Added: May 17, 2016 3:08 pm The U.S. EPA intends to negotiate on a sole source basis, under the authority of FAR 13.106-1(b)(1), with PANalytical, Inc. for the annual maintenance service of the PANalytical X-pert PRO MPD Diffactometer - serial number DY3041.



EPA has identified PANalytical as the only contractor able to meet the requirements of this procurement. The EPA's Office of Research and Development (ORD), National Risk Management Research Laboratory (NRMRL) at AWBERC, 26 West Martin Luther King Dr., Cincinnati, OH 45268 utilizes the PANalytical X-pert PRO MPD Diffractometer on a continuous basis for research projects vital to NRMRL's mission. It is important to not have extended times when this instrument is not functioning. Therefore, a maintenance agreement for routine maintenance and maximum 72 hour replacement of parts will be contracted with PANalytical.



PANalytical is the sole manufacturer and distributor of this instrumentation as well as the parts and products to support the equipment. This company possesses the unique capabilities of providing preventative maintenance and repair services. PANalytical, as the manufacturer of the instrumentation, has the capability and accessibility to the engineering and electronic specifications to ensure accurate operation of the products. The contractor shall supply installation CDs containing software updates as they occur and the upgrades shall be installed by contractor trained service engineers.



This procurement will be accomplished under FAR Part 12 Commercial Procedures. It is our intent to award a single fixed price purchase order consisting of one (1) 12-month base period and two (2) 12-month option periods for a potential term of 36 months. Interested firms may identify their interest and capability to respond to the requirement. THIS NOTICE OF INTENT IS NOT A REQUEST FOR COMPETATIVE QUOTATIONS. A determination by the Government not to compete this acquisition based upon responses to this notice is solely within the discretion of the Government.
