4. Basis for Sole Source

a. Authority Cited: Simplified Procedures for Certain Commercial Items, 41 U.S.C. 1901 (or 41 U.S.C.

1903 for Special Emergency Procurement) as implemented by FAR Subpart 13.5:

Unusual and compelling urgency Exclusive licensing agreements Industrial mobilization

Brand Name (Note approval level requirements are applicable only to this portion FAR 13.501(2)

Other: 41 U.S.C. 1901

b. Reason for Authority Cited:

Replacement parts for a Propulsion Drive System currently installed on board an MSC vessel are required to be procured from the original manufacturer (OEM), Renk Corporation and/or authorized distributors.

All of the replacement parts have unique specifications required to meet the form, fit, and function for proper interface with the existing system. The designs and drawings of the exact items are proprietary to Renk Corporation.

5. Efforts to Obtain Competition:

This requirement will be synopsized and solicited via SAM.Gov as an unrestricted, firm fixed price supply requirement. A telecom with Renk Corporation on 12/15/2021 confirmed they have no authorized distributors as they only sell directly. The Contracting Officer shall publish the notices required by FAR 5.201.

6. Actions to Increase Competition:

Market research indicates that only the OEM, Renk Corporation is capable of providing the required supplies.

7. Market Research:

Market research was conducted in accordance with FAR Part 10 and FAR Part 8 and it has been determined that the current requirement cannot be fulfilled via any mandatory sources of supply. Similar requirements have been solicited and negotiated as a sole source to the OEM. The required supplies are commercial in nature and readily available from the OEM. Commercial terms and conditions will be sufficient for this requirement.

8. Actions to Remove Barriers to Future Competition For the reasons set forth in paragraph 4, NAVSUP FLCPS has no plans at this time to compete future contracts for the supplies covered by this document. If another potential source emerges, NAVSUP FLCPS will assess whether competition for future requirements is feasible.

9. Any Other facts supporting the use of other than full and open competition.
