SECTION C—DESCRIPTION /SPECIFICATIONS/STATEMENT OF WORK

C-1 DESCRIPTION OF WORK

This contract involves the replacement of existing asphalt shingle roof systems.

The work must be completed no later than September 28, 2018.

The bidding contractor must bid all Base Item and Optional Items to be considered for award.

All construction materials, construction practices, and installation must meet current Clark County (WA) Code for roofing of residential structures, and also meet manufacturer recommendations. No permits will need to be pulled with the County, State, or Federal Governments to accomplish this work.

C-2 PROJECT LOCATION

The project site location is at the Mt. St. Helens National Volcanic Monument Headquarters located in Amboy, WA. The address is listed below:

C-3 APPLICABLE SPECIFICATIONS

All material for this contract must comply with local County Building Codes, regarding residential structure construction.

All material must not be weather damaged upon delivery by the contractor. All materials, once on site, must be protected from weather damage.

All boards and sheets must have minimal warping along the entire plane of the board or sheet;

examples of warp can include, but are not limited to the following: bow, crook, cup, twist, or any combination of these. Any warping in the boards or sheets shall be classified as “Very Light.”

The contractor must supply all materials and labor necessary for installation as per current Clark County (WA) Code and per manufacturer recommendations. Materials necessary for the work are expected to consist of, but not be limited to, the following:

- 30-year warranty, architectural, asphalt shingle. Dark gray in color.

- Metal flashing. Dark gray to black in color. Metal flashing shall consist of, but is not limited to the following: drip edge, rake edge, valley, head, apron, and step. Install flashing where needed per current Clark County (WA) Code and manufacturer recommendations.

- Water and ice protector layer. Protector layer installation locations expected at, but not limited to, the following locations: eave and valley. Install protector layer where needed per current Clark County (WA) Code and manufacturer recommendations.

- Underlayment/felt. Underlayment/felt installation locations expected at, but not limited to, the following locations: between shingles and deck sheathing. Install underlayment/felt where needed per current Clark County (WA) Code and manufacturer recommendations.

- Nails and rubber grommets. Install nails and rubber grommets where needed per current Clark County (WA) Code and manufacturer recommendations.

- Passive vents. Dark gray to black in color. Replace current passive vents with new vents that are equal to or greater in quality. Ensure that the appropriate amount of venting is installed, as per current Clark County (WA) Code and manufacturer recommendations.

- Vent pipe and exhaust fan flashing. Dark gray to black in color. Replace current vent pipe and exhaust fan flashing with new vent pipe and exhaust fan flashing that are equal to or greater in quality. Ensure that installation follows current Clark County (WA) Code and manufacturer recommendations.

- Roofing anchors. Install roofing anchors where needed per current Clark County (WA) Code and manufacturer recommendations.

- 5 sheets of deck sheathing, installed as necessary. Match existing deck sheathing.

Note, at this time, it is assumed that at least 5 sheets of deck sheathing will need to be replaced, per roof, during this project. If less than 5 sheets of deck sheathing need to be replaced, the Contractor shall provide the Forest Service with the remaining, uninstalled sheets of deck sheathing. There will be no compensation to the Forest Service, or price reduction to the contract, if less than 5 sheets of deck sheathing are installed. Ensure that installation follows current Clark County (WA) Code and manufacturer recommendations.

The Forest Service has measured the square footage of the roof systems that need to be replaced.

These measurements are listed below, per house number (#XXXX). It is highly recommended that the contractor visit the project site prior to submitting a bid, to ensure that the contractor is familiar with the work that is being bid upon.

The attachments to the Statement of Work/Specifications listed in Section J are hereby made part of this solicitation and any resultant contract.

C-5 PROSECUTION OF WORK

(a) General:

The contractor shall conduct activities so that interference with the public and employees is kept to a minimum and existing level of safety is maintained.

C-6 SCHEDULING OF WORK

Contractor shall provide a schedule of work 48 hours prior to starting work. The schedule shall include the proposed daily starting and stopping times and days of the week the contractor proposes to work. The maximum work week that will be approved is Monday through Friday, 08:00 a.m. to 5:00 p.m.

