SECTION C – DESCRIPTION/SPECIFICATIONS/STATEMENT OF WORK

MTA Office Roofing Replacement General Tasks and Requirements

C.1 DESCRIPTION OF WORK

The contractor shall complete services in accordance with the requirements specified and in this contract. The project consists of the following major items of work:

GENERAL

This structure currently has one layer of composition type roofing shingles. These shingles shall be removed and replaced with a standing seam, concealed fastener, 24 gauge steel roofing.

Roofing shall be installed in strict accordance with manufacturer’s instructions.

ROOFING

The Mount Adams Ranger District has other structures which have had metal roofs installed. The roofing product used on these structures was AEP Span Klip-Rib.

1. The roofing to be installed by this project will be expected to match the fire office and shop roofing so that it is not possible to find differences in style, installation, or aesthetic details between the existing metal roofs and roof to be applied to the office. Colors for each building are specified in color schedule below.

2. Mt. Adams RD Office building roof is approximately 5980 square feet. Option item roof sizes are as follows:

a. HVAC Building – approximately 304 square feet

b. Building #1013 – approximately 2423 square feet

c. Building #1018 – approximately 1626 square feet

3. Contractor will provide color samples. Colors to be approved by CO at least seven days prior to installation.

4. Ice and Water shield roof underlayment is required.

ROOFING PENETRATIONS

1. Vented ridge caps will be installed.

2. Main office restroom vents will be replaced with new, including end dams or, alternatively, venting ducts may be re-routed to eaves. Plans for re-routing to eaves must be approved prior to work commencing.

3. Additional new 1.5” plumbing vent to be installed on main office building, location to be verified with COR prior to construction.

4. New flashings shall be installed in accordance with manufacturer’s instruction. These shall include but not be limited to eaves, gable ends, and roofing penetrations. End dams shall be installed on all roofing penetrations.

ROOF DECK

1. Roof decking will be brought back into compliance with applicable codes and regulations prior to application of new roofing.

2. All repairs that are exposed to weather shall be primed and painted. Contractor shall provide paint to match existing colors.

FASCIA AND BARGE TRIM BOARDS

1. Damaged and/or rotten fascia boards shall be replaced.

2. Damaged and/or rotten barge trim boards shall be replaced

3. All fascia and barge trim boards shall be painted. Contractor shall provide matching paint.

The contractor shall provide any and all labor, equipment, vehicles, services, permits, and licenses, necessary to perform this contract.

This statement of work consists of completing tasks/subtasks required in this contract and meeting the performance requirements as identified following each task/subtask.

C.2 PROJECT LOCATION

This project is located at the Forest Service office at 2455 US Highway 141, in Trout Lake, WA, 98650 on the Mount Adams Ranger District of the Gifford Pinchot National Forest, Township 6 North, Range 10 East, Section 22, near the town of Trout Lake, Washington. It may be reached by traveling North on US Highway 141 from the town of White Salmon, WA.

(a) Existing Conditions:

The indications of existing conditions on the drawings and specifications are the result of on-site facilities inspections and the best information available at the time.

(b) Weather Conditions:

Weather conditions suitable for roofing replacement are normally expected in July through October. Rain, sometimes heavy, is normal.

(c) Pre-bid Conference: None scheduled.

C.3 PROSECUTION OF WORK

(a) General:

The contractor shall conduct activities so that interference with the public and residents is kept to a minimum and existing level of safety is maintained.

C.5 APPLICABLE SPECIFICATIONS AND MATERIAL CERTIFICATIONS

(a) Applicable Specifications:

References to Standard Specifications in the contract refer to the Construction Specifications Institute, Inc. standard specifications for construction and are physically included in Section J of the Contract under the title “LIST OF ATTACHMENTS.”

