Question # References Contractor Questions Government Response

RFP/Page 26; AD0005_DD254

Section 4.4 of the PWS states that the contractor shall possess a SECRET facility clearance from the DSS. However, Attachment AD0005 states “Confidential.” Please confirm a SECRET facility clearance is required and that an amended DD254 will be provided. The SECRET facility clearance requirement was removed from the soliciation.

RFP/Page 28 para 5.2.7.2 and page 40 Para 7.1 Performance Requirements Summary table

5.2.7.2 states the minimum basic unit load required is 90 rounds of ammunition for a rifle and 30 rounds for a pistol. The Performance Requirements Summary table states 150 are required per rifle and per pistol. Please confirm which requirement is correct.

Refer to Solicitation Amendment 0009 for the updated PWS paragraph 5.2.7.2, TABLE 3 ‐ AMMUNITION LOAD and updated Performance Requirements Summary for the required rounds of ammunition.

Attachment_1__‐_Pricing_Workbook

The formula in cell E10 of the "Base Period" sheet sums the cost of mobilization into the monthly CLIN 0002 total causing the "Contract Totals" sheet to reflect an incorrect base period amount.

Refer to the updated Attachment 1 ‐ Pricing Workbook provided in Amendment 0009.

Attachment_1__‐_Pricing_Workbook

The formula in cell E13 of the "Base Period" sheet should take the sum of E11 and E12 but appears to only capture the costs in cell E12. Refer to the updated Attachment 1 ‐ Pricing Workbook provided in Amendment 0009.

Attachment_1__‐_Pricing_Workbook

The formula in cell E13 of the "Contract Totals" sheet is not summing the cost of mobilization causing the "Contract Totals" sheet to reflect an incorrect base period amount. Refer to the updated Attachment 1 ‐ Pricing Workbook provided in Amendment 0009.

Overall

Are any of the requirements included in the PWS currently being performed by contractor personnel? If so, which ones? The current requirement is being performed in accordance with the Performance Work Statement under contract W91B4N‐16‐C‐5010.

Overall

If any of the requirements included in the PWS are currently being performed by contractors, which requirements are they and who are the incumbent contractors? The current requirement is being performed in accordance with the Performance Work Statement under contract W91B4N‐16‐C‐5010.

Overall FBO indicates that the solicitation number is W91B4N‐18‐T‐2011, however the documents indicate that it should be solicitation number W91B4N‐18‐Q‐2002. Please confirm the solicitation number.

Refer to the updated FBO posting under solicitation number W91B4N‐18‐Q‐2002, as the posted solicitation under number W91B4N‐18‐T‐2011 was an inadvertant error.

4.1.7., pg. 24 The second bullet states, “shall be a citizen of the United States,” while the third bullet states, “shall be a FVEY Expatriate with active Secret clearance including appropriate National Agency Check (NAC), National Agency Check with Local Agency Check and Credit Check (NACLAC) and other required background or security checks and/or inquiries.”

Please confirm whether the requirement is for U.S. or FVEY.

Refer to Solicitation Amendment 0009 for the updated PWS paragprah 4.1.7. ARMED SECURITY GUARD which states, "Shall be a FVEY Expatriate with active Secret clearance or Secret REL / NATO clearance including appropriate National Agency Check (NAC), National Agency Check with Local Agency Check and Credit Check (NACLAC) and other required background or security checks and/or inquiries in accordance with Table 1 ‐ TOTAL

MANNING REQUIREMENTS."

5.2.2.1 and 5.2.2.3, pg. 27 Section 5.2.2.1 of the RFP states, “Contractor shall fulfill the requirement for 414 personnel; it is also suggested that the contractor maintain enough personnel to mitigate manning shortfalls due to R&R, emergency leaves, and other unforeseen restrictions.”

Section 5.2.2.3 states that “Contractor is responsible for maintaining 100% manning to account for personnel on leave, in addition to sustaining 8‐hour shifts, with personnel working six (6) shifts on and one

(1) off. The total number of personnel under the contract, therefore, is anticipated to be approximately

414. This may be revised at the direction of either the COR or the Contracting Officer.”

Section 5.2.2.1 seems to indicate that 414 personnel does not account for R&R and other types of leave. Section 5.2.2.3 seems to indicate that 414 personnel is the anticipated number required for the contractor to maintain 100% coverage. Please confirm whether 414 personnel are expected to be sufficient to meet requirements including R&R and other types of leave.

Refer to Solicitation Amendment 0009 for the updated PWS paragraph 1.3 ‐ SCOPE OF WORK that states, "The PWS requires 329 personnel as identified Table 1..." This accounts for shift change, but does not account for R&R or other type of leave.