C.7 APPLICABLE SPECIFICATIONS AND MATERIAL CERTIFICATIONS

(a) Applicable Specifications:

References to Standard Specifications in the contract refer to the Construction Specifications Institute, Inc. standard specifications for construction and are physically included in Section J of the Contract under the title “LIST OF ATTACHMENTS.”

(b) Product Substitution:

Any modification of other items, designs, materials, products or equipment (including Government-Furnished Property), made necessary because of a substitution, will be the responsibility of the Contractor without adjustment in contract price or time. The Contracting Officer’s approval of any substitute will not affect the Contractor’s responsibility for such modification. Any and all substitutions will be requested by the Contractor after award of the contract has been made. No approvals will be made prior to award.

Work requiring submittals shall not begin until submittals have been approved.

Field Dimensions and Relation to Adjacent Structures.

Contractor's stamp, initialed or signed, certifying review of submittal, verification of field measurement and compliance with contract documents.

Samples:

Physical examples shall illustrate materials, equipment, or workmanship, and establish standards by which completed work shall be judged. Samples shall be of sufficient size and quantity to illustrate the functional characteristics of product or material, with integrally related parts and devices.

Manufacturer's requirements:

Supply manufacturer's catalog sheets or brochures with diagrams, schedules, or performance charts. Illustrations shall be clearly marked to identify pertinent materials or models, dimensions, and clearances required. Supplement standard drawings to provide information unique to this project.

Approval or Rejection Time Allowance:

Submittals will be reviewed and either approved or rejected within 7 calendar days of receipt by the Contracting Officer or COR unless otherwise specified.

52.242-14 Suspension of Work (APR 1984)

F-2 FAR 52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF

WORK (APR 1984)

The Contractor shall be required to (a) commence work under this contract within 7 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than 30 days after the contractor receipt of Notice to Proceed. The time stated for completion shall include final cleanup of the premises.

F-3 PERIOD OF PERFORMANCE

The estimated start work date is the first week of July 20th, 2018.

SECTION G--CONTRACT ADMINISTRATION DATA

G.1 DESIGNATION OF CONTRACTING OFFICER’S REPRESENTATIVE

The Contracting Officer will designate a Contracting Officer's Representative (COR) at the time of contract award.

The COR is responsible for administering the performance of work under this contract. In no event, however, will any understanding, agreement, modification, change order, or other matter deviating from the terms of this contract be effective or binding upon the Government unless formalized by proper contractual documents executed by the Contracting Officer prior to completion of the contract.

The Contracting Officer should be informed as soon as possible of any actions or inactions by the Contractor or the Government which will change the required delivery or completion times stated in the contract, and the contract will be modified accordingly. (This does not apply to individual task assignments which were issued by the COR provided they do not affect the delivery schedule or performance period stated in the contract).

On all matters that pertain to the contract terms the Contractor must communicate with the Contracting Officer. Whenever, in the opinion of the Contractor, the COR requests effort outside the scope of the contract, the Contractor should so advise the COR. If the COR persists and there still exists a disagreement as to proper contractual coverage, the Contracting Officer should be notified immediately, preferably in writing if time permits. Proceeding with work without proper contractual coverage could result in nonpayment or necessitate submittal of a contract claim.

G.2 AGAR 452.215-73 POST AWARD CONFERENCE (NOV 1996)

A post award conference with the successful offeror is required. It will be scheduled and held within five days after the date of contract award. The conference will be held at 10024 US Highway 12, Randle. Washington 98377.

SECTION H--SPECIAL CONTRACT REQUIREMENTS

H-1 FAR 52.236-4 PHYSICAL DATA (APR 1984)

Data and information furnished or referred to below is for the Contractor's information. The Government shall not be responsible for any interpretation of or conclusion drawn from the data or information by the Contractor. (a) The indications of physical conditions on the drawings and in the specifications are the result of site investigations by on site facility inspections and the best information available at the time.

(b) Weather conditions: Weather conditions suitable for roofing replacement are normally expected in July through October. Rain, sometimes heavy, is normal..

(c) Transportation facilities: N/A

H.2 EMERGENCY CONTROL (USDA 452.236-77) (JUL 1985)

a. Maintenance of Existing Facilities:

1. The Contractor shall conduct operations to minimize disruptions to campground users.

2. The Contractor shall request permission in writing to the COR for any planned closure of structures. Such requests shall be submitted at least seven days prior to the planned closure.

