About this file

This is a Notice to Bidders and Special Provisions document issued by the California Department of Transportation (Caltrans) District 03 for construction work on State Highway 5 in Sacramento County near Thornton. The project involves constructing acceleration lanes from Lost Slough Bridge to Dierssen Road Overcrossing (Post Mile 1.2/3.1) under Contract No. 03-4J9004, a federal-aid project designated as HSIM-0056(363). The work encompasses 74 bid items including earthwork, erosion control, asphalt concrete paving, traffic control systems, electrical systems, signage, pavement markings, and temporary construction elements. Bidders must submit electronically sealed bids by 2:00 p.m. on Tuesday, August 25, 2026, with work to be completed within a bid range of 65 to 90 working days on a cost-plus-time basis. The project requires either a Class A contractor license or a Class C-12 license constituting the majority of work, and an estimated project cost of $5,400,000 is provided for reference.

Bidders must submit security equal to at least 10 percent of their bid amount. Prevailing wages are required, and contractors must comply with both California Department of Industrial Relations wage rates and federal minimum wage determinations, applying whichever rate is higher. The contract includes extensive special provisions addressing traffic control during construction, with detailed lane closure restrictions by day and time for both mainline freeway and ramp operations. Key requirements include maintaining at least one through lane open in each direction, implementing portable radar speed feedback sign systems, and complying with construction work zone speed limit reductions. Additional compliance mandates cover Buy America requirements for manufactured products and construction materials, environmental product declarations for hot mix asphalt and concrete, stormwater pollution prevention, local material testing and certification, treated wood waste management, and professional project partnering. Liquidated damages are assessed for failure to open scheduled closures, limited to 5 percent of the total bid per occurrence, with damages calculated at $1,531 to $3,062 per 10-minute interval depending on facility type and time period.

6-1.04F Buy America Waiver for the De Minimis Costs for Manufactured Products and Construction Materials

A De Minimis Costs waiver can waive the application of FHWA's Buy America requirements for manufactured products and construction materials under a single project when the total cost of non-compliant manufactured products and construction materials is no more than the lesser of $1,000,000 or 5 percent of the total applicable costs for the project.

The percentage threshold is calculated based on the following formula:

X = NC / TA

where:

X = percent threshold NC = total cost of non-compliant construction materials and manufactured products

TA = total applicable project costs (steel, iron, construction materials and manufactured products;

does not include excluded materials)

This threshold is based on the actual cost of the steel, iron, construction materials, and manufactured products, not the anticipated cost of those materials. The contractor must account for compliant and non-compliant Department-Furnished Materials for the project in the De Minimis Costs Waiver Worksheet calculation if provided by the Department as supplemental project information.
