The boundary of this unit is defined at the break between the sapling unit and the adjacent stand that is comprised larger timber. The unit may or may not be flagged.

Georeferenced color photos and electronic shapefiles are available upon request.

3. CONTRACTOR’S OBLIGATIONS

Contractor shall furnish equipment, materials, labor, supervision, transportation, and all supplies not provided by the Forest Service, which are required to complete the project. The Forest Service shall provide unit maps and inspection cards.

The Contractor shall be responsible for insuring that operations will not cause harm or injury to employees

(Contractor or Government), or other users of the area. The Contractor shall also be responsible for insuring that operations don’t cause any environmental or resource damage to the work area.

4. COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK

The Contractor shall be required to (a) commence work under this contract after a pre-work meeting agreed upon by the Contractor and Forest Service, (b) prosecute the work diligently, and (c) complete the entire work ready for use. 5. TECHNICAL SPECIFICATIONS

A. Selection of Leave Trees

1. Leave trees shall be selected by the Contractor, except where the Government may mark individual leave trees.

2. Retain trees at the desired average spacing, as referenced in the Detailed Unit Information table above. Spacing may be varied up to 25 percent to select the most desirable trees. However, spacing shall not be materially increased or decreased by 25 percent.

3. The following prioritized guidelines will be used for tree selection to attain leave trees at the desired spacing.

a. All trees greater than or equal to 9.0 inches DBH shall be retained. These trees shall be used in determining average leave tree spacing.

b. Leave trees shall generally be those of tallest height, largest crown, and straightest stems that are free of damage.

c. Leave trees shall be selected using the following species priority:

1) Western white pine

2) Noble fir

3) Douglas-fir

4) Western hemlock

5) Pacific silver fir

6) Mountain hemlock

7) Lodgepole pine

d. If no healthy undamaged tree exists at the required spacing interval, leave a tree relatively free of damage and/or disease, regardless of species.

4. All Pacific yew and hardwood trees shall be retained and shall not be used in determining average leave tree spacing.

5. All snags greater than or equal to 9.0 inches DBH shall be retained and shall not be used in determining average leave tree spacing.

B. Cutting & Felling Specifications

1. Do not cut trees 9.0 inches DBH or greater.

2. Cut trees shall be severed below the lowest live limb, except where prevented by natural obstacles;

in which case, any live limbs below the cutting point shall be removed.

3. Trees shall be completely severed from the stump. Stump height shall not exceed 6 inches above ground level or 4 inches above natural obstacles.

4. When two or more trees originate from the same base, treat them as one tree by either leaving them all or cutting them all.

Project Name: Lemiti Thin and Pile

5. No thinning or piling would occur within 75 feet of perennial streams, seeps, springs, ponds, reservoirs, lakes, or wetlands. Do not buffer roadside ditches. Exclude meadows, cliffs, talus and rock outcrops.

6. Cut trees shall be felled away from unit boundaries, roads, ditch lines, telephone lines, electrical lines, established trails, stock driveways, fence lines, established land corners, other physical improvements, streams, trees designated with orange paint and yellow signs. Any trees falling on such areas shall be removed and treated as specified below and elsewhere herein.

a. If trees are felled across telephone or electrical lines, the Contractor shall immediately notify the utility company, then the Contracting Officer. Removal of these trees shall be performed at the Contractor’s expense and as directed by the utility company.

b. Removal of felled trees from roads shall be accomplished within 1 hour.

c. Removal of felled trees from trails and stock driveways shall be accomplished within 24 hours.

d. Removal of felled trees from other areas shall be accomplished prior to acceptance of the unit for payment.

7. Refuel power equipment at least 150 feet away from water bodies to prevent direct delivery of contaminants into a water source, or as far as possible from the waterbody where local site conditions do not allow a 150-foot setback.

C. Slash Piling Specifications

1. Location of Piles

a. Piles shall be located so that burning will not cause damage to snags or standing green trees, unless otherwise approved by the Forest Service. This will mean that all piles are at least 10 feet away from the bowl of any live or dead, and at least 50 feet away from any structure or utility box.

b. Slash piles shall not be located at the bottom of draws that carry water during periods of surface runoff.

c. Piles will be located on the flattest surface available, away from stumps or large down logs. All piled material must be out from under the drip line of leave trees. Piles built on a slope shall run with the slope to prevent rolling. No piling within 25 feet of existing trails or within 50 feet of streams or ditches.