Refer to Solicitation Amendment 0009 for the updated PWS paragprah 5.2.2.1 that states, "Contractor shall fulfill the minimum requirement for 329 personnel (reference Table 1); it is also suggested that the contractor maintain enough personnel to mitigate manning shortfalls due to R&R, emergency leaves and other unforeseen restrictions."

Refer to Solicitation Amendment 0009 for the updated PWS paragprah 5.2.2.3 that states,"These are personnel who must be on duty in a given 24‐ hour period. Contractor is responsible for maintaining 100% manning to account for personnel on leave, in addition to sustaining three 8‐hour shifts, with personnel working six (6) shifts on and one (1) shift off. The contractor shall maintain a pool of qualified personnel to mitigate manning shortfalls due to R&R, emergency leaves and other unforeseen restrictions."

11 Ref: Attachment 1 – Pricing Workbook

The sum formulas for TOTAL CLIN 0002 (row 10) appear to include the amounts from CLIN 0001.

Will the Government please revise the spreadsheet to exclude the CLIN 0001 pricing from the CLIN 0002 totals? Refer to the updated Attachment 1 ‐ Pricing Workbook provided in Amendment 0009.

12 Ref: Attachment 1 – Pricing Workbook

The sum formulas for TOTAL CLIN 0003 (row 13) appear to exclude pricing of CLIN 0003 – Security Guards on row 11. Will the Government please revise the spreadsheet to include the pricing of CLIN 0003 – Security Guards within the CLIN 0003 totals? Refer to the updated Attachment 1 ‐ Pricing Workbook provided in Amendment 0009.

13 Ref: Attachment 1 – Pricing Workbook

Will the Government confirm that the “Each” unit of measure included for CLIN 0007 – DBA, as well as the offeror’s proposed unit price, is intended to cover the total DBA costs for the entire proposed workforce? Refer to the updated Attachment 1 ‐ Pricing Workbook provided in Amendment 0009.

14 Attachment 1 – Pricing Workbook & RFP pg. 9

The total number of personnel contained within the Pricing Workbook does not appear to match the total number of personnel identified in Table 1 of the solicitation (pg. 9). Table 1 of the solicitation shows a total of 414 personnel, but the personnel numbers in the Pricing Workbook total 411. The difference is an additional 3 Shift Supervisors (Armed) included in Table 1 of the solicitation document. Will the Government confirm which personnel total is correct? Refer to the updated Attachment 1 ‐ Pricing Workbook provided in Amendment 0009.

Page 26, Para 4.5 and Page 21, Para 3.2.4

Para 4.5 states that only one vehicle is required, while Para 3.2.4 states that the contractor is responsible for the movement of personnel. There is no site visit so bidding contractors have no way of ascertaining what the vehicle requirements are, and rely on the Government to specify requirements. Can the Government confirm that only one vehicle is required. What specification is that vehicle (SUV, truck, bus for 40 pax etc)

In accordance with PWS paragraph 3.2.4. ‐ 3.2.4. INTRA‐INSTALLATION TRANSPORTATION, "The Government will not provide the Contractor and its personnel with any transportation assets to accommodate the movement of personnel."

In accordance with PWS paragraph 4.5. ‐ CONTRACTOR FURNISHED VEHICLE, MAINTENANCE AND ESCORT, "The Contractor shall provide and maintain vehicles at their expense. The Contractor shall be required to provide one (1) vehicle for transportation to and from the installation (Entry Control Point) to pick up and drop off Security Service employees as required."

25 License

Good morning ladies my name is XXXXXXXXXX the CEO/ Owner of XXXXXXXXX and I'm email you today to challenge the qualification that the Contracting Officer has published for any company to qualify for this security contracts. I read the Status of Forces agreement between the United States of America and the Aghan Government and it says nothing in that agreement about U.S Contractors needing Private Security Contract license to operate on U.S Contracts in Afghanistan. I have included below the qualification that has been posted to FBO on every security contract for your review. The agreement states that U.S Contractors don"t even need a license from the MOI as long as they are in country in support the U.S Military Operation nor does the Afghan Government issue any Arming Authority to Contractors that is issued by the U.S Commanders on the ground. The requirement per the agreement U.S Contractors in country to support the U.S Military only have to report to the Army via the SPOT reporting portal. Basically every qualification that the Contracting Office has published is incorrect. I would like an answer to my inquiry by the Contracting Officer we would like to hear from your office before we move up the Chain of Command of the U.S Military. Thank you for your time and we look forward to your reply.

