The City of Nashua, NH invites qualified firms to submit bids for construction related to the Walnut Street
Oval Traffic Flow & Signals Project.
This project involves minor intersection modifications, pavement marking adjustments, signage revisions, and traffic signal modifications necessary to revise traffic flow directions on West Pearl Street and Factory Street to support the forthcoming Walnut Oval Intersection Improvement project. Specific improvements will include removal and paving of the southwest curb extension at the West Pearl Street and Walnut Street intersection to allow access to the east end of West Pearl Street, pavement marking and signage revisions on
West Pearl Street and Factory Street, implementation of all-way stop control at Factory & Water Street intersection, and traffic signal and pavement marking modifications at the West Pearl Street & Main Street and Factory Street & Main Street intersections. Structural evaluation of the traffic signal mast arms on Main
Street and potential replacement will also be required.
Completion Time for the project will be calculated as calendar days from the date specified in the “Notice to Proceed” as follows:
August 14, 2026 For Substantial Completion
September 30, 2026 For Final Completion
INFORMATION FOR BIDDERS:

We strongly recommend that you give yourself sufficient time and at least one (1) business day before due date to begin the uploading process and finalize your submission. Copies are also available on the City’s website in the Purchasing section within the Bids section.
If a vendor chooses to submit their bid outside of Bonfire, they may submit one (1) paper copy and one (1) digital copy on a USB drive sealed in an envelope/package clearly marked “IFB0574-010826”. Bids must be submitted in the format provided and addresses the item(s) specified in the IFB package.

Regardless of the method of submission, bids must be received no later than January 8, 2026, at 3:00pm, in the Purchasing Department, City Hall, 229 Main Street, Lower Level, Room 11, Nashua, NH 03061. Postmarks or other timestamps will not be accepted in lieu of actual delivery. Bidders can use whatever delivery mechanism it chooses as long as it remains clear that the Bidder is responsible for submissions prior to the date and time.

The City of Nashua will consider all timely-received inquiries and, if reasonable and appropriate, will issue an addendum to clarify or modify this IFB on the City’s website www.nashuanh.gov, under Services, Bid Opportunities; Current Bids; (Refer to Document IFB0574-010826) and on Bonfire no later than Wednesday, December 17, 2025, at Noon.
The City of Nashua hereby notifies all bidders that it will affirmatively insure that in any contract entered into pursuant to this advertisement, disadvantaged business enterprises will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, religion, national origin, sex, age, sexual orientation, disability or handicap in consideration for an award.
Pursuant to NRO 5-71 (A), the City of Nashua supports the concept of purchasing products which are biodegradable, can be or have been recycled, or are environmentally sound. Due consideration will be given to the purchase of such products. If you are proposing any such products which qualify, please so indicate in a cover sheet by item number and description. We are also conscious of energy use and encourage Bidders to propose products that are energy efficient.
All bids are binding for ninety (90) days following the deadline for bids, or until the effective date of any resulting contract, whichever is later.
Bids must be submitted in the format provided and address the items specified in this request. The City may reject any or all of the bids on any basis without disclosure of a reason. The failure to make such a disclosure shall not result in accrual of any right, claim or causes of action by any unsuccessful bidder against the City. The City reserves the right to waive any irregularities when the public interest will be served thereby. The City also reserves the right to negotiate any change or amendment in any bid without soliciting further requests for bids if the action is necessary for the best interest of the City.
The City of Nashua will reject the bid of any proposed bidder who is presently debarred, declared ineligible or excluded by any Federal department or agency, and reserves the right to reject the bid of any proposer who has previously failed to perform any contract properly for any purchaser, or to complete on time, contracts or a similar nature, who is not in the position to perform the contract, or who has neglected the payment of bills or otherwise disregarded its obligations to clients, purchases, subcontractors, material men, or employees.
The City is exempt of all taxes. All bids must be FOB Nashua, NH. All bidders must comply with all applicable Equal Employment Opportunity laws.
Pursuant to NRO 5-78 (F), the Purchasing Manager shall not solicit a bid from a Contractor who is in default on the payment of taxes, licenses or other monies due the City. Therefore, this bid request is void as to anyone who is in default on said payments.