2. Pile Construction

a. Material between 1 and 6 inches in diameter on the large end, and over 3 feet in length will be piled. All material in excess of 6 feet in length must be bucked before being placed in the pile.

Existing down wood greater than 6 inches in diameter on the large end shall be left undisturbed.

b. Pieces over 6 inches in diameter on the large end that are not piled would be lopped and scattered so that they lie on the ground.

c. Hand piles shall be a minimum of 6 feet in height and not greater than 6 feet in height. Width shall not exceed 6 feet.

Project Name: Lemiti Thin and Pile

d. Material extending more than 2 feet beyond the general contour of the pile shall be bucked and placed on the pile. The pile should be in a “beehive” shape.

e. Piles shall be compactly constructed by aligning individual pieces in the same direction and placing heavier slash on top. Piles shall have a stable base to prevent toppling. The long axis of individual pieces shall be perpendicular to the slope to prevent rolling material.

f. Existing slash greater than 6 inches in diameter and over 3 feet in length lying exposed on the ground or suspended shall be cut to length and piled. Partially buried or rotten material will not be piled.

g. If there is not sufficient material to construct a pile with the minimum size specifications, lop and scatter the material to within 18 inches of the ground.

3. Pile Covering

a. The contractor will be required to provide black 6-mil plastic sheeting (such as Visqueen) for covering all hand piles. The plastic will be placed on piles when the piles are approximately ¾ finished and covered with additional slash to hold the plastic in place. The waterproof paper shall cover 75% of the pile.

D. Definition of Technical Specification Terms

1. Damage (Defect) - Includes any defect or deformity of a tree resulting from such agents as wind, snow, animals, insects, disease, and equipment; and evidenced by such things as dead or broken tops or trunks, crooks, gall rusts and deep scars. Examples of excessive damage and unhealthy conifers:

a. Trees with Crook, Sweep, or Snowbend (Damaged) - Crooks or bends in the main bole.

b. Forked or Defective Top (Damaged) - One or more forks in the live crown, or dead or broken-out top of the bole.

c. Diseased Trees (Unhealthy)

1) Mistletoe Infected - Small parasitic flowering plants, with mature shoots less than 6-8 inches long, that causes excessive growth and swelling to branches and stems.

2) Western White Pine Blister Rust - Disease of Western White Pine, characterized by some or all of the following symptoms: stem cankers, drab gray-green or yellow needles, poor foliage density, short needles, or an unthrifty appearance.

3) Bole Cankers - Trees with one or more visible bole infections (such as gall rusts), abnormal/dead areas or spot caused by certain species of fungi.

4) Root Rot - Areas that have two or more dead or dying trees, usually Douglas-fir, per 10-foot radius are suspected root rot pockets.

2. Deficient Trees – Those trees cut which should have been left to maintain average spacing requirements.

3. DBH (Diameter Breast Height) - Diameter of the trunk measured at a point 4.5 feet above the ground level on the uphill side of the tree.

4. Excess Tree - A tree which the Contractor, contrary to the specifications, has left uncut; has not completely severed from the stump; has left with a stump exceeding the specified maximum height; does not meet the specifications for removal of lower live limbs; or is excessively damaged by the thinning operation.

5. Fuel Break - An area within a thinned unit where thinning slash is removed or treated in order to reduce spread of fire to adjacent areas.

6. Hang-up Tree - Any cut tree that leans against or is suspended by an uncut tree, brush or shrubs, cut trees, or other obstacles.

7. Leave Tree - Any conifer tree that is selected or required to be left standing as provided in the

8. Lopping and Scattering - Cutting limbs from trunks of cut trees and moving and rearranging slash concentrations to reduce the fuel bed height above ground level, according to technical

9. Piling - Gathering and stacking of thinning slash into piles constructed and located as indicated by technical specifications and project maps.

10. Pull Back - Pulling thinning slash by hand methods back into the thinned unit and scattered, as indicated by technical specifications and project maps.

11. Satisfactory Leave Tree – Trees that were left standing according to contract specifications; or trees that are larger than the diameter limits; or trees that are not designated for cutting.