Concerns were raised as to the need for companies proposing on W91B4N‐18‐Q‐2002 to possess private security company (PSC) licenses in order to perform the subject contract. Possession of a PSC license is required.

The Bilateral Security Agreement [BSA] between the United States and The Government Islamic Republic of Afghanistan (GIRoA), as well as the Status of Forces Agreement [SOFA] between the North Atlantic Treaty Organization and GIRoA both acknowledge that, U.S/NATO contractors are subject to registration in Afghanistan. BSA, Art. 11, para. 2; SOFA, Art. 9, para. 2. While both the BSA and SOFA provide “[U.S./NATO] contractors shall otherwise be exempt from all other Afghan licenses and similar requirements in relation to their entry into or execution of contracts and subcontracts with or on behalf of [U.S./NATO] Forces." BSA, Art. 11, para. 2; SOFA, Art. 9, para. 2. Both documents clearly indicate that, “[U.S./NATO] Contractors performing security services in Afghanistan are subject to all relevant requirements of Afghan laws and regulations.”

BSA, Art. 14, para. 3; SOFA, Art. 12, para. 3. This includes those requirements established in “Procedure for Regulating Activities of Private Security Companies in Afghanistan”, published February 2008 by the Ministry of Interior, requiring that private security companies will be licensed and registered. This is reinforced by Presidential Decree 66 [PD66], Concerning the Authorization of Security Contracts with Private Security Companies, which states “the Ministry of Interior is tasked to take measures concerning the issuance and renewal of the licenses for the limited Private Security Companies listed and approved by the Ministry of Interior, based on related laws and procedures.” PD66, Art. 1, para. 6.

The requirement that Private Security Contractors and their employees follow Afghan law includes, when appropriate, PSC’s seeking and receiving individual Afghan Weapons Permits for each armed employee from the Ministry of Interior.

Thus, all provisions of Solicitation # W91B4N‐18‐Q‐2002 requiring the licensing and registration of offerors as PSCs in order to perform the solicited work are correct. Offerors will be required to be licensed as PSCs in order to receive award.

26 Security Clearance

Good morning Anna I know the question and answer time for this contract offering has pasted but I wanted to bring this to your attention hopefully you can get me an answer from the Contracting Officer. Anna if you look below I have included a clause out of the contract concerning the secret Facility Clearance it states that the bidding company must have a Clearance in place from DSS office if my memory service me correctly DSS is a Department of State Office for Security Operation. I was the Recruiter for the XXXXXX from 2004 to 2006 at XXXXXX plus 20 years in the United States Marines. The experience of being in the security field and in the position to process personnel for the XXXXXX every person that was hired with DOD clearance had to be flipped to a DOS clearance.

This tells me that one your going to award this contract to a company working a DOS contract and flip there clearance to a DOD clearance. This will be an unauthorized action because according to the change of the clearance rules no prior clearance can be used to secure a contract from another Agency within the U.S Government. This means the Contracting Officer will submit the awarded company DD254 to get a clearance from DOD to be authorize to work the contract that is how this process should work I only know this from working with clearance with DOS. I also know that British companies are bidding on this contract and to my knowledge of clearances only America Companies can be issued a Facility Clearance. Anna I hope you can answer this question for me or someone in your chain of command but being a retired Marine I will request General Mattis help to get answers to this question I have presented to you today. I.m sure the General would love to help out the Gunny I look forward to your reply.

4.4. SECRET FACILITY CLEARANCE. The contractor shall possess and maintain a SECRET facility clearance from the Defense Security Service. The Contractor’s employees at paragraphs 4.1.7, 4.1.8,

4.1.10 and 4.1.11, performing work in support of this contract shall have been granted a SECRET security clearance from the Defense Industrial Security Clearance Office. The DD 254 is provided as Attachment AD0005

Please note that Defense Security Services (DSS) is not primarily a Department of State office, rather DSS supports the U.S. Department of Defense. Furthermore, everyone that is hired with a DOD clearance does not have to be flipped to a DOS clearance. Refer to Solicitation Amendment 0009 for the updated PWS paragprah 1.21. ‐ SECURITY REQUIREMENTS that states, "Contractor personnel performing work under this contract at the identified at paragraphs 4.1.7, 4.1.8, 4.1.10 and 4.1.11 shall have a Secret clearance or Secret REL / NATO clearance at time of the proposal submission, and must maintain the level of security required for the life of the contract."

27 License

The Government will not accept offers from offerors whose AISA license is in an industry classification unrelated to security contracting."

28 Joint Venture

The Government will not accept offers from offerors whose AISA license is in an industry classification unrelated to security contracting."

