EVALUATING CONTRACTOR PERFORMANCE
The General Services Administration (GSA), Public Buildings Service (PBS) will begin using Contractor Performance Assessment Reporting System (CPARS) modules as the secure, confidential, information management tool to facilitate the performance evaluation process. The system enables a comprehensive evaluation by capturing comments from both GSA and the contractor. The following are the modules of the system:
(a) Contractor Performance Assessment Reporting System (CPARS): Used to create past performance evaluations on services procurements;
(b) Architect Engineer Contract Administration Support System (ACASS): Used to create past performance evaluations on A/E procurements; and
(c) Construction Contractor Appraisal Support System (CCASS) module: Used to create past performance evaluations on construction procurements.
Throughout the rest of this section, the term “CPARS” will mean the overall evaluation system (inclusive of the CPARS, ACASS and CCASS evaluation modules).
Each award requiring an evaluation will be registered in CPARS by the Government. Within 30 days of award, the contractor will receive an email that contains user account information, as well as the applicable contract number(s) and evaluation module assigned. The contractor will have one user account set up that will allow access to all three modules.
Contractors are encouraged to visit http://www.cpars.csd.disa.mil/allapps/cpartrng/webtrain/webtrain_all.htm to sign up for free on-line Contractor Overview training when these sessions are offered. The training session is (2) hours and is specifically for contractor users who will provide Past Performance Evaluation comments on PBS evaluations.
After the contracting officer prepares and releases a contract evaluation, the contractor will receive an email alerting them the evaluation is ready for their review and comment. The contractor will have 30 days to respond to the evaluation. GSA shall provide for review at a level above the contracting officer (e.g., contracting director) to consider any disagreement between GSA and the contractor regarding GSA’s evaluation of the contractor. Based on the review, the individual at a level above the contracting officer will issue the ultimate conclusion on the performance evaluation.
NOTE: Unless the contractor provides a different point of contact (POC) to the contracting officer after award, the Past Performance Point of Contact (POC) listed on the contractor’s Central Contractor Registration (CCR) profile will be used as the default Past Performance POC. This is the individual who will receive CPARS email alerts. In accordance with FAR Clause 52.204-7 the contractor is responsible for the accuracy and completeness of the data within the CCR database.
Copies of the evaluations, contractor responses, and review comments, if any, will be retained as part of the contract file, and may be used by Federal Agencies to support future award decisions.
For any assistance with the CPARS module, please contact the Customer Support Desk at (207) 438-1690 or via email at webptsmh@navy.mil. SECTION D – PACKAGING AND MARKING
E1. FAILURE TO PERFORM
(a) If any of the services do not conform with contract requirements, the Government may require the Contractor to perform the services again in conformity with contract requirements, at no increase in contract amount. If the work remains deficient, the COR may have the work accomplished by other means and deduct the cost thereof from the monthly payment. When the defects in services cannot be corrected by re-performance, the Government may--
(1) Require the Contractor to take necessary action to ensure that future performance conforms to contract requirements; and
(2) Reduce the contract price to reflect the reduced value of the services performed.
(b) If the Contractor fails to promptly perform the services in conformity with the contract requirements or to take the necessary action to ensure future performance in conformity with contract requirements, the Government may--
(1) By contract or otherwise, perform the services and charge to the Contractor any cost incurred by the Government that is directly related to the performance of such service; or
(2) Terminate the contract for cause.
E2. FAR 52.246-4 INSPECTION OF SERVICES – FIXED PRICE (AUG 1996)
(a) Definition: "Services," as used in this clause, includes services performed, workmanship, and material furnished or utilized in the performance of services.
(b) The Contractor shall provide and maintain an inspection system acceptable to the Government covering the services under this contract. Complete records of all inspection work performed by the Contractor shall be maintained and made available to the Government during contract performance and for as long afterwards as the contract requires.
SECTION E – INSPECTION AND ACCEPTANCE
(c) The Government has the right to inspect and test all services called for by the contract, to the extent practicable at all times and places during the term of the contract. The Government shall perform inspections and tests in a manner that will not unduly delay the work.
(d) If the Government performs inspections or tests on the premises of the Contractor or a subcontractor, the Contractor shall furnish, and shall require subcontractors to furnish, at no increase in contract price, all reasonable facilities and assistance for the safe and convenient performance of these duties.
(e) If any of the services do not conform with contract requirements, the Government may require the Contractor to perform the services again in conformity with contract requirements, at no increase in contract amount. When the defects in services cannot be corrected by re- performance, the Government may--
(1) Require the Contractor to take necessary action to ensure that future performance conforms to contract requirements; and
(2) Reduce the contract price to reflect the reduced value of the services performed.
(f) If the Contractor fails to promptly perform the services again or to take the necessary action to ensure future performance in conformity with contract requirements, the Government may--
(1) By contract or otherwise, perform the services and charge to the Contractor any cost incurred by the Government that is directly related to the performance of such service; or
(2) Terminate the contract for default.
E3. ADDITIONAL REQUIREMENTS FOR INSPECTION OF SERVICES
(a) Government inspections and tests are for the sole benefit of the Government and do not—
(1) Relieve the Contractor of responsibility for providing adequate quality control measures;
(2) Relieve the Contractor of responsibility for damage or loss of the material before acceptance;
(3) Constitute or imply acceptance; or
(4) Affect the continuing rights of the Government after acceptance of the completed work under paragraph (d) below.
(b) The presence or absence of a Government inspector does not relieve the Contractor from any contract requirement, nor is the inspector authorized to change any term or condition of the specification without the Contracting Officer’s written authorization.