(b) Product Substitution:

a. Any modification of other items, designs, materials, products or equipment (including

Government-Furnished Property), made necessary because of a substitution, will be the responsibility of the Contractor without adjustment in contract price or time. The Contracting Officer’s approval of any substitute will not affect the Contractor’s responsibility for such modification. Any and all substitutions will be requested by the Contractor after award of the contract has been made. No approvals will be made prior to award.

Work requiring submittals shall not begin until submittals have been approved.

Submittals shall include:

Date and Revision Dates.

Project Name and Contract Number.

Names of Contractor, Subcontractor, Supplier, and Manufacturers.

Contractor's stamp, initialed or signed, certifying review of submittal, verification of field measurement and compliance with contract documents.

Samples:

Physical examples shall illustrate materials, equipment, or workmanship, and establish standards by which completed work shall be judged. Samples shall be of sufficient size and quantity to illustrate the functional characteristics of product or material, with integrally related parts and devices.

Manufacturer's requirements:

Supply manufacturer's catalog sheets or brochures with diagrams, schedules, or performance charts. Illustrations shall be clearly marked to identify pertinent materials or models, dimensions, and clearances required. Supplement standard drawings to provide information unique to this project.

Approval or Rejection Time Allowance:

Submittals will be reviewed and either approved or rejected within _7_ calendar days of receipt by the Contracting Officer or COR.

F.2 FAR 52.211-10 Commencement, Prosecution, and Completion of Work (APR 1984)

The Contractor shall be required to (a) commence work under this contract within 10 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than 30 days after the date the Contractor receives the Notice to Proceed. The time stated for completion shall include final cleanup of the premises.

Estimated start work date: Aug. 20th, 2018

F.3 MAXIMUM WORKWEEK – CONSTRUCTION SCHEDULE (AGAR 452.236-

75)(NOV 1996)

Within 7 calendar days after receipt of a written request from the Contracting Officer, the Contractor must submit the following information in writing for approval:

(a) A schedule as required by FAR clause 52.236-15, Schedules for Construction Contracts, and

(b) The hours (including the daily starting and stopping times) and days of the week the Contractor proposed to carry out the work.

The approved regular workweek is Monday through Friday, 8:00 a.m. to 5:00 p.m. Work hours outside of the regular workweek hours shall be approved by the COR at least 24 hours prior to extending work hours. Requests for weekend work will be entertained in the interest of public safety and minimizing employee disruptions.

SECTION G – CONTRACT ADMINISTRATION DATA

G.1 GOVERNMENT-FURNISHED PROPERTY

The Government will provide the following item(s) of Government property to the Contractor for use in the performance of this contract. This property shall be used and maintained by the Contractor in accordance with the provisions of the "Government Property" FAR clause contained elsewhere in the contract:

G.2 DESIGNATION OF CONTRACTING OFFICER'S REPRESENTATIVE

The Contracting Officer will designate a Contracting Officer's Representative (COR) at the time of contract award.

The COR is responsible for administering the performance of work under this contract. In no event, however, will any understanding, agreement, modification, change order, or other matter deviating from the terms of this contract be effective or binding upon the Government unless formalized by proper contractual documents executed by the Contracting Officer prior to completion of the contract.

The Contracting Officer should be informed as soon as possible of any actions or inactions by the Contractor or the Government which will change the required delivery or completion times stated in the contract, and the contract will be modified accordingly. (This does not apply to individual task assignments which were issued by the COR provided they do not affect the delivery schedule or performance period stated in the contract).

On all matters that pertain to the contract terms the Contractor must communicate with the Contracting Officer. Whenever, in the opinion of the Contractor, the COR requests effort outside the scope of the contract, the Contractor should so advise the COR. If the COR persists and there still exists a disagreement as to proper contractual coverage, the Contracting Officer should be notified immediately, preferably in writing if time permits.

Proceeding with work without proper contractual coverage could result in nonpayment or necessitate submittal of a contract claim.

