About this file

This is a Pre-Solicitation Notice for a Request for Proposal (RFP 701-26-008-R) issued by the Texas Education Agency (TEA) regarding a Teacher Liability Insurance program. The TEA is seeking qualified contractors to design, implement, and manage a comprehensive liability insurance program for classroom teachers as defined by Texas Administrative Code 153.1301(3), with the additional requirement to assist teachers in understanding their rights, duties, and benefits as authorized by House Bill 2 of the 89th Texas Legislative Session. The RFP offers two application options that contractors may propose individually or in combination: Option A involves Statewide Coverage implemented across Texas covering all teachers by default, with pricing based on per-person premiums for approximately 379,456 classroom teachers; Option B involves Voluntary Enrollment where participation requires active teacher enrollment, with pricing based on per-enrollment costs. The notice was posted on August 13, 2026, with a 60-day pre-solicitation advertisement period. Required coverage components include liability coverage, criminal defense, civil rights claims, bail bond coverage, identity theft protection, and legal support services.

The pricing structure varies by option selected, with Option A based on statewide coverage across all Texas teachers and Option B structured around actual enrollment numbers. Loss funds under Option A are to be capped at a reasonable maximum deductible to be determined by TEA for member claims. While contractors may propose support for disseminating information regarding teacher workplace rights, duties, and benefits per Texas Education Code 21.417, the selected contractor's primary focus should be on developing and administering an effective liability insurance program. Interested parties may direct additional questions to the TEA Contracts and Purchasing Division at TEASolicitations@tea.texas.gov.

Pre-Solicitation Number: RFP 701-26-008-R

Pre-Solicitation Name: Teacher Liability Insurance

Notice Posting Date: August 13, 2026

Days Advertised: 60-Day Pre-Solicitation Notice

Pre-Solicitation Description:

The Texas Education Agency (TEA) will be requesting responses from qualified contractors to propose and design, implement, and manage a liability insurance program for classroom teachers as defined by TAC 153.1301(3) as well as assist in helping teachers understand their rights, duties, and benefits, as authorized by House Bill 2 (HB2) of the 89th Texas Legislative Session.

This RFP includes two application options where contractors can propose one or both options. TEA will choose from one of the following options:

• Option A: Statewide Coverage - This option indicates a program implemented across Texas, covering all teachers by default. This option should focus on a per-person premium and the inevitable inclusion of loss funds, which are to be capped at a reasonable max deductible provided by TEA towards claims by members. Price should be based on the full state, encompassing approximately 379,456 Texas classroom teachers.

• Option B: Voluntary Enrollment - This option indicates a program where participation is voluntary and requires active enrollment by each teacher. Under this option, TEA would seek to establish payments based on a per-enrollment premium cost structure where price is based on the amount of teachers enrolled.

Contractors may choose to propose both options in their response to this RFP, understanding that this provides TEA with multiple options to analyze, not an obligation to choose two program options simultaneously.

Responses should include, but are not limited to providing:

- Liability Coverage

- Criminal Defense

- Civil Rights Claims

- Bail Bond Coverage

- Identity Theft

- Legal Support

For both program design options:

TEC 21.417 includes part 1 to assist teachers in understanding their rights, duties, and benefits. TEA has taken initial steps toward fulfilling that component. Contractors may support the dissemination of information that helps teachers understand their workplace rights, duties, and benefits. However, the selected contractor should prioritize the development and administration of an effective liability insurance program.
