFP identified at this time). This property shall be used and maintained by the Contractor in accordance with the provisions of the "Government Property" FAR clause contained elsewhere in the contract.

G.3 DESIGNATION OF CONTRACTING OFFICER’S REPRESENTATIVE

The Contracting Officer will designate a Contracting Officer's Representative (COR) at the time of contract award.

The COR is responsible for administering the performance of work under this contract. In no event, however, will any understanding, agreement, modification, change order, or other matter deviating from the terms of this contract be effective or binding upon the Government unless formalized by proper contractual documents executed by the Contracting Officer prior to completion of the contract.

The Contracting Officer should be informed as soon as possible of any actions or inactions by the Contractor or the Government which will change the required delivery or completion times stated in the contract, and the contract will be modified accordingly. (This does not apply to individual task assignments which were issued by the COR provided they do not affect the delivery schedule or performance period stated in the contract).

On all matters that pertain to the contract terms the Contractor must communicate with the Contracting Officer. Whenever, in the opinion of the Contractor, the COR requests effort outside the scope of the contract, the Contractor should so advise the COR. If the COR persists and there still exists a disagreement as to proper contractual coverage, the Contracting Officer should be notified immediately, preferably in writing if time permits. Proceeding with work without proper contractual coverage could result in nonpayment or necessitate submittal of a contract claim.

The COR is delegated full authority under this contract except for the following actions which are reserved for the Contracting Officer:

1. Issue the Notice to Proceed / Stop-Work Order.

2. Approve Change Orders and Modifications.

3. Take Action to terminate the contract for default or Government convenience.

4. Make contract adjustments under the Differing Site Conditions clause.

5. Grant extensions of contract time.

6. Approve assignment of claims.

7. Make final decisions under the Disputes clause

8. Make final acceptance under the contract.

9. Make final decisions under the Stop-Work Order clause.

10. Make equitable adjustments.

11. Authorize change in amount of Payment Retention.

12. Approve subcontractors.

13. Approve payment with deductions or final payment.

14. Approve use and possession prior to completion.

15. Enforce the warranty provisions.

G.4 ELECTRONIC INVOICING AND PAYMENT REQUIREMENTS – INVOICE PROCESSING

PLATFORM (IPP)

Payment requests must be submitted electronically through the U.S. Department of the Treasury’s Invoice Processing Platform (IPP) System. “Payment request” means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions – Commercial Items included in commercial item contracts. The IPP website address is: https://www.ipp.gov.

The Contractor must use the IPP website to register access and use IPP for submitting requests for payment. The Contractor Government Business Point of Contact (as listed in SAM) will receive enrollment instructions via email from the Federal Reserve Bank of Boston (FRBB) prior to the contract award date, but no more than 3 – 5 business days of the contract award date.

SECTION H--SPECIAL CONTRACT REQUIREMENTS

H.1 PROTECTION OF EXISTING VEGETATION, STRUCTURES, EQUIPMENT, UTILITIES,

AND IMPROVEMENTS ( FAR 52.236-9) (APR 1984)

(a) The Contractor shall preserve and protect all structures, equipment, and vegetation (such as trees, shrubs, and grass) on or adjacent to the work site, which are not to be removed and which do not unreasonably interfere with the work required under this contract. The Contractor shall only remove trees when specifically authorized to do so, and shall avoid damaging vegetation that will remain in place. If any limbs or branches of trees are broken during contract performance, or by the careless operation of equipment, or by workman, the Contractor shall trim those limbs or branches with a clean cut and paint the cut with a tree-pruning compound as directed by Contracting Officer.

(b) The Contractor shall protect from damage all existing improvements and utilities (1) at or near the work site and (2) on adjacent property of a third party, the location of which are made know to or should be known by the Contractor. The Contractor shall repair any damage to those facilities, including those that are the property of a third party, resulting from failure to comply with the requirements of this contract or failure to exercise reasonable care in performing the work. If the Contractor fails or refuses to repair the damage promptly, the Contracting Officer may have the necessary work performed and charge the cost to the Contractor.

H.2 USE OF PREMISES

(a) Before any camp, quarry, borrow pit, storage, detour, or bypass site, other than shown on the drawings, is opened or operated on USDA land or lands administered by the USDA, written permission shall be obtained through the Contracting Officer. A camp is interpreted to include the campsite or trailer parking area of any employee working on the project for the Contractor.

(b) Camping: No camping site is nearby.

H.3 ARCHAEOLOGICAL OR HISTORIC SITES (USDA 452.236-73) (FEB 1988)

If a previously unidentified archaeological or historic site(s) is encountered, the Contractor shall discontinue work in the general area of the site(s) and notify the Contracting Officer immediately.

The Contracting Officer’s Representative shall immediately notify the Forest Archaeologist.

Work may resume after approval by the Forest Archaeologist; provided any recommended Standard Protection Measures are implemented. Should any cultural resources become damaged in unanticipated ways by Contractors activities, the steps for inadvertent effects will be followed, as advised by the Forest Archaeologist.

H.4 CONTROL OF EROSION, SEDIMENTATION AND POLLUTION (USDA 452.236-74)

(FEB 1988)

(a) Operations shall be scheduled and conducted to minimize erosion of soils and to prevent silting and muddying of streams, rivers, irrigation systems, and impoundments (lakes, reservoirs, etc.).