SECTION H – SPECIAL CONTRACT REQUIREMENTS

H.1 EMERGENCY CONTROL (USDA 452.236-77) (JUL 1985)

a. Maintenance of Existing Facilities:

1. The Contractor shall conduct operations to minimize disruptions to office visitors and employees.

2. The Contractor shall request permission in writing to the COR for any planned disruption of utilities. Such requests shall be submitted at least seven days prior to the planned disruption.

3. Utility disruptions shall be limited to a maximum of 12 hours duration at a time. Do not proceed with utility interruptions without Government’s written permission.

H.2 LANDSCAPE PRESERVATION

(a) The Contractor shall confine operations to the immediate vicinity of buildings. Measures shall be taken to protect flowerbeds, shrubbery, attachments, and etc. from damage and/or disturbance by contractor’s operations.

(b) All nails, flashing, metal debris, and other materials or garbage generated as a result of contractor’s operations shall be picked up and removed from the work areas and disposed of properly.

(c) Prevention of Oil Spills - Spilled product and other chemicals shall be immediately cleaned up

PLAN FOR WEATHER-CAUSED SUSPENSIONS OF WORK

The Contractor shall prepare a plan for weather-caused suspensions of work to ensure protection of structures affected by long or short term precipitation events. The plans shall be consistent with the requirements in the LANDSCAPE PRESERVATION clause contained in this contract.

The plan shall be submitted in writing to the Contracting Officer for review and, if acceptable, approval no later than 14 days after contract award. If rejected by the Contracting Officer, the Contractor shall revise the plan and re-submit it for consideration within three working days of verbal or written notification by the Contracting Officer. The Contractor shall take action consistent with the plan before suspending activity on the site(s). Acceptance of the plan by the Contracting Officer in no way waives any of the requirements of the LANDSCAPE PRESERVATION clause.

H.3 USE OF PREMISES

(a) A storage site will be permitted within the project area. The Forest Service assumes no liability for materials stored within the storage site. The Contractor will be allowed to erect a temporary fence to secure materials and equipment, however, the fence shall be removed and the site restored prior to final acceptance of the contract.

(b) Potable water is available for use during construction.

(c) Electric power is available on site for construction use.

(d) Sanitary facilities are available for use during construction.

H. 4 SPECIAL PROJECT REQUIREMENTS

• None

H.5 PROSECUTION OF WORK

(e) The Contractor shall conduct activities so that interference with office visitors, employees and their daily activities shall be kept at a minimum. The work site shall be kept free of contractor’s work related hazards as much as possible at all times. Any activities requiring closure of an entrance shall be scheduled with the COR at least 7 days in advance and shall not be in effect more than eight (8) consecutive hours.

(f) The Contractor shall use measures and precautions necessary to warn and protect office visitors and Government personnel during work at the project site. Such actions include, but are not limited to, furnishing and maintaining barricades and signs around the work site and roping off the area.

H.6 FINAL CLEANUP

Contractor shall remove and dispose all of its own trash and refuse from the contract area.

This Cleanup is a subsidiary item for which no special payment will be made. All debris shall be disposed off National Forest Land and in accordance with State and Local disposal requirements.

H.7 POTENTIAL SAFETY HAZARDS

(g) Data and information furnished or referred to below is for the Contractor's information.

The Government shall not be responsible for any interpretation of or conclusion drawn from the data or information by the Contractor. This list shall not be deemed to be all-inclusive. The Contractor shall bear the sole responsibility for taking all appropriate actions necessary to prevent accidents and injuries to individuals at the worksite.

(h) The following checked activities have been identified by the Government as potential safety hazards.

[ ] Confined space entry.

[ ] Temporary excavation/deep trenching/slope stability.

[ ] Tree falling.

[x] Fall hazard from work heights exceeding six feet.

[ ] Blasting.

[ ] Traffic control on high-volume and/or high-speed and/or limited visibility roads.

[ ] Heavy equipment operation.

[ ] Tree climbing and/or tower climbing.

[ ] Fire hazards.

[ ] Hazardous materials handling.

