DEPARTMENT OF THE NAVY

NAVAL SURFACE WARFARE CENTER

CORONA DIVISION

PO BOX 5000

CORONA, CA 92878-5000

IN REPLY REFER TO

J&A No. 50,183 Ser 02/3030

JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity

The Naval Sea Systems Command (NAVSEA), Naval Surface Warfare Center, Corona Division (Corona Division), Contracts Department, Code 02.

2. Description of the Action Being Approved

Award of a Firm-Fixed-Priced Contract on a brand name basis for the purchase of One Network Enterprises (ONE), Inc. proprietary software configuration support. Authority to act under this Justification and Approval (J&A) shall be effective from the date of approval to the end of the contract term.

The acquisition is being conducted under the authority of the Multiple Award Schedule Program, Federal Acquisition Regulation (FAR) 8.401. Approval of this Justification will authorize a limited source procurement of supplies and/or services described in paragraph 3. The procedures in FAR subpart 13.5 will be utilized for this procurement in accordance with 41 U.S.C. 1901.

3. Description of Supplies/Services

Corona Division, Range Systems Engineering Department (RS40) has a requirement to continue the utilization of software and system experts to perform system software configuration on ONE, Inc.

software. This software is used on the United States Air Force (USAF) Theater Integrated Combat Munitions System (TICMS) platform and table structures and the services are required for continued configuration of the TICMS software suite. The following table provides the estimated value of the procurement.

FY20 FY21 FY22 Total

O&MAF

The total estimated cost of the proposed procurement is $ and will be funded with Air Force Operations and Maintenance funding for the base and option years.

The Government’s needs have been verified by the certifying technical and requirements personnel.

4. Statutory Authority Permitting Other Than Full and Open Competition

10 U.S.C. 2304(C) (1) Only one responsible source or a limited number of sources, no other supplies or services will satisfy agency requirements as implemented by FAR 8.405-6 (b) (1).

5. Rationale Justifying Use of Cited Statutory Authority

ONE, Inc. proprietary software and system experts are essential to the continued use of the TICMS munitions Accountable Property System of Record (APSR) record system application. As ONE, Inc.

is the owner of the proprietary software and subsequent configuration authority, their expertise is required to configure the software, while tracking the rapidly changing technology environment by leveraging their in-house capability.

The Government has identified two (2) vendors, who are authorized to provide ONE, Inc. software and system experts via NASA SEWP MAS. Without this expertise, the Government will be unable to continue the use of ONE, Inc. software, which will result in a waste of approximately $ M and -months of effort.

Additionally, software reconfiguration by system experts will protect the system’s internal security aspects and ensure the USAF conventional munitions stockpile remains accurately accounted for, while simultaneously shielding total quantities worldwide at over locations from any unauthorized entities.

The Government developed the TICMS APSR around the use of this proprietary software and system deployed by ONE Inc., investing and -months in the process. The cost of the values listed below is the compiled totals of all previous contracting actions for the TICMS application effort:

USAF Contract for Phase 1: FA8772-18-F-0019 for $935K USAF Contract for Phase 2A: FA8772-18-F-0030 for $2.9M USAF Contract for Phase 2B: FA8772-19-F-0002 for $6.5M USAF Contract for Phase 2C: FA8772-19-F-0027 for $4.4M USAF & USN Contract for Software Licenses: N6426720F0002 for $36.8M

Should TICMS have to change to a new software, due to the lack of software and system experts to support it, it would negate the work completed over the past months. The legacy system, Combat Ammunition System (CAS), has been decommissioned and no longer meets cyber-security or APSR requirements. The cost of the delay would not be recovered by competition. More importantly, the USAF’s forward components at over locations worldwide will be significantly hampered by the removal of the non-supported APSR, while a new system is deployed.

Additionally, the USAF Munition enterprise, encompassing in conventional munitions inventory would be left without a congressionally mandated APSR. The current TICMS application is the ONLY application the USAF uses to support over users at munitions locations worldwide. Failure to sustain and support this application will result in mission failure

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

A Sources Sought Notice (SSN) was posted on the Contract Opportunities (beta.SAM) website, indicating the Government’s intent of a Brand Name is requirement of One, Inc. The posting was issued on 13 July 2020 to 30 July 2020. There were no responses to the SSN.

7. Determination of Fair and Reasonable Costs

The Contracting Officer has determined that the anticipated costs to the Government for the items covered by this J&A will be fair and reasonable. Significant (or similar) quantities of this requirement have been purchased in the past and cost/pricing information was received on those past procurements. This information should be sufficient to support the fair and reasonable cost determination of this procurement.

8. Actions to Remove Barriers to Competition

For the reasons set forth in Paragraph 5, Corona Division, Contracts Department, Code 02 has no plans at this time to compete future contracts for the types of items covered by this document. If another potential source emerges, Code 02 will assess whether competition for future requirements is feasible.