Contract will be awarded to the Bidder that is designated by the City of Nashua as the lowest responsive and responsible Bidder.
GENERAL REQUIREMENTS:
A. To be eligible for an award, a Bidder must be deemed “responsible” by demonstrating the following:
has the ability, capacity and skill to provide the goods or services required;
can provide the goods or services within the time frame specified;
has a satisfactory record of integrity, reputation, judgment and experience;
has sufficient financial resources to provide the goods or services;
is on the NHDOT’s pre-qualified Contractor’s list; and has developed a positive track record with the City of Nashua to the extent the Bidder has previously provided goods or services.
B. Some common reasons why a bid might be found “non‐responsive” are:
failure to sign the bid and/or signature by the appropriate person;
failure to furnish any required bid bonds;
failure to include a unit bid price for each item;
failure to include a total amount for the bid;
failure to prepare the bid in ink;
failure to submit a non‐collusion affidavit; and inclusion of any unauthorized additions, conditional or alternative bids that make the bid package incomplete, indefinite, or ambiguous.

C. The Successful Bidder will be required to provide the City with certificates of insurance for coverage as listed below and endorsements affecting coverage required by the contract within ten (10) calendar days after the City issues the Notice of Award. The City requires thirty (30) calendar day’s written notice of cancellation or material change in coverage. The certificate and endorsements for each insurance policy must be signed by a person authorized by the insurer and who is licensed by the State of New Hampshire.
General Liability, Employers Liability and Auto Liability policies must name the City of Nashua as an additional insured and be reflected on the certificate of insurance.
• General Liability: $1,000,000 per Occurrence $2,000,000 Aggregate
• Motor Vehicle Liability: $1,000,000 Combined Single Limit *Coverage must include all owned, non-owned and hired vehicles
• Workers’ Compensation Coverage according to Statute of the State of New Hampshire:

All Bidders and subcontractors at every tier under the Bidder will fully comply with NH RSA Chapter 281- A, “Workers’ Compensation”.
It is the responsibility of the Contractor to submit to the City of Nashua certificates of insurance for the Contractor and all other subcontractors prior to the start of the project. It is the responsibility of the Contractor to provide the City of Nashua with updated certificates of insurance for the Contractor and all subcontractors 10 days prior to the expiration of coverage. The City of Nashua may, at any time, order the Contractor to stop work, suspend the contract or terminate the contract for non-compliance. All subcontractors are subject to the same insurance requirements as the Contractor.
D. The Successful Bidder will be required to post the following bonds. Cost of bond premiums to be incorporated into the bid item costs.
• Bid Bond: A bid guarantee from each bidder equivalent to 5% of the bid prices. The “bid guarantee” must consist of a firm commitment such as a bid bond, certified check, or other negotiable instrument accompanying a bid as assurance that the bidder will, upon acceptance of the bid, execute such contractual documents as may be required within the time specified.
• Payment & Performance Bonds: Successful Bidder shall furnish Performance and Payment Bonds, each in an amount at least equal to the Contract Price, as security for the faithful performance and payment of all obligations under the Contract Documents. These Bonds shall remain in effect at least until one year after the date when final payment becomes due, except as provided otherwise by Laws and Regulations or by the Contract Documents.
Successful Bidder shall also furnish such other Bonds as are required by the Contract Documents. When Successful Bidder delivers the executed agreements to the City, Successful Bidder shall also deliver to the City such Bonds as may be required to furnish.
E. The City also reserves the right to negotiate any change or amendment in any bid without soliciting further bids if the action is necessary for the best interest of the City.
F. The City may conduct discussion with responsible Bidders prior to selection. Successful Bidders shall begin performance upon receipt of an executed contract and a valid purchase order issued from the City.
G. The City may reject any and all responses on any basis without disclosure of a reason. The failure to make such a disclosure shall not result in accrual of any right, claim, or cause of action by any unsuccessful bidder against the City.
H. After the initial designation of a Bidder, City Staff will work with the selected Bidder to negotiate final terms and conditions between the City and the successful Bidders prior to the Contract Award. A draft contract is attached.
I. The Bidder shall meet all requirements of the Americans with Disabilities Act.

