CLAUSES INCORPORATED BY FULL TEXT 52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014) (a) The Government intends to award a Firm Fixed Priced contract to a single contractor. The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: Technical Capability, Price and Past Performance. Award will be made to the Lowest Price Technically Acceptable offer. •1. Technical Capability: (10 Page limit, not smaller than 12 point font, size 8.5 X 11 page) - The Government shall evaluate the offeror's technical proposal on an Acceptable/Unacceptable basis. The proposal will be evaluated based on the offeror's ability to meet the requirements and responsibilities for the position provided in the PWS. Provide a brief description of how the Offeror will accomplish the requirements of the PWS, with special attention provided to the tasks to be performed listed under section 5. The proposal should not simply repase or restate the Government's requirements, but rather shall provide convincing rationale to address how the offeror intends to meet these requirements. Offerors shall assume that the Government has no prior knowledge of their experience, and will base its evaluation on the information presented in the offeror's proposal. •2. Price: No Page limit - Award will be made to the offeror that proposes the lowest price and is determined to be technically acceptable. The offeror agrees to hold the prices in its offer firm for 120 calendar days from the date specified for receipt of offers. a. This criterion evaluates the overall price to determine if the proposed price is fair and reasonable. The Government may determine an offer unacceptable if the proposed prices are materially unbalanced which is defined as significantly understated or overstated in relation to the actual cost of that work or when the price is determined not to be fair and reasonable. •b. Certified cost or pricing data is not anticipated for the award of this contract since adequate competition is anticipated; however, the Government reserves the right to request such information should it become necessary, consistent with Federal Acquisition Regulation (FAR) Subpart 15.4, Contract Pricing. Only CLIN level pricing information is required; however, if reasonableness can't be established based on price analysis, then other than certified cost and pricing data may be required.c. Ratings: Price proposals will be evaluated, but not rated. •B. Past Performance: Past Performance will be evaluated based on information obtained using internal systems. Offerors are not required to submit Past Performance information. The Government will use information obtained using other sources, such as the Past Performance Information Retrieval System (PPIRS) or similar systems. The offeror will either be deemed acceptable or non-acceptable in this area. Any offeror which has no relevant Past Performance will be deemed acceptable.(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). The government will also evaluate its option to extend services (see FAR Clause 52.217-8) by adding six (6) months of the offeror's final price to the offeror's total price. Offerors shall not submit a price for the potential six month extension of services period. Evaluation of the six month extension period shall not obligate the Government to exercise the option to extend services. (c) It is the Government's intention to award without discussions. Offerors are encouraged to present their best technical capability proposal and prices in their initial proposal submission. However, in accordance with (IAW) FAR Part 15.306, should discussions become necessary, the Government reserves the right to hold them. (d) If an offeror believes that the requirements in these instructions contain an error, an ambiguity, omission, or are otherwise unsound, the offeror shall immediately notify the contracting officer in writing with supporting rationale. The offeror is reminded that the Government reserves the right to award this effort based on the initial proposal, as received, without discussions. (e) The Offer. The submission of the documentation identified within this section will constitute the offeror's acceptance of the terms and conditions of the Request for Proposal (RFP) and its amendments, concurrence with the Performance Work Statement (PWS), and the proposed contract type. (f) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. (g) Debriefings. Upon notification, unsuccessful offerors may request and receive a debriefing. Offerors desiring debriefing must make their request in accordance with the requirements of FAR 15.505 or 15.506, as applicable.