12. Slash - Any vegetation that was cut by the Contractor.

13. Spacing - The horizontal distance from the center of one leave tree to the center of the next nearest leave tree.

14. Thinning - The cutting of trees in excess of those to be left for stand management.

6. INSPECTION AND GOVERNMENT VERIFICATION

A. Inspection Procedure

1. The Contractor or Contractors’ Representative shall make periodic inspections of the thinning that has been completed and record the results on inspection cards furnished by the government and shall take corrective action, if necessary. These cards shall be given to the Forest Service on request.

2. Inspection plot size shall be 1/50 acre (16.7 feet)

a. Record the number of Satisfactory Leave Trees

b. Record the number of Deficient Trees

c. Record the number of Excess Trees

3. Upon inspection of all plots for a sub-item, the quality of thinning shall be calculated as follows:

# of Satisfactory Trees – (# of Deficient Trees + # of Excess Trees)

X 100 = Quality of Thinning # of Satisfactory Trees

B. Government Verification

The Government will make periodic inspections to verify that the Contractor is meeting contract specifications. The Contractor or Contractors’ Representative is encouraged to observe the inspection and will receive inspection summaries upon request. Inspections will be performed in a manner that will not unduly delay work.

C. Unsatisfactory Thinning

When inspection results are below 90 percent and excess trees contribute significantly to the lower inspection percentage, acceptance will not be made until the excess tree deficiency has been corrected.

Re-inspections after rework will be made in the same manner as the first inspection but on different plots.

D. Inspection of Slash Treatment

Acceptance will be determined by comprehensive visual inspection to the areas requiring treatment and will be based on adherence to the requirements stated in the Technical Specifications. Nonconformance with any of the Specifications will classify the treatment as unsatisfactory and rework will be required to bring the treatment up to Specification standards.

E. Re-inspection Upon Contractor’s Request

If the original inspection results are unacceptable to the Contractor and a second inspection is requested without rework, the same inspection procedures as implemented by the Contractor will be used.

However, the inspection pattern will be shifted. If the second inspection shows less than 5 percent variance from the first inspection, the Contractor shall pay the cost of the second inspection, and the result of the second inspection will be used in determining acceptance. Requests for re-inspection must be made in writing to the CO.

Only one re-inspection will be made by the Government.

7. PAYMENT CALCULATION

A. Calculation of Payment for Thinning - Plot Inspection

1. After inspection of completed acreage, the Contracting Officer will calculate the pay rate. The pay rate will be calculated by multiplying the inspection percentage times the contract unit price per acre.

2. When the percent of satisfactory thinning is 90 percent or greater, payment will be made at the contract unit price.

3. When the percent of satisfactory thinning is below 90 percent and this is due to overcutting, payment will be made at the actual inspection percent multiplied by the contract unit price.

Project Name: Lemiti Thin and Pile

4. If the percent of satisfactory thinning for a pay unit falls below 70 percent, and rework could not bring the percentage above 70 percent, then the contract will be considered in default and the

Contractor's right to proceed may be terminated.

B. Calculation of Payment for Slash Treatment

When slash treatment is required by the specifications and a separate pay item is provided, full payment will be made at the contract unit price if piling inspections determine contract specifications have been met.

** UNIFORM ALLOWANCE **

If employees are required to wear uniforms in the performance of this contract

The Department of Labor will accept payment in accordance with the following standards as compliance:

The contractor or subcontractor is required to furnish all employees with an adequate number of uniforms without cost or to reimburse employees for the actual cost of the uniforms. In addition, where uniform cleaning and maintenance is made the responsibility of the employee, all contractors and subcontractors subject to this wage determination shall (in the absence of a bona fide collective bargaining agreement providing for a different amount, or the furnishing of contrary affirmative proof as to the actual cost), reimburse all employees for such cleaning and maintenance at a rate of $3.35 per week (or $.67 cents per day). However, in those instances where the uniforms furnished are made of "wash and wear" materials, may be routinely washed and dried with other personal garments, and do not require any special treatment such as dry cleaning, daily washing, or commercial laundering in order to meet the cleanliness or appearance standards set by the terms of the Government contract, by the contractor, by law, or by the nature of the work, there is no requirement that employees be reimbursed for uniform maintenance costs.