J. The City encourages disadvantaged business enterprise (DBE) participation from contractors and/or subcontractors.
K. The Bidder should understand that under the New Hampshire Right-to-Know Law, all documents submitted in response to this request, including financial information, are considered public information and will be made available to the public upon request, unless specifically exempted under the law.
L. Any Bidder submitting a bid may appeal a pending award prior to award by the City. The appellant must:
a) Submit a written protest to the City’s Purchasing Manager within five (5) business days after the bid opening;
b) Describe, in the written protest, the issues to be addressed on appeal;
c) Post, with the written protest, a bond with a surety meeting the requirements of General
Condition 5.02 authorized to do business in this state or submit other security in a form approved by the City who will hold the bond or security until a determination is made on the appeal;
d) Post the bond or other security in the amount of 25% of the total dollar value of the appellant’s bid, up to a maximum bond or other security amount of $250,000.00;
e) Not seek any type of judicial intervention until the City has rendered its final decision on the protest.
If an appeal is granted, the full amount of the posted bond or security will be returned to the appellant.
If the appeal is denied or not upheld, a claim may be made against the bond for expenses suffered by the City because of the unsuccessful appeal. The City is not liable for any costs, expenses, attorney's fees, loss of income, or other damages sustained by the appellant in a bid appeal process.
M. The City assumes no liability for the payment of costs and expenses incurred by any Bidder in responding to this request. All bids become sole property of The City. This is not a contract and shall not be interpreted as such but rather serves as an instrument through which qualifications and cost bids are solicited.
N. Bid Document Submission List:
To be considered a complete response, the following documents must be submitted along with your bid.
a) Division 1 of the Bidding Specifications and Contract Requirements
i. Bid Form – which includes a tabulation of Subcontractors, Suppliers and other individuals and entities required to be identified in this Bid;
ii. Schedule of Values;
iii. Bid Bond; and
iv. Construction Contractor’s Qualification Statement

b) Any and all addendums issued after the release of this IFB. Upon issuance, addendums can be found on the City website or on Bonfire with the original bid documents.
ADDITIONAL CONSIDERATIONS:
The Bidder selected shall be expected to comply with all applicable federal and state laws in performance of services. The consideration of all bids and subsequent selection of the Successful Bidder shall be made without regard to race, color, sex, age, handicap, religion, political affiliation or national origin. Services provided by the Successful Bidder shall be rendered through a Standard Form of Agreement Between Owner and Contractor Contract, which has been included in Division 3 of the Bidding Specifications and Contract Requirements.
Bidder must identify any exceptions or objections it has to the City’s sample Standard Form of Agreement Between Owner and Contractor, General Conditions, Supplementary Conditions documents. Copies are part of the Bidding Specifications and Contract Requirements.
The City may from time to time revise the above listed documents. The City will not accept or entertain any exceptions or objections to the above listed documents at any time after Bid submittal except and only to the extent the City subsequently makes a material change to a substantive provision of the above listed terms and conditions.
The bid must declare that it is made without collusion with any other person or entity submitting a bid pursuant to this IFB.
Disclosure of any potential conflict or statement that there are none to the best knowledge of the Bidder(s).
Also, Bidder(s) should state its intention to conform to the no conflict provisions of the IFB.

