Limited Source/Brand Name Justification United States Department of Agriculture
FAR 13.106-1(b)(1) – Simplified Acquisitions
1. Identification of the agency and the contracting office.
United States Department of Agriculture, Departmental Administration, Office of Procurement and Property Management, Procurement Operations Division, 321 S. Howes Street, Suite 300, Fort Collins, CO 80521.
2. Description of supply or service required to meet the agency’s needs.
This is a requirement for brand name renewal of 225 existing JRebel software under the authority of FAR 3.302-1(c). This requirement will result in a single FFP award.
3. The rationale or circumstances for limiting competition.
This requirement is for the subscription/support renewal of 225 JRebel licenses. This renewal is critical for the Government to continue to utilize the software as well as receive patches and updates to the software to ensure it is current and operating fully in support of Government Systems. This software is imperative for the Farm Service Agency (FSA) to provide support to their constituents. Only genuine renewal of JRebel software will fulfill the requirement for renewal as well as provide the functionality required of the software while allowing seamless usage and program development to continue. This software has been tested and is currently in use on Government Systems and implementation and use of a different product would create duplicate costs to the Government, that would not be recaptured through a competitive acquisition, including but not limited to the following: testing of replacement software, removing current software from existing Government systems, installing the new product on Government systems, ensuring new product works seamlessly with current Government infrastructure and processes, and retraining of Government employees on the use and management of the replacement product. Non-direct cost would also include FSA not being able to meet their organizational mission in supporting their customers. The software required also provides unique functionality in the JAVA programming environment including but not limited to: adding and removing fields, changing static field values, modifying interfaces and adding and removing methods. FSA utilizes the functionality and it is a continued requirement.
4. A description of the market research conducted and the results or a statement of the reason market research was not conducted.
Market research shows that there are multiple small business contractors that can fulfill the requirement including the publisher as well as multiple resellers. This market research was conducted via internet searches as well as research on previous requirements for JRebel software.
5. Estimated price, including all options, if applicable.
Estimated value is $110,000.00
6. Recommended source(s).
Interested/Recommended sources: ZeroTurnaround, New Tech, Seahorse Defense Supply, US Pan American Solutions LLC. A brand name solicitation with a small business set-aside will be issued via FBO for this requirement.