(c) The contractor shall, without charge, replace or correct work found by the Government not to conform to contract requirements, unless in the public interest the Government consents to accept the work with an appropriate adjustment in the contract price. The Contractor shall promptly segregate and remove rejected material from the premises.
(d) Unless otherwise specified in the contract, the Government shall accept, as promptly as practicable after completion and inspection, all work required by the contract or that portion of the work the Contracting Officer determines can be accepted separately. Acceptance shall be final and conclusive except for latent defects, fraud, or the Government’s rights under any warranty or guarantee.
(e) The government may charge to the Contractor any additional cost of inspection or test when work is not ready at the time specified by the Contractor for inspection or test or when prior rejection makes re-inspection or retest necessary
E4. CRITERIA FOR EVALUATIVE PERFORMANCE
(a) At the sole election of the Government, and upon notification of the Contractor, the Contractor may be required to re-perform or perform late any or all defective work disclosed by Government inspection, including incomplete performance. Where the Government so elects, the Contractor shall be notified promptly after inspection that specified defective services must be re-performed or performed late, and completed within a reasonable time, as specified by the Government. In such cases, the Government shall re-inspect the work designated for re- performance or late performance, and the Contractor may be liable for any damages sustained by the Government including, for example, the costs associated with re-inspection. All re- performance by the Contractor will not be a reimbursable cost.
(b) Re-performance, and the acceptance of re-performance (or late performance), will be determined by the CO or COR on an individual service work item basis.
(c) The Government reserves the right to have any or all of the existing deficiencies corrected by other means. The Contractor will have the full amount of the cost for having these deficiencies corrected deducted from the monthly payment.
(d) Payment may be withheld for failure to comply with any terms and conditions of the contract.
E5. CANCELLATION CLAUSE
This contract may be canceled unilaterally by either party under the following conditions:
Cancellation under this clause is limited to total, not partial, contract cancellation and does not apply to individual task orders. This contract may be canceled, without cost, by either the contractor or GSA upon 120 calendar days after receipt of written notice.
Such a cancellation does not relieve the contractor for the obligation to perform work under this contract prior to the effective cancellation date, nor does it relieve GSA from the obligation to pay for such work. Such a cancellation will not provide any settlement costs to the contractor and will not result in any action by GSA to gain performance by a surety or to obtain reprocurement costs.
E6. SUSPENSION OF WORK
Deductions will not be taken for services not performed due to unanticipated closing of the building by the Government due to inclement weather, unanticipated holidays, failure of the Congress to appropriate funds, etc., provided the contractor's employees are compensated.
E7. DETERMINATION OF DEDUCTION AMOUNTS
The Deduction amount or the actual cost to the Government for having the work performed by other means will be used by the Government in determining monetary reductions to contract price for nonperformance of work under this contract, or for deficiencies in the performance of work.
Administrative costs are those time and material costs incurred by Government personnel to correct or respond to the unsatisfactory event. Inadequate performance is just as undesirable as nonperformance, and the cost of correcting inadequate performance may equal the cost of initial performance. Therefore, the deduction criteria in this Section shall control in all cases, as distinguished from the Contractor's estimated cost to perform the work.

SECTION G – CONTRACT ADMINISTRATION DATA
G4. EVALUATING CONTRACTOR PERFORMANCE
The General Services Administration, Public Buildings Service, will begin using the Contractor Performance Assessment Reporting System (CPARS) modules as the secure, confidential, information management tool to facilitate the performance evaluation process. CPARS enables a comprehensive evaluation by capturing comments from both GSA and the contractor. CPARS is the overall system name;
however, it is important to note the different modules within.
CPARS module: This module is used to create past performance evaluations on services procurements.
CCASS module: This is the Construction Contractor Appraisal Support System. This is used to create past performance evaluations on construction procurements.
The term “CPARS” will be used throughout this document to denote the overall evaluation system (the evaluation modules of CPARS, ACASS and CCASS).
Each award requiring an evaluation must be registered in CPARS. The contractor will receive several automated emails. Within thirty days of award, the contractor will receive an e-mail that contains user account information, as well as the applicable contract number(s) and evaluation module assigned. The contractor will have one user account set up that will allow access to all three modules.
Contractors are encouraged to visit http://www.cpars.csd.disa.mil/allapps/cpartrng/webtrain/webtrain_all.htm to sign up for the free on- line Contractor Overview training when these sessions are offered. This is a 2 hour training session specifically targeted to contractor users who will provide Past Performance Evaluation comments on PBS evaluations.
Once the evaluation is readied and released, the contractor will receive a second email alerting them the evaluation is ready for their review and comment. The contractor will have thirty (30) days to respond to the evaluation. GSA shall provide for review at a level above the contracting officer (i.e., contracting director) to consider any disagreement between GSA and the contractor regarding GSA’s evaluation of the contractor.
Based on the review, the individual at a level above the contracting officer will issue the ultimate conclusion on the performance evaluation.
NOTE: Unless the contractor provides a different POC to the contracting officer after award, the contracting officer will use the Past Performance Point of Contact (POC) listed on the contractors Central Contractor Registration (CCR) profile as the default Past Performance POC. This is the person that will receive the above CPARS email alerts. In accordance with FAR Clause 52.204-7 at 52.204-7 the contractor is responsible for the accuracy and completeness of the data within the CCR database.
Copies of the evaluations, contractor responses, and review comments, if any, will be retained as part of the contract file, and may be used by Federal Agencies to support future award decisions