[ ] Electrical hazard.

[ ] Hydraulic and/or pneumatic and/or other high pressure hazards.

I.2 FAR 52.215-8 Order of Precedence – UNIFORM CONTRACT FORMAT

I.3 FAR 52.225-9 Buy American -Construction Materials

(MAY 2014)

(a) Definitions. As used in this clause— “Commercially available off-the-shelf (COTS) item”—

(1) Means any item of supply (including construction material) that is—

(i) A commercial item (as defined in paragraph (1) of the definition at FAR 2.101);

(ii) Sold in substantial quantities in the commercial marketplace; and

(iii) Offered to the Government, under a contract or subcontract at any tier, without modification, in the same form in which it is sold in the commercial marketplace; and

(2) Does not include bulk cargo, as defined in 46 U.S.C. 40102(4), such as agricultural products and petroleum products.

“Component” means an article, material, or supply incorporated directly into a construction material.

“Construction material” means an article, material, or supply brought to the construction site by the Contractor or a subcontractor for incorporation into the building or work. The term also includes an item brought to the site preassembled from articles, materials, or supplies. However, emergency life safety systems, such as emergency lighting, fire alarm, and audio evacuation systems, that are discrete systems incorporated into a public building or work and that are produced as complete systems, are evaluated as a single and distinct construction material regardless of when or how the individual parts or components of those systems are delivered to the construction site. Materials purchased directly by the Government are supplies, not construction material.

“Cost of components” means—

(3) For components purchased by the Contractor, the acquisition cost, including transportation costs to the place of incorporation into the construction material (whether or not such costs are paid to a domestic firm), and any applicable duty (whether or not a duty-free entry certificate is issued); or

(4) For components manufactured by the Contractor, all costs associated with the manufacture of the component, including transportation costs as described in paragraph (1) of this definition, plus allocable overhead costs, but excluding profit. Cost of components does not include any costs associated with the manufacture of the construction material.

“Domestic construction material” means—

(1) An unmanufactured construction material mined or produced in the United States;

(2) A construction material manufactured in the United States, if—

(i) The cost of its components mined, produced, or manufactured in the United States exceeds 50 percent of the cost of all its components. Components of foreign origin of the same class or kind for which nonavailability determinations have been made are treated as domestic; or

(ii) The construction material is a COTS item.

“Foreign construction material” means a construction material other than a domestic construction material.

“United States” means the 50 States, the District of Columbia, and outlying areas.

(b) Domestic preference.

(1) This clause implements 41 U.S.C. chapter 83, Buy American, by providing a preference for domestic construction material. In accordance with 41 U.S.C. 1907, the component test of the Buy American statute is waived for construction material that is a COTS item. (See FAR 12.505(a)(2)). The Contractor shall use only domestic construction material in performing this contract, except as provided in paragraphs (b)(2) and (b)(3) of this clause.

(2) This requirement does not apply to information technology that is a commercial item or to the construction materials or components listed by the Government as follows:

(3) The Contracting Officer may add other foreign construction material to the list in paragraph (b)(2) of this clause if the Government determines that—

(i) The cost of domestic construction material would be unreasonable. The cost of a particular domestic construction material subject to the requirements of the Buy American statute is unreasonable when the cost of such material exceeds the cost of foreign material by more than 6 percent;

(ii) The application of the restriction of the Buy American statute to a particular construction material would be impracticable or inconsistent with the public interest; or

(iii) The construction material is not mined, produced, or manufactured in the United States in sufficient and reasonably available commercial quantities of a satisfactory quality.

(c) Request for determination of inapplicability of the Buy American statute.

(1)(i) Any Contractor request to use foreign construction material in accordance with paragraph (b)(3) of this clause shall include adequate information for Government evaluation of the request, including—

(A) A description of the foreign and domestic construction materials;

(B) Unit of measure;

(C) Quantity;

(D) Price;

(E) Time of delivery or availability;

(F) Location of the construction project;

(G) Name and address of the proposed supplier; and

(H) A detailed justification of the reason for use of foreign construction materials cited in accordance with paragraph (b)(3) of this clause.

