FAR Provision 52.212-2, Evaluation -- Commercial Items (Jan 99), applies to this acquisition and the following evaluation is applicable: 


(a) The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: Offerors ability to comply with all aspects of the Performance Work Statement (PWS).


Technical and past performance, when combined, shall be evaluated based non-cost evaluation factors such as past performance, compliance with solicitation requirements, technical excellence, management capability, personnel qualifications, and prior experience, when compared to price.


 (b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).


(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(a) The Contractor shall not require employees or subcontractors seeking to report fraud, waste, or abuse to sign or comply with internal confidentiality agreements or statements


prohibiting or otherwise restricting such employees or contactors from lawfully reporting such waste, fraud, or abuse to a designated investigative or law enforcement representative


of a Federal department or agency authorized to receive such information.


(b) The Contractor shall notify employees that the prohibitions and restrictions of any internal confidentiality agreements covered by this clause are no longer in effect.


(c) The prohibition in paragraph (a) of this clause does not contravene requirements applicable to Standard Form 312, Form 4414, or any other form issued by a Federal department or agency


governing the nondisclosure of classified information.

    (a) In accordance with sections 7 44 and 7 45 of Division E, Title VII. of the


Consolidated and Further Continuing Appropriations Act, 2015 (Pub. L. 113-235 ). none of the funds made available by this or any other Act may be used to enter into a contract


with any corporation that-


        (1) Has any unpaid Federal tax liability that has been assessed, for which all


judicial and administrative remedies have been exhausted or have lapsed, and that is


not being paid in a timely manner pursuant to an agreement with the authority


responsible for collecting the tax liability, where the awarding agency is aware of the


unpaid tax liability, unless the agency has considered suspension or debarment of the


corporation and made a determination that this further action is not necessary to


protect the interests of the Government; or


        (2) Was convicted of a felony criminal violation under any Federal law within

DFARS Provision 252.209-7992, Representation by corporations regarding an unpaid delinquent tax liability or a Felony Conviction under any federal law-fiscal year 2015 appropriations (Dev 2015-OO0005)(Dec 2014)


 


    (a) In accordance with sections 7 44 and 7 45 of Division E, Title VII. of the


Consolidated and Further Continuing Appropriations Act, 2015 (Pub. L. 113-235 ). none of the funds made available by this or any other Act may be used to enter into a contract


with any corporation that-


        (1) Has any unpaid Federal tax liability that has been assessed, for which all


judicial and administrative remedies have been exhausted or have lapsed, and that is


not being paid in a timely manner pursuant to an agreement with the authority


responsible for collecting the tax liability, where the awarding agency is aware of the


unpaid tax liability, unless the agency has considered suspension or debarment of the


corporation and made a determination that this further action is not necessary to


protect the interests of the Government; or


        (2) Was convicted of a felony criminal violation under any Federal law within


the preceding 24 months, where the awarding agency is aware of the conviction, unless


the agency has considered suspension or debarment of the corporation and made a


determination that this action is not necessary to protect the interests of the


Government.


    (b) The Offeror represents that-

FAR clause at 52.212-4, Contract Terms and Conditions -- Commercial Items (May 2014), applies to this acquisition with the following Addendum:  Paragraph (c) of this clause is tailored as follows: Changes in the terms and conditions of this contract may be made only by written agreement of the parties with the exception of administrative changes, such as changes in the paying office, appropriations data, etc., which may be changed unilaterally by the Government.

The Request for Quotation (RFQ) number is FA2521-15-Q-B031 shall be used to reference any written responses to this source sought. 


Patrick Air Force Base anticipates a requirement that is being considered under a small business set-aside program.  The North American Industry Classification Systems (NAICS) Code proposed 562211.  The size standard for NAICS  is $12.5M.   


The requirement is to establish a contract for medical waste removal/disposal. Contractor shall provide regulated waste transportation, sterilization, and disposal IAW Performance Work Statement  (PWS). Approximately 550 boxes/year to be disposed. Contractor shall invoice monthly for partial quantities, not to exceed 550 boxes/year.


PWS is attached.


What is the purpose of the requirement:  To remove & dispose of medical waste from Patrick AFB on a monthly basis.


45 CONS is interested in any size business that is capable of meeting this requirement.


The government is also interested in all small businesses including (8(a), Historically Underutilized Business Zone, Service Disabled Veteran Owned Small Businesses (SDVOSB), or, if applicable based on NAICS code, Economically disadvantaged women-owned small business (EDWOSB) Women Owned Small Businesses (WOSB) that are interested in performing this requirement.   The government requests interested parties submit a brief description of their company's business size (i.e. annual revenues and employee size), business status (i.e., 8(a), Historically Underutilized Business Zone, or SDVOSB, WOSB, EDWOSB, or small business) anticipated teaming arrangements, and a description of similar services offered to the Government and to commercial customers.  


Any responses involving teaming agreements should delineate between the work that will be accomplished by the prime and the work accomplished by the teaming partners.  The Government will use this information in determining its small business set-aside decision." 


As stipulated in FAR 15.201, responses to this notice are not considered offers and cannot be accepted by the Government to form a binding contract. No solicitation exists; therefore, do not request a copy of the solicitation. The decision to solicit for a contract shall be solely within the Government's discretion. 


Any information submitted by respondents to this sources sought synopsis is voluntary. This sources sought notice is not to be construed as a commitment by the Government, nor will the Government reimburse any costs associated with the submission of information in response to this notice. Respondents will not be individually notified of the results of any government assessments. The Government's evaluation of the capability statements received will factor into whether any forthcoming solicitation will be conducted as a full and open competition or as a set-aside for small businesses, or any particular small business designation (e.g. SDVOSB, HUBZone, 8(a), WOSB, VOSB, etc.).


All interested firms should submit a capabilities package that outlines the firm's capabilities in providing the required services.  Contractor is required to provide all management and labor required for the operation and management of the required services.  Include three past references with current contact information and contract number.  If subcontracts are to be used, provide anticipated percentage of effort to be subcontracted and whether small or large businesses will be used.  The capabilities package should be brief and concise, yet clearly demonstrate an ability to meet the stated requirements.  Recent, relevant experience in all areas should be provided.  Teaming and/or subcontracting arrangements should be clearly delineated and previous experience in teaming must be provided.  The response must not exceed 5 pages. 


Include in your capabilities package your DUNS, Cage Code, and System for Award Management expiration date., GSA Contract Number with expiration date and MAS (if applicable), and specifications/drawings regarding item(s).
