1. This request for justification and approval for other than full and open competition is to bridge the gap between the end of the existing contract for base support services, W912L7-17-C-0004, and the issuance of a new, long term contract for these services. The new contract is not yet awarded due to pending review by the National Guard Bureau (NGB). The service requirement provides non-personal base support services for the Construction and Facilities Management Office (CFMO) of the Tennessee Army National Guard (TNARNG).
2. This approval is for a new firm fixed priced contract using operational and maintenance funds.
3. Estimated Value: Is on file at this office and can be obtained through Freedom of Information Act Procedures.
4. Statutory Authority: the Federal Acquisition Regulation (FAR) 6.302-1(a)(2)(iii)(A): Substantial duplication of cost to the Government that is not expected to be recovered through competition.
5. This is a follow-on acquisition to the current contract that expires on 28 February 2018 until a new contract is in place. This requirement was synopsized on 28 March 2017 but has not been advertised on fbo.gov yet due to the pending pre-award review for the new contract. The Tennessee Army National Guard (TNARNG) must do a bridge contract to fulfill the agency needs while waiting for the completion of pre-award review by the National Guard Bureau (NGB). Staffing One Inc. is the only known contractor capable of providing uninterrupted service while the TNARNG awaits a decision from NGB.
6. The TNARNG completed market research for the new contract that is pending pre-award review by NGB. The TNARNG posted a sources sought for the pending contract on 4 April 2017; five companies responded. Of the five companies who responded, the Government does not feel any of them would be capable of providing a short-term contract without some type of interruption in service. The Government feels Staffing One Inc. is the only contractor capable of providing a seamless bridge contract.
7. There are no other facts to support the use of other than full and open competition.
8. No actions to remove barriers to competition will be taken, as the new contract under
NGB review will be solicited and advertised using full and open competition on fbo.gov.