(ii) A request based on unreasonable cost shall include a reasonable survey of the market and a completed price comparison table in the format in paragraph (d) of this clause.

(iii) The price of construction material shall include all delivery costs to the construction site and any applicable duty (whether or not a duty-free certificate may be issued).

(iv) Any Contractor request for a determination submitted after contract award shall explain why the Contractor could not reasonably foresee the need for such determination and could not have http://uscode.house.gov/ http://uscode.house.gov/ https://acquisition.gov/far/current/html/Subpart%2012_5.html#wp1077123 requested the determination before contract award. If the Contractor does not submit a satisfactory explanation, the Contracting Officer need not make a determination.

(2) If the Government determines after contract award that an exception to the Buy American statute applies and the Contracting Officer and the Contractor negotiate adequate consideration, the Contracting Officer will modify the contract to allow use of the foreign construction material.

However, when the basis for the exception is the unreasonable price of a domestic construction material, adequate consideration is not less than the differential established in paragraph (b)(3)(i) of this clause.

(3) Unless the Government determines that an exception to the Buy American statute applies, use of foreign construction material is noncompliant with the Buy American statute.

(d) Data. To permit evaluation of requests under paragraph (c) of this clause based on unreasonable cost, the Contractor shall include the following information and any applicable supporting data based on the survey of suppliers:

(a) This award is subject to the provisions contained in sections 433 and 434 of the Consolidated Appropriations Act, 2012 (P.L. No. 112-74), Division E, as amended and/or subsequently enacted regarding corporate felony convictions and corporate federal tax delinquencies.

Accordingly, by accepting this award the contractor acknowledges that it –

(1) does not have a tax delinquency, meaning that it is not subject to any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, and

(2) has not been convicted (or had an officer or agent acting on its behalf convicted) of a felony criminal violation under any Federal law within 24 months preceding the award, unless a suspending and debarring official of the United States Department of Agriculture has considered suspension or debarment of the awardee, or such officer or agent, based on these convictions and/or tax delinquencies and determined that suspension or debarment is not necessary to protect the interests of the Government.

(b) If the awardee fails to comply with these provisions, the Forest Service may terminate this contract for default and may recover any funds the awardee has received in violation of sections 433 or 434.

(2) An identifier assigned by a member of the North Atlantic Treaty Organization (NATO) or by the NATO Support Agency (NSPA) to entities located outside the United States and its outlying areas that the DLA Contractor and Government Entity (CAGE) Branch records and maintains in the CAGE master file. This type of code is known as an NCAGE code.

(b) The Offeror shall enter its CAGE code in its offer with its name and address or otherwise include it prominently in its proposal. The CAGE code entered must be for that name and address. Enter “CAGE” before the number. The CAGE code is required prior to award.

(c) CAGE codes may be obtained via–

(1) Registration in the System for Award Management (SAM) at www.sam.gov. If the

Offeror is located in the United States or its outlying areas and does not already have a CAGE code assigned, the DLA Contractor and Government Entity (CAGE) Branch will assign a CAGE code as a part of the SAM registration process. SAM registrants located outside the United States and its outlying areas shall obtain a NCAGE code prior to registration in SAM (see paragraph (c)(3) of this provision).

(2) The DLA Contractor and Government Entity (CAGE) Branch. If registration in SAM is not required for the subject procurement, and the offeror does not otherwise register in SAM, an offeror located in the United States or its outlying areas may request that a CAGE code be assigned by submitting a request at http://www.dlis.dla.mil/cage_welcome.asp.

(3) The appropriate country codification bureau. Entities located outside the United States and its outlying areas may obtain an NCAGE code by contacting the Codification Bureau in the foreign entity’s country if that country is a member of NATO or a sponsored nation.