3. Measures shall be taken to protect well head and associated appurtenances during all phases of work.

H.3 LANDSCAPE PRESERVATION

The Contractor shall give attention to the effect of contract operation upon the landscape, shall take care to maintain natural surroundings undamaged, and shall conduct the work at all times in compliance with the following requirements.

a. Prevention of the Landscape Defacement. The Contractor shall not remove, deface, injure, or destroy trees, shrubs, lawns, or other natural features or any other improvements in the work area unless specifically authorized by the Contracting Officer. Unless otherwise provided herein, the Contractor shall confine contract operations to within the areas designated in contract documents and the immediate vicinity of the structures. Measures shall be taken to protect shrubbery, attachments, and etc. from damage and/or disturbance by contractor’s operations.

b. Protection of Streams, Lakes, and Reservoirs. The Contractor shall take sufficient precautions to prevent pollution of streams, lakes, small ponds, and reservoirs with fuels, oils, bitumens, calcium chloride, silt, or other harmful materials. Mechanical equipment shall not be operated in live streams without written approval of the Contracting Officer.

c. All nails, flashing, metal debris, and other materials or garbage generated as a result of contractor’s operations shall be picked up and removed from the work areas and disposed of properly.

d. Prevention of Oil Spills - Spilled product and other chemicals shall be immediately cleaned up

H.4 PLAN FOR WEATHER-CAUSED SUSPENSIONS OF WORK

The Contractor shall prepare a plan for weather-caused suspensions of work to ensure protection of structures affected by long or short term precipitation events. The plans shall be consistent with the requirements in the LANDSCAPE PRESERVATION (H.3) contained in this contract.

The plan shall be submitted in writing to the Contracting Officer for review and, if acceptable, approval no later than 14 days after contract award. If rejected by the Contracting Officer, the Contractor shall revise the plan and re-submit it for consideration within three working days of verbal or written notification by the Contracting Officer. The Contractor shall take action consistent with the plan before suspending activity on the site(s). Acceptance of the plan by the Contracting Officer in no way waives any of the requirements of the LANDSCAPE

PRESERVATION (H.3).

H.5 USE OF PREMISES

(a) A storage site will be permitted within the project area. The Forest Service assumes no liability for materials stored within the storage site. The Contractor will be allowed to erect a temporary fence to secure materials and equipment, however, the fence shall be removed and the site restored prior to final acceptance of the contract.

(b) Potable water is not available for use during construction.

(c) Sanitary facilities are available for use during construction. (Outhouse in campground)

H. 6 SPECIAL PROJECT REQUIREMENTS

• None

H.7 PROSECUTION OF WORK

(a) The Contractor shall conduct activities so that interference with the campground users and their activities shall be kept at a minimum. The areas around structures shall be kept free of contractor’s work related hazards as much as possible at all times.

(b) The Contractor shall use measures and precautions necessary to warn and protect campground users during work at the project site. Such actions include, but are not limited to, furnishing and maintaining barricades or fences and signs around the work site and roping off areas.

H.8 FINAL CLEANUP

Contractor shall remove and dispose all of its own trash and refuse from the contract area. This cleanup is a subsidiary item for which no special payment will be made. All debris shall be disposed off National Forest Land and in accordance with State and Local disposal requirements.

H.9 POTENTIAL SAFETY HAZARDS

(a) Data and information furnished or referred to below is for the Contractor's information. The Government shall not be responsible for any interpretation of or conclusion drawn from the data or information by the Contractor. This list shall not be deemed to be all-inclusive. The Contractor shall bear the sole responsibility for taking all appropriate actions necessary to prevent accidents and injuries to individuals at the worksite.

(b) The following checked activities have been identified by the Government as potential safety hazards.

[ ] Confined space entry.

[ ] Temporary excavation/deep trenching/slope stability.

[ ] Tree falling.

[X] Fall hazard from work heights exceeding six feet.

[ ] Blasting.

[ ] Traffic control on high-volume and/or high-speed and/or limited visibility roads.

[ ] Heavy equipment operation.

[ ] Tree climbing and/or tower climbing.

[ ] Fire hazards.

[ ] Hazardous materials handling.

[X] Electrical hazard.

[ ] Hydraulic and/or pneumatic and/or other high pressure hazards.

