STATEMENT OF WORK
ADVISOR CONSULTANT - ENVIRONMENTAL AND SOCIAL PERFORMANCE TO SUPPORT COMPACT DEVELOPMENT TEAM– INDONESIA II COMPACT
A. Introduction
The Millennium Challenge Corporation (MCC) is a U.S. Government corporation whose mission is to provide assistance that will support economic growth and poverty reduction in carefully selected countries that demonstrate a commitment to just and democratic governance, economic freedom, and investments in their citizenry. For more information on the MCC, please visit www.mcc.gov.
MCC has been working in Indonesia since 2006, helping to improve governance, fight corruption and enhance public health through the MCC Threshold program. This program, which concluded in December 2010, was designed to strengthen key anti-corruption institutions and to create a more efficient and sustainable immunization surveillance system.
MCC’s first, $600 million compact with Indonesia was signed in November 2011. The compact was designed to reduce poverty through economic growth by supporting three of the Government of Indonesia’s (GOI) growth and development priorities: better health and nutrition, procurement modernization, and sustainable energy and resource management. The compact included three projects in these priority areas, and was designed and implemented with a focus on community ownership and innovative, scalable models that would allow for emerging opportunities. The 2011 Indonesia Compact successfully concluded on April 2, 2018. Against this backdrop, on December 11, 2018, MCC’s Board of Directors selected Indonesia as eligible to develop a second compact program.
Despite challenges, MCC and the GOI have achieved many successful outcomes through our partnership and will incorporate key lessons learned from the 2011 Indonesia Compact into the design of the new compact program. For example, learning from the first compact program – which was both geographically and sectorally diverse – MCC and the GOI plan to develop a more focused second compact in order to streamline implementation and ensure greatest impact.
Beginning with the preliminary analysis phase of compact development, MCC and the GOI, primarily represented by the Compact Development Team (CDT) currently operating under the National Planning Bureau (BAPPENAS), continue to work together to consider geographic and sectoral areas of focus that can then facilitate a more efficient process of stakeholder engagement and a more effective project development and due diligence phase.
MCC recognizes that the pursuit of sustainable economic growth and a healthy environment are related. Economic growth that doesn’t adequately address the associated risks related to environmental management can leave the poor particularly vulnerable. MCC’s Environmental and Social Performance (ESP) Practice Group will work with the GOI trough the CDT to integrate internationally-accepted principles of environmental and social performance into the design and implementation of MCC funded programs in an effort to minimize environmental and social risks and enhance environmental and social benefits.
B. Countries
Indonesia and other eligible MCC countries
C. Scope and Objectives
MCC seeks an Environmental and Social Performance Advisor (Advisor) to advise the CDT, based in Jakarta, on ESP impacts, risks and opportunities associated with activities that are under development or implementation in Indonesia. The Advisor will assist the CDT’s efforts to integrate recommendations from MCC optimizing environmental and social performance into the design and implementation of MCC funded programs specifically through the elaboration and use of Environmental and Social Management Systems (ESMS) and integration of best management practices into research methods and analysis.
D. Tasks
The Advisor shall assist the CDT’s efforts to support the design and implementation of activities in various sectors, potentially including (but not necessarily limited to):
· Water/Sanitation
· Logistics/Transportation
· Natural Resource Management
· Institutional Reform
More specifically, the Advisor shall:
1. Coordinate with MCC ESP to identify major environmental and social risks and opportunities associated with investments being considered by MCC and work within the CDT to propose mitigation measures for any negative impacts identified and recommendations for site selection, enhancing project design and/or benefit streams from an environmental and social perspective;
2. Assist the CDT in the production and/or technical reviews of project-related documents including concept papers, feasibility studies, environmental and social impact assessments and management plans, consultant terms of reference, construction bidding documents, work plans, and performance monitoring plans to ensure compliance with the International Finance Corporation’s Performance Standards on Environmental and Social Sustainability;
3. Assist the CDT in the development of, or reviewing, Terms of References for specific sector activities;
4. Provide the CDT with appropriate guidance, tools, and assistance to help strengthen institutional capacity and policies to integrate internationally accepted principles of environmental and social sustainability into the design and implementation of MCC-funded projects; and
5. Maintain a productive, collaborative working relationship with key GOI actors, sector representatives, donors, donors’ consultants, MCC and MCC’s consultants.
Other Technical Assistance
From time to time, and as required, the Consultant may be required by the MCC COR or PM to provide other advice and counsel to either MCC or the CDT. This may include but is not limited to:
1. Review of proposal evaluation reports from technical panels and procurement agents;
2. Review of proposed implementing entity agreements and cooperation agreements between government entities;
3. Travel within Indonesia;
4. Assist the CDT in reviewing qualifications of key technical staff in Indonesia prior to their engagement; and
5. Undertake missions to project sites, as required by the CDT and MCC, and provide review of project risks and recommend corrective and/or mitigation measures to assure environmental and social performance that complies with MCC’s Environmental Guidelines.
The Consultant would be precluded from bidding on work and services (design, assessment, program implementation) to be procured by Indonesia’s Compact program management entity or using funds advanced under a Compact or Threshold Program in the country where services are being provided to MCC. The designated Consultant would be expected to work onsite with the CDT in Jakarta and to coordinate with local authorities responsible for MCC Compact implementation as well as other donors, where relevant. However, the designated Consultant would report directly to the designated COR/PM.
E. Deliverables
The Consultant shall provide services to MCC on an as needed basis. To support MCC in the flexible and timely manner needed to meet the evolving needs of Compact development and implementation, technical directives under this statement of work will be issued and the Consultant deployed each time the Consultant’s services are needed over the course of this contract. No additional tasks shall imply any additional costs to the Government beyond the amount allowed for in the initial call order; however, this call order may be amended to reflect additional costs associated with implementation planning and oversight requirements in additional countries. In terms of written deliverables, the following are required:
Deliverable 1: Trip reports, ad hoc reports or information as may be requested by the COR/PM.
Deliverable 2: Final report, including comments by MCC, due as per agreement.
F. Period of Performance
All work under this contract will be completed between effective date of the contract award through a one-year base period. MCC may extend the contract for up to four (4) additional years, depending on MCC continued requirement, consultant’s performance and MCC’s satisfaction (see Clauses “Increase in Services”, “Increase in Services/Option CLIN”, and Option to Extend the Term of the Contract”). MCC anticipates this level of effort but does not guarantee this level of effort as it may increase or decrease.
G. Performance Location
Consultant shall be based in Indonesia and shall perform the tasks under this contract entirely in Indonesia, largely on site with the CDT in Jakarta.

The COR will have technical responsibility for monitoring the contractor’s performance and will review and evaluate the contractor’s performance.
Any changes in the terms of the SoW will be made in writing and approved by the Contracting Officer. No representation of the COR/PM shall serve as a basis for an alteration in the general scope of this SoW or of the terms and conditions of the SoW unless confirmed in writing by the Contracting Officer. The contractor must communicate with the Contracting Officer on all matters that pertain to the Contract terms. Proceeding with the work without proper contractual coverage could result in nonpayment for that work.
