J&A-21-00117

This acquisition is conducted under the authority of the Multiple-Award Schedule Program, 41 U.S.C. 152(3), Competitive Procedures, and 40 U.S.C. 501, Services for Executive Agencies.

1. Agency and Contracting Activity.

The U.S. Department of Homeland Security, U.S. Immigration and Customs Enforcement (ICE), Office of Acquisition Management (OAQ), on behalf of the Office of Professional Responsibility (OPR), Security Division (SD), and Physical Security Operations Unit (PSOU) proposes to award an order modification pursuant to FAR 8.405-6(a), Limiting Sources.

2. Nature and/or description of the action being approved.

(a) Type of action: Modification to HSCEMR-17-F-00039

(b) Amount the current J&A is justifying: Increase in the award ceiling of $666,770.46 (in total). Increase to the ceiling amount based on current mod is $175,000.00. A limited source justification was not done for the previous increases in the award ceiling.

Therefore, this limited source justification will cover the current modification as well as the entire increase from inception of award.

(c) Brief Description: OAQ intends to procure, on a sole source basis, surge support and travel from the following company.

Global Resource Solutions Inc.

3701 Pender Drive Suite 320 Fairfax, VA 22030

3. Description of Supplies/Services.

This requirement is to provide professional services at two ICE Locations, Washington, DC and Bethlehem, PA. For the Washington DC office, the contractor services include fingerprinting, passport, photo processing, and manning a Personal Identification Verification (PIV) card issuance helpdesk from 8am – 5pm EST that provides technical support and training to federally manned satellite PIV Card Issuing Facility (PCIF) offices across the Continental United States (U.S.) as well as 60 international locations.

For the Bethlehem, PA office the contractor provides ICE Badge and Credential Issuance Services which supports ICE locations and associated personnel located throughout the nation as well as internationally.

These services are required for ICE to maintain compliance with Homeland Security Presidential Directive-12 (HSPD-12).

The period of performance will remain unchanged at 6/1/2021 – 5/31/2022.

4. Authority and supporting rationale and a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.

FAR 8.405-6(a)(1)(i)(B) Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized.

Global Resource Solutions (GRS) is uniquely qualified to continue providing these services to DHS on an uninterrupted basis at the high level of quality required. Awarding to an alternate source at this time would result in a lapse in services due to the time needed to identify a qualified vendor, clearing the contractor personnel through OPR Security for fitness determination (typically 60-90 days) and providing the requisite training/transition plan. Additionally, the incumbent vendor has demonstrated the ability/capability throughout the duration of this effort to meet the ICE requirements as described by the Performance Work Statement (PWS) and is prepared to continue these services without delays which helps ensure DHS can meet its’ mission critical objectives to protect the homeland.

An unfunded surge and travel CLIN were added to this requirement at the time of award for situations in which there is an unexpected surge due to some unforeseen event. These unfunded CLINs were added to the base and all four option periods. The recent surge is due to the award of a strategically sourced vehicle that requires credentialed investigators for all of DHS. To compete the requirement would delay the credentialing of investigators and result in a delay in performing background investigations for all DHS employees and contractors.

5. Determination by the ordering activity contracting officer that the anticipated order represents the best value consistent with FAR 8.404(d).

The Contracting Officer (CO) has determined that issuing a modification to Task Order no.

$666,770.46 (overall)/ $175,000.00 (current modification) represents the best value and will result in the lowest overall cost, considering price and administrative costs, to meet the Government’s needs. The current rates in the Task Order will be utilized for this contract modification and the rates were already determined to be ‘fair and reasonable’. In addition, this modification will be placed in accordance with FAR 8.404-Use of Federal Supply Schedules and the U.S. General Services Administration (GSA) has already determined the pricing of GSA schedule contracts to be fair and reasonable.

A breakdown of the $175,000.00 added as a result of this modification is listed below:

Item Number Item Description

Unit of

Issue QTY Unit Price Price Total Price

Project Manager/HSPD-12 Lead ea

PIV Card Enrollment/Sponsor Official ea

HSPD-12 Help Desk/Customer Support ea

Badge & Credential Clerk (CBI Support) ea

Travel for Assessments/ Training (NTE) ea

Supplies/Services Subtotal: $ 174,976.67

6. A description of the market research conducted among schedule holders and the results, or a statement of the reason market research was not conducted.

Market research indicates that there are several Federal Supply Schedule vendors who can perform these services. The rates being offered by GRS are comparable to other GSA vendors and discounted off their GSA Schedule rates.

7. Any other facts supporting the limited-sources justification. Additional facts may be stated in this section. If there are no additional facts, you must state that here.

The additional funding must be added to Task Order no. HSCEMR-17-F-00039 in order to fund the surge support and travel CLINs. Both CLINs were included in the original award

Page 1 of 5 Version 2.0 with no associated award value. Surge support for this modification includes travel from Bethlehem, PA to Washington DC, credentials for 4,000 new contract background investigators (CBI) and the relocation of ICE Badge and Credential Issuance Services from Bethlehem, PA to Washington DC. The CBI effort is in direct support of the DHS mission and recently awarded BPA for background investigations to be conducted across the department.

8. A statement of actions, if any, the agency may take to remove or overcome any barriers that led to restricted consideration (i.e., limited-sources) before any subsequent acquisition for the supplies or services is made.

ICE plans to award a follow-on task order for ICE Badge and Credential Issuance Services within the next year.

9. DHS intends to post this requirement on Fedbizopps pursuant to FAR 8.405-6(a)(2).