H.10 DEFINITIONS AND ABBREVIATIONS

Wherever in these provisions, or in other contract documents, the following terms, or pronouns in place of them are used, the intent and meaning shall be interpreted as follows:

Building Limits - A line 5 feet outside foundations of the structure.

Calendar Day - Every day shown on the calendar, Sundays and holidays included.

Change Order - A written order issued by the Contracting Officer, to the Contractor documenting modifications within the scope of the contract.

Contract Amendment - A bilateral written supplemental agreement between the Government and the Contractor.

Contract Time - The number of calendar days allowed by the contract for the completion of the work.

Contracting Officer's Representative (COR) - The duly authorized representative of the Contracting Officer, responsible for on-site administration of the contract within the limits of specific written delegation of authority.

Contractor - The individual, partnership, joint venture, or corporation undertaking the execution of the work under the terms of the contract and acting directly or through their agent, employees, or subcontractors.

Equipment - All machinery and equipment, together with the necessary supplies for upkeep and maintenance, including tools and apparatus necessary for the proper construction and acceptable completion of the work.

Forest Supervisor - The person, or designated representative, responsible for administration of a National Forest.

Inspector - The Government authorized representative designated in writing by the COR responsible for detailed inspections of contract performance, within delegation of authority.

Materials - Any substances specified for use in the construction of the project and its appurtenances.

Notice of Non-Compliance - Written notice issued detailing specific area(s) of Non- Compliance with contract requirements.

Original Contract Quantities - Those quantities shown in the Schedule of Items.

Right-of-way - A general term denoting land, property, or interest therein acquired for or devoted to a road or a construction site.

Schedule of Items - Schedule in the contract which contains a listing and description of construction items, quantities, units of measure, method of measurement, unit price and amount.

Specifications - A general term applied to all written directions and requirements pertaining to performance of the work.

Utility Services - Services such as electricity, gas, steam, water and sewerage.

Work Order - A written instruction directing the Contractor to fulfill contract requirements.

Reference to a specific standard or specification shall mean the latest edition or amendment in effect on date of invitation to bid.

I.2 FAR 52.215-8 ORDER OF PRECEDENCE – UNIFORM CONTRACT FORMAT

Any inconsistency in this solicitation or contract shall be resolved by giving precedence in the following order:

(a) The Schedule (excluding the specifications)

(b) Representations and other instructions

(c) Contract clauses

(d) Other Documents, exhibits, and attachments

I.3 FAR 52.225-9 BUY AMERICAN -CONSTRUCTION MATERIALS

(MAY 2014)

(a) Definitions. As used in this clause— “Commercially available off-the-shelf (COTS) item”—

(1) Means any item of supply (including construction material) that is—

(i) A commercial item (as defined in paragraph (1) of the definition at FAR 2.101);

(ii) Sold in substantial quantities in the commercial marketplace; and

(iii) Offered to the Government, under a contract or subcontract at any tier, without modification, in the same form in which it is sold in the commercial marketplace; and

(2) Does not include bulk cargo, as defined in 46 U.S.C. 40102(4), such as agricultural products and petroleum products.

“Component” means an article, material, or supply incorporated directly into a construction material.

“Construction material” means an article, material, or supply brought to the construction site by the Contractor or a subcontractor for incorporation into the building or work. The term also includes an item brought to the site preassembled from articles, materials, or supplies. However, emergency life safety systems, such as emergency lighting, fire alarm, and audio evacuation systems, that are discrete systems incorporated into a public building or work and that are produced as complete systems, are evaluated as a single and distinct construction material regardless of when or how the individual parts or components of those systems are delivered to the construction site. Materials purchased directly by the Government are supplies, not construction material.

“Cost of components” means—

(3) For components purchased by the Contractor, the acquisition cost, including transportation costs to the place of incorporation into the construction material (whether or not such costs are paid to a domestic firm), and any applicable duty (whether or not a duty-free entry certificate is issued); or https://acquisition.gov/far/current/html/Subpart%202_1.html#wp1145508 http://uscode.house.gov/

(4) For components manufactured by the Contractor, all costs associated with the manufacture of the component, including transportation costs as described in paragraph (1) of this definition, plus allocable overhead costs, but excluding profit. Cost of components does not include any costs associated with the manufacture of the construction material.

