OFFICE OF ACQUISITION MANAGEMENT
ICE Acquisition Manual 3006.301-90
JUSTIFICATION FOR EXCEPTION TO FAIR OPPORTUNITY
EXCEEDING MICRO-PURCHASE THRESHOLD AND UP TO SAT
J&A-21-0078
1. Agency and Contracting Activity.
Identification of the agency and the contracting activity, and specific identification of the document as a “Justification of an Exception to Fair Opportunity.”
The Department of Homeland Security, U.S. Immigration and Customs Enforcement, Office of Acquisition Management, prepared this justification for an exception to fair opportunity on behalf of HSI-INTEL-TIP LINE.
2. Nature and/or description of the item/service being procured and anticipated cost:
(a) Type of action: Bridge Contract
(b) Amount the current J&A is justifying: $137,460.40
(c) Brief Description: OAQ intends to award a one-month bridge contract to our current awardee for call center services. We are in the process of awarding a new contract and need this time to properly evaluate proposals received on the current solicitation and allow for a seamless and efficient transition to the new awardee. The vendor is listed below.
Integral Consulting Services, Inc.
2101 Gaither Road, Suite 410 Rockville, MD 20850
3. Statutory exception and rationale for its use:
Exception:
☐ FAR 16.505(b)(2)(i)(A). The agency need for the supplies or services is so urgent that providing a fair opportunity would result in unacceptable delays.
☐ FAR 16.505(b)(2)(i)(B). Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized. [Explain why supplies or services are unique].
☒ FAR 16.505(b)(2)(i)(C). The order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order. [For logical follow-on, the rationale shall describe why the relationship between the initial order and the follow-on is logical (e.g., in terms of scope, period of performance, or value)]:

JUSTIFICATION FOR EXCEPTION TO FAIR OPPORTUNITY
EXCEEDING MICRO-PURCHASE THRESHOLD AND UP TO SAT
☐ FAR 16.505(b)(2)(i)(D). It is necessary to place an order to satisfy a minimum guarantee.
Rationale:
ICE/OAQ intends to procure 30 days of call center support services. Pursuant to 41 U.S.C.
4106(c)(1) as implemented by FAR 16.505(b)(2)(i)(C): The order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order.
The current call center support services are being provided by Integral Consulting Services on task order GS00Q14OADS145 70CMSD18FR0000232. A competitive order issued off OASIS SB Pool 1. The current task order ends 3/27/2021.
A new Task Order for these services is currently in the evaluation stage. The evaluation team is working diligently to get the technical evaluations done as soon as possible, however there is not sufficient time to get them completed and an award issued prior to the current task orders end date of March 27, 2021. The required support tasks align with the services that Integral is currently providing. Issuing this sole source task order to keep this contractor in place will maintain the mission critical tip line without compromising services or having any disruptions to the current critical tip line needed by HSI agents.
In the interest of economy and efficiency Integral Consulting is able to continue providing these services to Tip Line on an uninterrupted basis and to allow for a smooth transition to the new contractor. Integral is currently performing these services on 70CMSD18FR0000232 which are equal to the scope of work that is required for this 30-day requirement. As such, it is in the best interest of the Government to continue receiving call center support services from Integral until the current solicitation is properly evaluated and a new competitive award is made.
