Therefore, the vendor’s initial quote should con-tain the vendor’s best terms. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary.
This USPS AMS-API Software License requirement is being conducted in accordance with FAR Subpart 13.104.
See Statement of Work and Evaluation Criteria specified in this Request for Quote.

No other rating or qualitative value will be assigned. To be determined technically acceptable, all technical factors (1 & 2) must be rated acceptable for the technical quotation. Any technical quotation that does not re-ceive an acceptable rating for all factors, [including sub-factors], will receive an unacceptable rating for the technical quotation.
Award will be made to the lowest-priced, technically acceptable, responsible vendor. The work shall be performed on a Firm Fixed Price basis.

Termination for Convenience The Contracting Officer, by written notice, may terminate this contract, in whole or in part, when, in his sole discretion, he determines that it is in the Government's interest. Such notice will specify the effective date of termination. If this contract is terminated, the Gov-ernment shall not be liable for any termination costs, and shall be liable only for payment under the payment provisions of this con-tract for the legal services rendered before the effective date of termination.
Termination for Default
(a) The Government may terminate performance of work under this contract in whole, or in part, if the Contractor defaults in perform-ing this contract and fails to cure the default within 10 days (unless extended by the Contracting Officer) after receiving a notice spe-cifying the default. Default includes failure to make progress in the work so as to endanger performance.
(b) The Contracting Officer shall terminate by delivering to the Contractor a Notice of Termination specifying that termination is for default of the Contractor, the extent of termination, and the effective date. If after termination for default, it is determined that the Contractor was not in default or that the Contractor failure to perform or to make progress in performance is due to causes beyond the control and without the fault or negligence of the Contractor set forth in the Excusable Delays clause (see (c) below), the rights and obligations of the parties will be the same as if the termination was for the convenience of the Government.
(c) Excusable delays. The Contractor shall be liable for default unless nonperformance is caused by an occurrence beyond the reason-able control of the Contractor and without its fault or negligence, such as acts of God or the public enemy, acts of the Government in either its sovereign or contractual capacity, fires, floods, epidemics, quarantine restrictions, strikes, unusually severe weather, and delays of common carriers. The Contractor shall notify the Contracting Officer in writing as soon as it is reasonably possible after the commencement of any excusable delay, setting forth the full particulars in connection therewith, shall remedy such occurrence with all reasonable dispatch, and shall promptly give written notice to the Contracting Officer of the cessation of such occurrence.
GAO 52.216-9002 Most Favored Customer Price (Jun 04) - Alternate 1 (Agency Specific) The Offeror warrants and agrees that the prices charged under this Agreement will not exceed the prices charged by the contractor to its most favored customer for the same item or services in like or comparable quantities; and further agrees, that any payments re-ceived for charges made in excess of prices paid by such most favored customers will be returned to the Government.
GAO 52.243-70 Notification of Changes Definitions: "Contracting Officer," as used in this clause, does not include any representative of the Contracting Officer: "Contracting Officer's Representative (COR)," as used in this clause, means any person the Contracting Officer has so designated by written notice (a copy of which shall be provided to the Contractor) which shall refer to this subparagraph and shall be issued to the designated rep-resentative before the COR exercises such authority.
Notice: The primary purpose of this clause is to obtain prompt reporting of Government conduct that the Contractor considers consti-tuting a change to this contract. Except for changes identified as such in writing and signed by the Contracting Officer, the Contractor shall notify the Contracting Officer in writing promptly, within 15 calendar days from the date that the Contractor identifies any Gov-ernment conduct (including actions, inactions, and written or oral communications) that the Contractor regards as a change to the con-tract terms and conditions. On the basis of the most accurate information available to the Contractor, the notice shall state:
1) The date, nature, and circumstances of the conduct regarded as a change;
2) The name, function, and activity of each Government individual and Contractor official or employee involved in or knowledgeable about such conduct;
3) The identification of any documents and the substance of any oral communication involved in such conduct; and
4) In the instance of alleged acceleration of scheduled performance or delivery, the basis upon which it arose.
GAO 52.235-73 Confidentiality of GAO Data (APR 1984) Because of the sensitivity and confidentiality of much of the data handled by GAO, the contractor shall maintain documents, data, and other information supplied to it by the GAO, in accordance with all applicable Federal guidelines and regulations. Also, specific CLINs under this contract may involve processing records or portions of records which GAO treats as confidential, and contain in-formation subject to the GAO Privacy Procedures for Personnel Records, 4 C.F.R. Part 83.
The contractor assumes full responsibility for and guarantees the security of all documents, data, and other information supplied by GAO. The contractor shall assure that all persons handling GAO confidential or sensitive materials has signed the GAO Non-Disclosure Agreement.

At the Comptroller Gen-eral's option, the contractor shall assign all of his rights of action against any person to the United States.