“Domestic construction material” means—

(1) An unmanufactured construction material mined or produced in the United States;

(2) A construction material manufactured in the United States, if—

(i) The cost of its components mined, produced, or manufactured in the United States exceeds 50 percent of the cost of all its components. Components of foreign origin of the same class or kind for which nonavailability determinations have been made are treated as domestic;

or

(ii) The construction material is a COTS item.

“Foreign construction material” means a construction material other than a domestic construction material.

“United States” means the 50 States, the District of Columbia, and outlying areas.

(b) Domestic preference.

(1) This clause implements 41 U.S.C. chapter 83, Buy American, by providing a preference for domestic construction material. In accordance with 41 U.S.C. 1907, the component test of the Buy American statute is waived for construction material that is a COTS item. (See FAR 12.505(a)(2)). The Contractor shall use only domestic construction material in performing this contract, except as provided in paragraphs (b)(2) and (b)(3) of this clause.

(2) This requirement does not apply to information technology that is a commercial item or to the construction materials or components listed by the Government as follows:

(3) The Contracting Officer may add other foreign construction material to the list in paragraph (b)(2) of this clause if the Government determines that—

(i) The cost of domestic construction material would be unreasonable. The cost of a particular domestic construction material subject to the requirements of the Buy American statute is unreasonable when the cost of such material exceeds the cost of foreign material by more than 6 percent;

(ii) The application of the restriction of the Buy American statute to a particular construction material would be impracticable or inconsistent with the public interest; or

(iii) The construction material is not mined, produced, or manufactured in the United States in sufficient and reasonably available commercial quantities of a satisfactory quality.

(c) Request for determination of inapplicability of the Buy American statute.

(1)(i) Any Contractor request to use foreign construction material in accordance with paragraph (b)(3) of this clause shall include adequate information for Government evaluation of the request, including—

(A) A description of the foreign and domestic construction materials;

(B) Unit of measure;

(C) Quantity;

(D) Price;

(E) Time of delivery or availability;

(F) Location of the construction project;

(G) Name and address of the proposed supplier; and

(H) A detailed justification of the reason for use of foreign construction materials cited in accordance with paragraph (b)(3) of this clause.

(ii) A request based on unreasonable cost shall include a reasonable survey of the market and a completed price comparison table in the format in paragraph (d) of this clause.

(iii) The price of construction material shall include all delivery costs to the construction site and any applicable duty (whether or not a duty-free certificate may be issued).

(iv) Any Contractor request for a determination submitted after contract award shall explain why the Contractor could not reasonably foresee the need for such determination and could not have requested the determination before contract award. If the Contractor does not submit a satisfactory explanation, the Contracting Officer need not make a determination.

(2) If the Government determines after contract award that an exception to the Buy American statute applies and the Contracting Officer and the Contractor negotiate adequate consideration, the Contracting Officer will modify the contract to allow use of the foreign construction material. However, when the basis for the exception is the unreasonable price of a domestic construction material, adequate consideration is not less than the differential established in paragraph (b)(3)(i) of this clause.

(3) Unless the Government determines that an exception to the Buy American statute applies, use of foreign construction material is noncompliant with the Buy American statute.

(d) Data. To permit evaluation of requests under paragraph (c) of this clause based on unreasonable cost, the Contractor shall include the following information and any applicable supporting data based on the survey of suppliers:

(a) This award is subject to the provisions contained in sections 433 and 434 of the Consolidated Appropriations Act, 2012 (P.L. No. 112-74), Division E, as amended and/or subsequently enacted regarding corporate felony convictions and corporate federal tax delinquencies.

Accordingly, by accepting this award the contractor acknowledges that it –

(1) does not have a tax delinquency, meaning that it is not subject to any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, and

(2) has not been convicted (or had an officer or agent acting on its behalf convicted) of a felony criminal violation under any Federal law within 24 months preceding the award, unless a suspending and debarring official of the United States Department of Agriculture has considered suspension or debarment of the awardee, or such officer or agent, based on these convictions and/or tax delinquencies and determined that suspension or debarment is not necessary to protect the interests of the Government.

(b) If the awardee fails to comply with these provisions, the Forest Service may terminate this contract for default and may recover any funds the awardee has received in violation of sections 433 or 434.
