About this file
This is a Confidential Treatment Form from the State of Michigan related to RFP 26-2108 for Financial Examination Services Pre-Qualification. The form is a mandatory document that must be submitted with all proposals, regardless of whether the bidder requests confidential treatment of proposal materials. Bidders must complete either Section 1, confirming that no confidential treatment is requested, or Section 2, formally requesting confidential treatment of specific materials. The form must be signed by the same individual who signed the bidder's proposal; failure to submit a completed and properly executed form will result in rejection of the proposal as non-responsive, and improper completion may result in the entire proposal being publicly disclosed without redaction.
Section 2 of the form requires bidders requesting confidential treatment to specifically identify protected materials by proposal page number, section number, and paragraph number, and to classify information as Trade Secret (TS), Proprietary Financial Information (FI), or Proprietary Information (PI). Bidders must provide detailed legal justifications citing applicable Freedom of Information Act (FOIA) exemptions under Michigan law, explain how materials qualify for protection, and designate an authorized contact person for State inquiries. Bidders may not request confidential treatment for resumes, pricing, or marketing materials. All bidders submitting Section 2 must also provide a redacted "Public Copy" of the proposal with confidential materials clearly removed. The State of Michigan reserves final authority to determine whether designated materials are actually exempt from FOIA disclosure and is not obligated to notify bidders of FOIA requests or public disclosure decisions.
