About this file

This is a Justification and Approval (J&A) document for a sole-source contract award by the Department of the Navy's DLA Maritime office in Mechanicsburg, Pennsylvania.

The Navy seeks to acquire six spare pressure equalizing gaseous product valves (NSN 4820 015216164, P/N 506-4009) directly from Portland Valve LLC (CAGE 53154) with an expected final delivery date of February 4, 2030. The acquisition is classified as spares under a non-commercial procurement for military application. The contracting activity determined that Portland Valve LLC is the only responsible source capable of satisfying the requirement because they exclusively own the technical data and manufacturing rights for this item, and the Government determined it uneconomical to acquire the data or pursue reverse engineering. No authorized substitutes exist, as the item must be tested and qualified within the higher assembly according to approved testing specifications, embedded coding procedures, design protocols, and internal quality assurance requirements. Market research was conducted across multiple Government databases (ITIMP, WEBFLIS, ERP) and included searches of mandatory sources of supply including UNICOR, Ability One, GSA, and SAM, with no viable alternatives identified. A Request for Information/Sources Sought Notice was posted on the government-wide point of entry with an initial solicitation period from March 20, 2026 to April 20, 2026, later amended to July 20, 2026. One quote was received from Portland Valve that exceeded the Simplified Acquisition Threshold. The previous procurement for this item (SPRMM118CYA82) was awarded on May 9, 2018 at $95,550.00 per unit for a quantity of two. The anticipated contract cost has been determined to be fair and reasonable, with pricing analysis supporting reasonableness. The J&A was created May 5, 2026 and received final supervisory approval on August 4, 2026.

The Government does not own the data or the rights to the data needed to purchase / contract repair of this part from additional sources. It has been determined to be uneconomical to buy the data or rights to the data. It is uneconomical to reverse engineer the part. This code is used when the Government did not initially purchase the data and/or rights. If only one source has the rights or data to manufacture/repair this item, A/RMCs 3, 4, or 5 are valid. If two or more sources have the rights or data to manufacture/repair this item, A/RMCs 1 or 2 are valid.

This acquisition will be solicited to

PORTLAND VALVE LLC (CAGE 53154). Based on the market research performed by the technical advocate, it is concluded that the only source of procuring the spare part is PORTLAND VALVE LLC (CAGE 53154) because they are currently the only source capable of satisfying this requirement. PORTLAND VALVE LLC (CAGE 53154) is the only known source that has/owns the data, and it has been deemed uneconomical to pursue the acquisition of the data because the data and its content are not available. There are no authorized substitutes of this item as this is the only item known to meet performance and compatibility requirements within the higher assembly. Furthermore, there is no data to support an open and full competition. The item has to be tested within the upper assembly and qualify within approved testing specifications procedures, embedded coding procedures, design protocols, and internal QA requirements. NAVSUP-WSS must procure the item from PORTLAND VALVE LLC (CAGE 53154).

A technical review, which consisted of searching several Government databases including ITIMP, WEBFLIS and ERP, has been completed on this item. Search criteria included Part Number, Design Control Activity, Cage Code, NSN, Nomenclature, AMC/AMSC, AAC, Criticality Coding, recorded approved sourced of supply, historical sources of supply and past contracts. Based on this market research the contracting officer has determined that the only known repair source is PORTLAND VALVE LLC (CAGE 53154). If a company other than the one listed believes they have a compatible product, they can submit the item to the Engineering Program Office, to include research and development, drawings and test specifications. The program office may test and evaluate the item at the company’s expense, when appropriate. Upon qualification, the approved company will be able to participate in current or future solicitations. ITIMP- Reviewed award history and other potential sources of supply, AMC/AMSC code, part number, CAGE code. ERP- Search criteria included part number, design control activity, Cage code, NSN, Nomenclature, AMC/AMSC, AAC, Criticality Coding which all matched with ITIMP. A review of the databases, in the market research, did not reveal nor identify any known distributors. All market research sites were checked which include UNICOR, Ability One, GSA, SAM, HAYSTACK and WEBFLIS by DLA Weapon Support. A review of the mandatory sources of supply was conducted in accordance with FAR 8.002 and DFARS 208.002. None of the mandatory sources of supply are capable of providing this requirement. Source Validation Review

I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable. This item has been procured on a non-commercial basis in the past and is for a specific military application. However, the total estimated cost is lower than the threshold for providing certified cost or pricing data as provided for in FAR15.403-3. Any necessary price analysis or cost information will be used to support the reasonableness of the price.

To promote competition, NAVSUP WSS will continue to encourage vendors with the expertise to manufacture/repair the subject item to submit a complete technical data package for review and source approval by the appropriate engineering source approval authority per the (WSS) guidelines. Also, future requirements will be advertised on the government-wide point of entry. If another potential manufacturing source emerges, NAVSUP WSS will assess whether competition for future requirements is feasible. The government will include remarks in this solicitation instructing offerors interested in qualifying an alternate product for future acquisitions to contact the design control activity specified on the source control drawing.
