Performance Based Statement of Work (PBSOW)

Nilgai Harvesting for the Cattle Fever Tick Eradication Program

I. Background

Cattle fever ticks are established within a permanent quarantine zone in South Texas. USDA and the Texas Animal Health Commission (TAHC) work fervently to detect, quarantine, and treat infestations found in and sometimes out of the zone. Complications occur when wildlife move ticks undetected from one area to another. Historically white tailed-deer have been seen as the main culprit. More recently nilgai (Boselaphus trogocamelus) are emerging as a larger threat in controlling cattle fever ticks. Nilgai antelope are large ungulates native to India. In India, they have been known to transmit foot and mouth disease and malignant catarrhal fever, carry numerous endo- and ectoparasites, and can be infected with babesiosis. Furthermore, they have been found (by PCR) to be infected with Babesia bovis and Babesia bigemina (the agents of bovine babesiosis) in Mexico . They serve as hosts for cattle fever ticks (Rhipicephalus microplus and R. annulatus) and move these ticks (and potentially Babesia parasites) throughout their range including over the border from Mexico.

In South Texas, nilgai have no native predators, live in favorable environmental conditions, and are valued for exotic game hunting. Their numbers have blossomed from 13 individuals introduced in the late 1920s to presently around 38,000. They are popular game animals with hunts running $2,000 to $5,000 and no closed season. They are large animals (males can weigh over 600 pounds) and have large home ranges (as large as 31,533 hectares). Female year-long home ranges are 20% larger than the males'. During "tick friendly" July and August they experience a spike in their space use potentially helping the tick population grow and spread.

II. Objectives

Individually harvest by lethal shooting via helicopter as many nilgai as possible, estimated 20-50 nilgai, per harvest period, with an estimated 3-7 harvest periods. Harvesting will occur in multiple one-day periods, with a 5-15 hour flight period during the day. Harvest operations will be conducted September 2019-September 2020.

III. Contract Scope/Deliverables

The purpose of this contract is to help eradicate cattle fever ticks by the contractor providing all services, personnel, equipment to complete the above task. A private helicopter pilot along with helicopter crew and associated equipment, will be hired (by the contractor), to individually harvest from air as many nilgai as possible from designated area in southeast Texas. Helicopter team shall perform lethal head shots to nilgai 100% of the time during nilgai harvests.

Helicopter team must remain aware of premises boundaries so that no nilgai are harvested outside of the designated boundaries. The team will be provided a map of the boundaries. All nilgai will be harvested and meat inspected according to requirements for commercial meat sale and consumption.

During the term of the approved commercial nilgai harvester (approved mobile meat processer) agrees to harvest nilgai antelope on select properties in Cameron and/or Willacy Counties where requested. Scheduling may be discussed, but may be as often as one harvest day per week, or one harvest day every other week.

The approved commercial nilgai harvester will provide all personnel and equipment necessary for the harvesting, including supply of aerial crew pilot and gunner. Gunners are expected to be adept enough that 99% of the time the initial shot is a fatal head shot. The commercial harvester agrees to abide by all regulations as may be established relating to times and places of harvest, and agrees to conduct its harvesting operations in a manner, which will minimize any adverse effect on other livestock and wildlife on the property.

The harvester agrees to keep complete and accurate records of all nilgai harvested, including sex and carcass weights. Reports will be provided of all nilgai harvested. The inspector from the Texas Department of Health will sign a production report including weights of all nilgai carcasses.

The goal, when population is available, is to harvest 50 animals per harvest and the harvester agrees to harvest male and female nilgai indiscriminately per harvest day. Following harvest, 50% of the meat shall be donated. As harvester will not receive the normal percentage of meat for payment of services, the bid for harvesting should include costs incurred by harvester and crew in lieu of meat. Bid should include expenses incurred when 50% of meat is donated, with a goal of 50 head harvested/day. Harvester must submit invoice as required by contract.

Every effort will be made to provide at least 14 days advance notice to commercial harvester of any harvest cancelations or schedule changes not related to inclement weather conditions.

The commercial harvester agrees to indemnify and hold the federal government harmless from any and all claims of any kind or character asserted by any person or persons for personal injury or property damage sustained or claimed to have been sustained on the premises as a result of the operations of harvester or any cause within the control of harvester. Harvester shall maintain in effect a liability policy, to be issued by admitted Texas insurance carrier of not less than $1,000,000.00 per occurrence. A certificate of insurance shall be furnished if so needed.

IV. Type of Contract

This is a firm-fixed price (FFP).

Award Determination:

Technical and Past Performance is more important than price, V. Period of Performance The Delivery Order period of performance shall be for a year from September 2019-September, 2020.

