ERDC Control No. 17-0244
LIMITED SOURCES JUSTIFICATION
(BRAND NAME ITEM)
(FAR Part 13 – Simplified Acquisition Procedures)
1. Agency/Contracting Activity: Engineer Research and Development Center – Construction Engineering Research Laboratory (ERDC – CERL)
2. Description of Action:
Nature: New Requirement Follow-On Requirement Mod to Existing Purchase Order/Contract Number
Pricing: Firm-Fixed Price Time and Materials
Funds: OMA Other Funds: 21 x 2040
3. Description of Supplies/Services:
a. The total estimated dollar value of the proposed action is $83,000.00.
b. The acquisition is for the procurement of a Geodetics brand name LiDAR package for a
UAS.
4. Authority: FAR 13.106-1(b)(1) For purchases not exceeding the simplified acquisition threshold contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization).
5. Reason for Authority Cited: ERDC-CERL procured Light Detection and Ranging (LiDAR) package for use on an Unmanned Aircraft System in May 2017. During said procurement, two sources were identified which could meet the technical requirement of the LiDAR package.
Since delivery, the Geodetics Geo-MMS LiDAR package has proven to be very useful for surveying and 3D modeling. The upcoming robotics program will benefit from the use of an additional aerial LiDAR package. Given the need of an identical package as a backup and associated software is in currently used by CERL researchers, it has been determined that there is a bona fide need to procure an identical LiDAR package. Furthermore, CERL received training and software as a deliverable from the previous procurement which will not be needed with the purchase of an identical LiDAR package.
6. Actions to Increase Competition: Market Research has been conducted by discussion with potential sources, as well as through a previous procurement. Two HUBzone contractors expressed interest and confirmed that they could fulfill the requirement. A combined synopsis/solicitation will be posted to FedBizOpps using a HubZone set-aside.
7. Market Research: Reference Attached Market Research Form.
