Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is "late" and will not be considered unless it is received before award is made and the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition.

(ix) 52.212-2 Evaluation – Commercial Products and Commercial Services (NOV 2021) (Provision)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

Evaluation Criteria

The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, BASIS OF AWARD: A contract will be awarded to the lowest-priced technically acceptable offeror.

Quotes will be evaluated for acceptability but will not be ranked using the non-cost/price factors.

In order to be eligible for award, offerors must receive a rating of “acceptable” in every non-price factor/subfactor. In the interest of economy and efficiency, the Government will start by evaluating the technical quote of the lowest-priced offeror and will award to that offeror if the technical quote is rated “technically acceptable”. If the lowest offeror receives a rating of “unacceptable” in any of the non-cost factors, the Government will then move on to evaluating the technical quote of the next lowest offeror and so on until a quote is rated “technically acceptable”. Therefore, the technical quote of the non-low price offerors may or may not be evaluated.

The following factors and sub-factors will be used to determine technical acceptability. Offeror shall provide the narratives that fully address each of the evaluation factors in order to be considered for award, including for any subcontractors, to evaluate the following factors and subfactors:

Factor #1 – Technical Capability of Offeror. In order to receive a rating of “acceptable”, offer must at a minimum, demonstrate adequate experience and technical capability of the services offered to meet or exceed the technical specifications. Specifically, the Government will evaluate for the following and each category must receive a rating of acceptable in order to receive an overall rating of acceptable in this factor:

• Subfactor #1.1 – Experience in performing – In order to receive a rating of acceptable, offer must demonstrate 3 years or more experience providing the requested product/services.

• Subfactor #1.2 – Equipment – In order to receive a rating of acceptable, offer must demonstrate that they have adequate equipment and resources to provide the requested product/services. Equipment must be in good working condition.

• Subfactor #1.3 Approach and Capability to complete work – In order to receive a rating of acceptable, offeror’s approach, project management, staffing experience, training, and scheduling must reflect the ability to successfully perform.

Factor #2 – Past Performance – In order to receive a rating of “acceptable” for this factor, offeror must have a recent past performance rating for of acceptable/satisfactory or higher for same or similar services. The offeror must provide at a minimum two references for past performance, including any proposed subcontractor. References should include contact name, phone number and email, and a description of the services provided. The past experience should indicate successes of the contractor in completing/meeting delivery dates and customer satisfaction as well as address any problems.

• Subfactor #2.1- Recency of present/past performance in relation to this effort – The Government considers “recent” present/past performance to be within the past 3 years.

• Subfactor #2.2- Relevancy of present/past performance in relation to this effort -The Government considers “relevant” present/past performance to be present/past performance effort involved in similar scope and magnitude of effort and complexities this solicitation requires.

The Government may also use past performance information obtained from other than the sources identified by the offeror. Information obtained from the Past Performance Information Retrieval System (PPIRS) database located at http//www.ppirs.gov is one of the sources that will be utilized.

PRICE: Award will be made to the lowest priced offeror that is evaluated as “acceptable” for all non-price factors.

(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

Inspection Surveillance Plan: The Forest Service will inspect completed acres for and provide recommendations to improve work quality while work is in progress. The Contractor is responsible for providing quality control to assure that work complies with the contract specifications.

CONTRACTOR QUALITY CONTROL

The Contractor shall provide quality control for all thinning operations. The Contractor is expected to conduct their own prompt inspections to ensure that all thinning and slash treatment requirements are being met. Government inspections are for payment determination only and are not intended to be used as a quality control by the Contractor. Any delay in Government inspections will not cause the Government to be responsible for the Contractors thinning quality.

Quality control includes the monitoring of quality while work is in progress and an unbiased sample of thinning and other work to determine actual quality percentage.

GOVERNMENT QUALITY ASSURANCE SURVEILLANCE PLAN

1. Inspection. The Government’s quality assurance inspections will determine compliance with specifications and provide the basis for computing the rate of payment. Inspections will consist of visual observations and sample plots to determine compliance with the specifications.

2. Determination of the acceptability of the work performed will be based on these inspections, which will be considered conclusive, except as otherwise provided in the contract. The Contractor or his representative may observe inspections while they are underway.

3. Acceptance will be determined based on compliance with the contract specifications.

Noncompliance will result in non-acceptance of the work. If the Contractor’s work is determined to be unacceptable, the Government may initiate any remedies described in FAR 52.212-4(a) Contract Terms and Conditions-Commercial Items, Inspection/Acceptance. The Contract Officer Representative (COR) and/or designated inspector(s) will make periodic inspections. The Contractor’s representative is encouraged to observe the inspection process.

4. Rework and Re-inspection after Rework. Inspections after rework will be made in the same manner as the first inspection but on different areas.

5. Inspection of Slash Treatment and Other Contract Requirements. Acceptance will be determined by inspection of areas requiring treatment and will be based on adherence to the specifications. Noncompliance with any of the specifications will classify the treatment as unsatisfactory and rework will be required to bring the treatment up to specification standards.