29 General is there any possibility to extend the deadline period Please refer to the Federal Business Opportunities website for the posted Amendments.

30 License can we bid on this contract if we have only AISA lisence?

Yes; in accordance with Solicitation, Addendum 52.212‐1 Paragraph 1, "Offerors responding to this solicitation shall submit a valid and current Afghanistan Investment Support Agency (AISA) (or equivalent) Business license and PSC license at the time of proposal submission including those of any subcontractor. The Government will not accept offers from offerors whose AISA license is in an industry classification unrelated to security contracting."

RFP/Page 9; Attachment_1__‐_Pricing_Workbook / Schedule B

The staffing total required by the Schedule B and Attachment 1 is 411 while the total staffing in the RFP on page 9 requires 414. It appears there are three (3) Shift Supervisors (Armed)(FVEY EXPATS Only) contained in this table on page 9 which are not included within the Schedule B or Attachment 1 personnel numbers. Please clarify which reference contains the correct number of required personnel. Refer to the updated Attachment 1 ‐ Pricing Workbook provided in Amendment 0009.

32 FBO FBO shows an amendment dated 9 March, but there isn’t any document posted. This appears to be a system error; there was no posting in reference to solicitation W91B4N‐18‐Q‐2002 on 09 March 2018.

33 General

The SF 1449 says this is an RFQ but you are asking for RFP‐type input (e.g., technical proposal of 20 pages).

In accordance with ADDENDUM TO FAR 52.212‐2, para 1 ‐ Basis for award "This will be a lowest price technically acceptable (LPTA) source selection conducted in accordance with (IAW)FAR Part 12, Acquisition of Commercial Items, and FAR Part 15.101‐2, Lowest Price Technically Acceptable Source Selection Process, as supplemented by the DFARS and the AFARS."

34 General The due date is not achievable with the degree of information that you are requesting as RFP. Refer to the Federal Business Opportunities website for the posted Amendments for extension of proposal submisison.

35 General

If possible, please provide the current contract number.

Or, is this a new requirement for the government? The current requirement is being performed in accordance with the Performance Work Statement under contract W52P1J‐16‐C‐

5010.

37 Attachment 1 ‐ Pricing Workbook

Cell E13 is supposed to be the total of CLIN 0003, however, it is only calculating from Cell E12. It is not calculating any of the data in Cell E11, and Cell E11 is not set up as "Currency", it is set up as "General". Please Advise. Refer to the updated Attachment 1 ‐ Pricing Workbook provided in Amendment 0009.

38 Attachment 1 ‐ Pricing Workbook

The PWS staffing table, para 1.2 Scope of Work, page 9 of 102, specifies 414 total personnel.

Attachment_1__‐_Pricing_Workbook (4).xlsx calls for pricing only 411 total personnel.

It appears to OTTS that the PWS staffing table represents the intended staffing solution. We respectfully request that the pricing spreadsheet be updated to include 414 total personnel to match the PWS staffing table.

Refer to Solicitation Amendment 0009 for the updated PWS paragprah 1.3 ‐ SCOPE OF WORK that states, "The PWS requires 329 personnel as identified in Table 1 below:." Refer to the updated Attachment 1 ‐ Pricing Workbook provided in Amendment 0009.

Clause 5152.225‐5908 ‐ Government Furnioshed Contractor Support.

Page 97 5152.225‐5908 GOVERNMENT FURNISHED CONTRACTOR SUPPORT (JUN 2015) Indicates DFAC authorized for LNs.

Page 21 3.2.3. DINING FACILITIES AND WATER says that LNs "...shall not be permitted to eat in any of the U.S. Government dining facilities, unless specifically authorized by the Contracting Officer."

Request clarification as soon as possible as that is a major cost driver.

Clause 5152.225‐5908 ‐ GOVERNMENT FURNISHED CONTRACTOR SUPPORT remains unchanged for Local National (LN) Employees. Though LNs shall not be permitted to eat in any of the U.S Government dining facilities, unless specifically authorized by the Contracting Officer, LNs are authorized “Government Furnished Meals” (GFM) at no cost to the contractor that will include MREs or to‐go plates from the DFAC. Clause 5152.225‐5908 ‐ GOVERNMENT FURNISHED CONTRACTOR SUPPORT states if "GFM" is checked, “DFAC” must also be checked.

41 Attachment 1 ‐ Pricing Workbook There is an error in your pricing template. CLIN 2 pricing includes CLIN 1 and then multiples it by 10.

Please advise. Refer to the updated Attachment 1 ‐ Pricing Workbook provided in Amendment 0009.

File details come from the government source that posted it.
