About this file

This is a Project Manual prepared by the Luzerne County Flood Protection Authority for the West Nanticoke and Hunlock Creek Structure Demolitions project, part of the Wyoming Valley Levee Raising Project Mitigation Program. The project encompasses the clearing and demolition of all existing structures—including residential buildings, detached garages, septic systems, oil/fuel tanks, and paved areas—on three parcels located at 242-246 State Route 11 in Hunlock Creek Township and at 12 South Mill Street and 74-76 Allen Street in West Nanticoke, followed by grading and seeding of all disturbed areas to enable proper drainage and future maintenance by the Township. A pre-bid conference is scheduled for Friday, January 30, 2026, at 10:00 a.m. at the Luzerne County Flood Protection Authority office in Forty-Fort, Pennsylvania. Sealed bids are due through the PennBid electronic procurement program by 10:00 a.m. on Wednesday, February 11, 2026, with public opening immediately following. Contract award is anticipated at the February 17, 2026 regular meeting of the Authority Board. The contract requires completion of all work within forty-five (45) calendar days from the date the Contract Times commence, with liquidated damages assessed at $100 per day for delays beyond this deadline.

Contractors must submit bid security equal to ten percent (10%) of the total bid amount in the form of a certified check, bid bond, or equivalent instrument. The project is subject to Pennsylvania prevailing wage requirements and compliance with multiple state and federal regulations, including the Prohibition of Illegal Alien Labor on Assisted Projects Act, Pennsylvania's Public Works Employment Verification Act, and provisions of the Americans with Disabilities Act. Contractor insurance requirements include workers' compensation (statutory), commercial general liability ($2,000,000 aggregate), automobile liability ($1,000,000), and pollution liability coverage. Contractors must provide performance and payment bonds, each equal to the contract price. All work must comply with the Erosion and Sedimentation Control Plan detailed in the specifications, Pennsylvania Department of Environmental Protection Chapter 106 Floodplain Management requirements, and utility disconnection procedures coordinated with the Pennsylvania One Call System. The project documents include asbestos inspection and testing reports, an easement agreement for the American Tower utility easement at the Route 11 site that must remain unobstructed, and location maps and site photographs for each property.

5. Surety waives notice of any and all defenses based on or arising out of any time extension to issue Notice of Award agreed to in writing by Owner and Bidder, provided that the total time for issuing Notice of Award including extensions shall not in the aggregate exceed 120 days from the Bid due date without Surety’s written consent.

6. No suit or action shall be commenced under this Bond prior to 30 calendar days after the notice of default required in Paragraph 4 above is received by Bidder and Surety and in no case later than one year after the Bid due date.