XIII. SAFETY AND SECURITY REQUIREMENTS

a. In accordance with the USDA regulations, a Background Investigation is required prior to starting work under this contract as well as maintaining it throughout the duration of the contract. Prior to start of work, the CONTRACTOR shall provide only fully qualified and properly cleared employees for the work to be performed under this SOW. The contractor shall, through their own internal background investigation protocol and pre-employment investigation, ensure that each employee submitted for a background investigation is reasonably expected to receive a favorable adjudication of their respective investigations and training.

b. The USDA, APHIS will pay for the required background investigations. The government shall have and exercise full and complete control over granting, denying, withholding, or termination the background investigation clearance for employees.

c. All contractor personnel that will have access to the APHIS facilities will be required to have a Background Investigation (BI) with no less than favorably adjudicated returned results.

Once approved and working at the facilities, contractor personnel shall not be removed or diverted from the site without prior notification to the designated COR. The COR will work with HR Classification to determine the level of background investigation for those prime and subcontractor employees consistent with those position sensitivity designations in the Homeland Security Presidential Directive (HSPD) 12. The level of background investigation required will depend upon the work of the position. It is estimated the type of BI’s required for the various personnel will be one of the following: National Agency Check with Inquiries (NACI), Minimum Background Investigation (MBI), or Limited Background Investigation (LBI) either a Public Trust, High Risk or a Public Trust, Moderate Risk - Minimum Background Investigation. The APHIS Security staff will advise the contractor on the appropriate type of BI required under this contract.

d. The contractor shall not employ persons for work on this contract if such employee is considered by the contracting officer to be a potential threat to health, safety, general well-being or operational mission of USDA and its employees. If the contracting officer finds a prospective employee to be unsuitable for his or her assigned duties, the contractor will be advised immediately that such employee cannot continue to work or be assigned to work under the contract.

(a) Contractors shall comply with the personal identity verification (PIV) policies and procedures established by the AGAR Advisory No. 81, Revision 03 dated July 19, 2010 – Common Identification Standard for Contractors. In addition, procedures to be followed by contractors and contractor employees are specified in the Departmental Regulation and Departmental Manual (DM) 4620-002. Copies can be downloaded from the website at http://hspd12.usda.gov

(b) All applicable contractor employees requiring routine, long term (the aggregate of 6 months or more) physical access to Federally-controlled facilities or routine access to Federally-controlled information systems must go through the identify proofing, registration, and e-verify process, and have a successful background investigation conducted by OPM. The level of investigation required is dependent on the duties and may require a low-risk non-sensitive National Agency Check with (Written) Inquiries, an

Office of Personnel Management (OPM) Public Trust or an OPM National Security background investigation to serve on the contract. E-Verify is an electronic system which checks employee information obtained from the Employment Eligibility Verification form (I-9 form) against records maintained by both the Department of Homeland Security (DHS) and the Social Security Administration (SSA). If the information input matches the DHS and SSA records, an ‘employment authorized’ message will be received. However, any discrepancy between the information input and the records at DHS and SSA will result in an alert being issued. The alert is called a Notice of Tentative Non-Confirmation (TNC) and further action is required. All background investigations or clearances must be done one week prior to commencing work. Where this is not practical and the prime or subcontractor requires intermittent access to federally controlled facilities or are under the aggregate 180 day limit, a temporary guest ID badge will be issued and/or such laborer may be under constant supervision and their access to areas or data may be more restricted. Laborers who will NOT have routine unaccompanied physical access to a Federally-controlled facility and/or routine unaccompanied access to a Federally-controlled information system may be excluded from coverage by AGAR Advisory 81 based on the LincPass Distribution Risk Assessment. The LincPass Distribution Risk Assessment will be conducted by a USDA Sponsor for laborer’s (Contracting Officer’s Representative, or other Government designated program/project officers) as part of the PIV II registration, identity proofing, and credential issuance procedures. Examples of probable exclusion are couriers, express mail and package or other delivery persons.

(c) The Contractor shall provide to the USDA PIV Sponsor and the Personnel Security Specialist listed below, a list of all contractor and subcontractor employees full name, job title, employer (prime or subcontractor), contract number, performance period and/or the days employee is expected to be on-site for base year and each period of performance, if applicable, and information on OPM’s background investigation or clearance conducted by the prime or subcontractor and that contractor employees pass the background check.

(d) The Contractor shall take full responsibility to ensure that prime and subcontractor employees who require routine, long-term physical access to federally controlled facilities and logical access to Federally controlled information systems except for "national security systems" as defined by 44 U.S.C. 3542(b)(2), are required to complete and submit HRO 1197, Contractor Supplement and the AD-1197, Request for USDA Identification (ID) Badge, along with copies of two identity source documents (one being a photo ID) and two completed fingerprint cards (FD-258 attached), to the following. You can obtain these forms and further guidance from the Personnel Security Specialist who oversees the investigation process for contractors:
