In accordance with Federal Acquisition Regulation FAR 13.501 & FAR 6.303-2 this is a justification for other than full and open competition for the subject line contract.
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
This notice is published for informational purposes only and not as a request for competitive quotations. The USDA Forest Service (FS), Springfield, OR awarded a single-source contract to the Military Oregon Department. The contract was awarded on August 17, 2018. A busy fire season in the fall of 2018 did not permit ample time to post this justification within 14 days of award per FAR 13.501 (a) (1) (iii).
The following format is required in accordance with FAR 13.501 & FAR 6.303-2:

Agency: Forest Service
(2) Nature and/or description of the action being approved.
USDA-Forest Service Willamette National Forest and State of Oregon - Military Oregon Department are co-located in the Lane County Armed Forces Reserve Center at 3106 Pierce Parkway, Springfield, OR. This contract action specifically provides a method of payment to the Military Oregon Department for the FS share of the facility Operating and Maintenance (O & M) cost. As the owner of the site and largest shareholder in the building, Military Oregon Department will receive all bills. It is not possible to have bills sent separately to the individual tenants.
(3) A description of the supplies or services required to meet the agency’s needs (including the estimated value).
The costs include utility bills, facility maintenance, supplies, grounds maintenance and custodial work with an estimated value of $15,000 per month.
(4) An identification of the statutory authority permitting other than full and open competition.
FAR 13.106-1 Soliciting competition (2)(b) Soliciting from a single source &
FAR 6.302-1 – Only one responsible source and no other supplies or services will satisfy agency requirements.
(5) A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited.
This is the most efficient and reasonable method to reimburse the Military Oregon Department for paying the Forest Service’s share of the Operating and Maintenance (O & M) cost.
(6) A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by subpart 5.2 and, if not, which exception under 5.202 applies.
A notice was not made to publicize the proposed contract action based on the exception under 5.202 (10) The proposed contract action is made under conditions described in 6.302-3.
(7) A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.
The costs are based on fixed rates for utilities for the Springfield area.
(8) A description of the market research conducted (see part 10) and the results or a statement of the reason market research was not conducted.
Market research was not conducted.
(9) Any other facts supporting the use of other than full and open competition, such as:

(12) Contracting officer certification that the justification is accurate and complete to the best of the contracting officer’s knowledge and belief.
The Forest Service is required to reimburse the Military Oregon Department for O & M expenses as required by the Tenancy in Common Agreement signed by the OMD and the FS in June 2005. This document provides for fair and reasonable allocation of expenses. All expenses are reviewed and approved according to the terms set forth in the Tenancy in Common Agreement prior to submission of invoices.
I certify that this justification is accurate and complete to the best of my knowledge and belief. It is anticipated that the total amount of the contract will not exceed $ $700,000. In accordance with FAR 6.304, this award amount may be approved at the Contracting Officer level.
