1. Agency and Contracting Activity.
The Department of Homeland Security (DHS), U.S. Immigration and Customs Enforcement (ICE), Office of Acquisition Management (OAQ), proposes to enter into a contract on behalf of Homeland Security Investigations (HSI) Chicago on a basis of other than full and open competition.
2. Nature and/or description of the item/service being procured and anticipated cost.
(a) Type of action: Firm-Fixed Price
(b) Amount the current J&A is justifying:
(c) Brief Description: OAQ intends to procure, on a sole source basis, internet services for the HSI Chicago office. The vendors listed below are the only internet service providers authorized to be used at the office location per the buildings property manager.

Rationale:
HSI Chicago has a need for internet services at their office building. The previous contract, 70CMSD23P00000007, was awarded to Comcast and the contract expired on February 11, 2024.
During this time HSI Chicago has been paying for internet services via government purchase card while waiting for the new contract to be awarded. During market research, the building’s property manager informed HSI Chicago that there were only two authorized internet service providers for the building, Comcast (the incumbent) and AT&T.
4. The anticipated price will be determined fair and reasonable based on one or more of the price analysis techniques described below in accordance with FAR Part 13.106- 3(a)(2). (Check one and provide short description of action taken.)
Market Research.
Comparison of the proposed price with prices found reasonable on previous purchases.
Current price List.
Comparison with similar items in a related industry.
Comparison to IGCE.
Contracting Officer’s personal knowledge.

Short description of how price was determined fair and reasonable:
The Contracting Officer determines that the anticipated price(s) will be fair and reasonable based on adequate price competition. This will be competed on SAM.gov as a Small Business set-aside. If only one response is received, the Contracting Officer may base the determination on: market research, comparison of the proposed price with prices found reasonable on previous purchses; current price lists, catalogs, advertisements, comparison with similar items in a related industry; the Contracting Officer’s personal knowledge of the item being purchase; and/or any other reasonable basis to determine that the price at the time of the award represents the overall best value for the Government and is fair and reasonable.
