This contract was awarded as other than firm fixed price. It was awarded as a time and materials type contract.
1. The proposed procurement calls for technical assistance services as required by the Employment and Training Administration. These services will be provided to the Office of National Response in support of the Rapid Response Initiative.
2. FAR Subpart 16.6 indicates that a time and materials contract is only appropriate when it is not possible at the time of placing the contract to estimate the extent or duration of the work, or to anticipate costs with any reasonable degree of confidence. At the time of award, neither the Program Office nor the Contracting officer can determine the amount of support required with any reasonable degree of confidence.
3. A determination was be made prior to award, that the proposed contractors accounting system was adequate for the determination of costs applicable to the proposed contract and the solicitation makes provisions for maintenance of adequate records and controls, including appropriate surveillance by Government personnel during the performance as to reasonably assure that inefficient or wasteful methods will not be used.
Determinations
1. In accordance with FAR 16.301-3(b), this is not a cost-reimbursement contract for the acquisition of commercial items.
2. It is impracticable to secure services of the kind or quality required, without the use of the proposed contract type.
3. The celing price of the proposed contract is $899,526.75. Which includes technical assistance for the period of April 22, 2010 through April 21, 2011.

The Department of Labor, Employment & Training Administration (DOL/ETA) intends to award a contract on a sole source basis in accordance with FAR Part 19.1406, Sole source awards to service-disabled veteran-owned small business concerns, to a Service-Disabled Veteran-owned Small Business (SDVOSB). The contractor will provide technical assistance and training in support of the National Rapid Response Initiative to aid the public workforce development system on the Federal, state and local level. Specifically, the contractor will provide logistical and meeting planning support, technical assistance tools training development and online community support.
ETA conducted market research to identify contractors capable of performing the requirement. ETAs market research revealed QualX was the sole SDVOSB capable of performing the requirement. In accordance with FAR Part 19.1406, DOL intends to award a contract to QualX. The North American Industry Classification System (NIACS) Code is 541611, with a $7 million size standard. The period of performance for the contract will be twelve (12) months from the date of contract execution.
PLEASE NOTE. THIS CONTRACT IS BEING FUNDED IN WHOLE WITH RECOVERY ACT FUNDS. WHEN THE SPECIAL PRE-AWARD NOTICE FOR THIS ACTION WAS POSTED, IT WAS MISTAKENLY NOT IDENTIFIED AS A RECOVERY ACTION.