1. The undersigned Bidder proposes and agrees, if this BID is accepted, to enter into an agreement with the City in the form included in the BID Documents to perform all Work as specified or indicated in the BID Documents for the prices and within the times indicated in this BID and in accordance with the other terms and conditions of the BID Documents.
2. The Bidder accepts all of the terms and conditions of the Advertisement for BID and Information for Bidders, including without limitation those dealing with the disposition of Security. The bid will remain subject to acceptance for ninety 90 days after the day of bid opening, or for such longer period of time that Bidder may agree to in writing upon request of the City.
3. In submitting this BID, Bidder represents, as set forth in the Agreement, that:

E. Bidder does not consider that any further examinations, investigations, explorations, tests, studies, or data are necessary for the determination of this bid for performance of the Work at the price(s) bid and within the times and in accordance with the other terms and conditions of the BID Documents.
F. Bidder is aware of the general nature of work to be performed by the City and others at the Site that relates to the Work as indicated in the BID Documents.
G. Bidder has correlated the information known to Bidder, information and observations obtained from visits to the Site, reports and drawings identified in the BID Documents, and all additional examinations, investigations, explorations, tests, studies, and data with the BID Documents.
H. Bidder has given written notice of all conflicts, errors, ambiguities, or discrepancies that Bidder has discovered in the BID Documents, and the written resolution thereof by the City is acceptable to Bidder.
I. The BID Documents are generally sufficient to indicate and convey understanding of all terms and conditions for performance of the Work for which the BID submitted.
4. Bidder further represents that this BID genuine and not made in the interest of or on behalf of any undisclosed individual or entity and is not submitted in conformity with any agreement or rules of any group, association, organization or corporation; Bidder has not directly or indirectly induced or solicited any other Bidder to submit a false or sham BID Bidder has not solicited or induced any individual or entity to refrain from bidding; and has not sought by collusion to obtain for itself any advantage over any other Bidder or over the City .

1. Bidder and Surety, jointly and severally, bind themselves, their heirs, executors, administrators, successors, and assigns to pay to OWNER upon default of Bidder the penal sum set forth on the face of this Bond.
2. Default of Bidder shall occur upon the failure of
Bidder to deliver within the time required by the Bidding Documents (or any extension thereof agreed to in writing by OWNER) the executed Agreement required by the Bidding Documents and any performance and payment bonds required by the Bidding Documents and Contract Documents.
3. This obligation shall be null and void if:
3.1. OWNER accepts Bidder’s bid and Bidder
delivers within the time required by the Bidding Documents (or any extension thereof agreed to in writing by OWNER) the executed Agreement required by the Bidding Documents and any performance and payment bonds required by the Bidding Documents and Contract Documents, or
3.2 All bids are rejected by OWNER, or
3.3 OWNER fails to issue a notice of award to
Bidder within the time specified in the Bidding Documents (or any extension thereof agreed to in writing by Bidder and, if applicable, consented to by Surety when required by paragraph 5 hereof).
4. Payment under this bond will be due and payable upon default by Bidder and Within 30 calendar days after receipt by Bidder and Surety of written notice of default from OWNER, which notice will be given with reasonable promptness, identifying this Bond and the Project and including a statement of the amount due.
5. Surety waives notice of and any and all defenses based on or arising out of any time extension to issue notice of award agreed to in writing by OWNER and Bidder, provided that the time for issuing Notice of Award including extensions shall not in the aggregate exceed 120 days from Bid Due Date without Surety’s written consent.
6. No suit or action shall be commenced under this
Bond prior to 30 calendar days after the notice of default required in paragraph 4 above is received by Bidder and Surety, and in no case later than one year after Bid due date.
7. Any suit or action under this Bond shall be commenced only in a court of competent jurisdiction located in the state in which the Project is located.
8. Notice required hereunder shall be in writing and sent to Bidder and Surety at their respective addresses shown on the face of this Bond. Such notices may be sent by personal delivery, commercial courier or by United States Registered or Certified Mail, return receipt requested, postage pre-paid, and shall be deemed to be effective upon receipt by the party concerned.
9. Surety shall cause to be attached to this Bond a current and effective Power of Attorney evidencing the authority of the officer, agent or representative who executed this Bond on behalf of Surety to execute, seal and deliver such Bond and bind the Surety thereby.
10. This Bond is intended to conform to all applicable statutory requirements. Any applicable requirement of any applicable statute that has been omitted from this Bond shall be deemed to be included herein as if set forth at length. If any provision of the Bond conflicts with any applicable provision of any applicable statute, then the provision of said statute shall govern and the remainder of this Bond that is not in conflict therewith shall continue in full force and effect.
