FAR 52.212-2 EVALUATION—COMMERCIAL ITEMS. (OCT 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
• Past Performance
• Experience and Expertise
• Utilization of Local Work Force
• Price. A price evaluation will be performed to determine the reasonableness of the proposed price. Reasonableness will be determined considering other competitive prices received and comparison to the independent Government estimate (IGE). The Government will look at whether a proposed price is too high and may also consider whether a proposed price is too low, since this might indicate a lack of technical understanding on the offeror's part or a performance risk associated with the proposal that the agency may not be willing to accept. Whether a price is too high or too low may be considered in the context of comparison to other price proposals as well as to the IGE or to any other information the contracting officer deems useful in his or her discretion. If multiple contract line items are included in the price schedule, prices will also be evaluated to determine whether any line items are unbalanced. Offerors are cautioned to distribute costs appropriately.
Non-price evaluation factors when combined are more important than cost or price in the award decision.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
Quote Instructions. Quotes will be evaluated to determine the ability of the contractor to meet the requirements of the Government. Therefore, the Quote must present sufficient information to reflect a thorough understanding of the requirements and a detailed description of the organization, techniques, procedures and program for achieving the objectives of the specifications/statement of work. At a minimum, the Quote must clearly address the following:
• Past Performance. Past Performance is a measure of the degree to which the offeror has satisfied the customers in the past, and complied with Federal, state, and local laws and regulations. The assessment of Past Performance will be subjective, and based mainly on the offeror’s reputation with customers and others. The Government reserves the right to obtain information for use in the evaluation of past performance from any and all sources including Federal, state and local government agencies, better business bureaus, published media, electronic databases, as well as personal knowledge of evaluators. The evaluation may also take into account performance of key personnel regarding predecessor companies or subcontractors, if applicable. NOTE: In the case where an offeror lacks Past Performance experience, the offeror will not be evaluated either favorably or unfavorably in this area but will receive a neutral rating in the area of past performance (FAR 15.305). With their Quote, offerors may also include customer letters of commendation, etc., with customer points of contact and telephone numbers for past performance references.
• Experience and Expertise. Experience is knowledge or practical wisdom gained from what one has observed, encountered, or undergone. Expertise is extensive or in-depth specialized knowledge, skills, and judgment to accomplish a result or to accomplish one's job effectively. Offerors should present information demonstrating the firm’s experience and expertise relevant to the work for which an offer is submitted. Offers will be assessed by relevant experience on the basis of its breadth and its depth.
• Utilization of Local Work Force. Explain how you will recruit and utilize labor, subcontractors, and other workforce from the local community, as available skills allow. Identify personnel if possible.
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