(b) Pollutants such as fuels, lubricants, bitumens, raw sewage, and other harmful materials shall not be discharged on the ground; into or near rivers, streams, and impoundments; or into natural or manmade channels. Wash water or waste from concrete or aggregate operations shall not be allowed to enter live streams prior to treatment by filtration, settling, or other means sufficient to reduce the sediment content to not more than that of the stream into which it is discharged.

(c) Mechanized equipment shall not be operated in live streams without written approval by the Contracting Officer.

H.5 STORAGE AND STOCKPILING OF MATERIALS

Material shall be stored to assure the preservation of quantity and fitness for the work. Stored materials shall be located to facilitate their promt inspection. Sites on Forest Service administered land, approved by Forest Service, may be used for storage purposes and for the placing of Contractor's plant equipment. All storage sites provided by Forest Service shall be restored at Contractor's expense. Contractor shall be responsible for making arrangements for storage on other than Forest Service administered land.

H.6 EMERGENCY CONTROL (USDA 452.236-77) (NOV 1996)

(a) Contractor's Responsibility for Fighting Fire. (1) The Contractor, under the provision of FAR clause 52.236-9, PROTECTION OF EXISTING VEGETATION, STRUCTURES, EQUIPMENT, UTILITIES, AND IMPROVEMENTS, shall immediately extinguish, all fires on the work site other than those fires in use as a part of the work. (2) The contractor may be held liable for all damages and for all costs incurred by the Government for labor subsistence, equipment, supplies, and transportation deemed necessary to suppress a fire set or caused by the Contractor or the Contractor's agent or employees.

(b) Contractor's Responsibility for Notification in Case of Fire. The Contractor shall immediately notify the Government of any fires sighted on or in the vicinity of the work site.

(c) Contractor's Responsibility for Responding to Emergency. When directed by the Contracting Officer, the Contractor shall allow the Government to temporarily use employees and equipment from the work site for emergency work (anticipated restricted to firefighting). An equitable adjustment for the temporary use of employees and equipment will be made under the CHANGES clause, FAR 52.243-4.

H.7 FIRE PROTECTION REQUIREMENTS

The following fire requirements are attached in Section J and are applicable to this contract:

H.8 LANDSCAPE PRESERVATION

(a) The Contractor shall confine operations to within the clearing limits or other areas designated in contract documents and prevent the depositing of rocks, excavated materials, stumps, or other debris outside of these limits. Material which falls outside of these limits shall be retrieved, disposed of, or incorporated in the work as directed by the Contracting Officer.

(b) Prevention of Oil Spills. If the Contractor maintains storage facilities for oil or oil products onsite, appropriate preventive measures shall be taken to ensure that any spill of such oil or oil products does not enter any stream or other waters of the United States or any of the individual states.

Servicing of all equipment shall be done only in the area approved by the Contracting Officer.

If the total oil or oil products storage exceeds 1,320 gallons or if any single container exceeds a capacity of 660 gallons, the Contractor shall prepare a Spill Prevention Control and countermeasures (SPCC) Plan. Such plan shall meet applicable EPA requirements (40CFR

112) including certification by a registered Engineer.

The Contractor will be required to make reasonable attempts to preserve the scenic and natural environment along this construction project.

(c) Trash and Refuse. The Contractor shall remove all of its own trash and refuse from the contract area. Material to be removed includes, but is not limited to; used engine oil, oil filters, oil cans, grease cartridges, camp refuse such as tin cans, paper, garbage, etc. This material must be removed to a State, County, or Municipality-designated solid waste disposal area.

H.9 BARRICADES, WARNING SIGNS, AND OTHER DEVICES

The contractor shall provide, erect and maintain all necessary barricades, suitable and sufficient lights, danger signals, signs, flaggers, pilot cars and other traffic control devices, and shall take all necessary precautions for the protection of the work and safety of the public. Barricades and other obstructions shall be illuminated during the hours of darkness. Suitable warning signs shall be provided to properly control and direct traffic. All operations shall conform to the current requirements and guidelines of the Occupational Safety and Health Administration (OSHA) and the Manual of Uniform Traffic Control Devices (MUTCD).

The contractor shall erect warning signs in advance to any place on the project where operations may interfere with the use of the road or trail by traffic and at all intermediate points.

H.10 EQUIPMENT CLEANING

All off-road equipment used on this project shall be washed before moving into the project area so that the equipment is free of soil, seeds, vegetative material, or other debris that could contain or hold seeds of noxious weeds. “Off-road equipment” includes all logging and construction equipment and such brushing equipment as brush hogs, masticators, and chippers; it does not include log trucks, chip vans, service vehicles, water trucks, pickup trucks, and similar vehicles not intended for off-road use.

Equipment will be considered clean when visual inspection does not reveal soil, seeds, plant material, or other such debris. Disassembly of equipment components or specialized inspection equipment is not required. Contractor shall notify the Contracting Officer at least five days in advance of moving equipment in so that arrangements can be made for inspection.

If the project area is known to contain noxious weeds, the equipment shall be cleaned before moving to other Forest Service system lands which do not contain noxious weeds.
