SECTION SF 30 BLOCK 14 CONTINUATION PAGE

SUMMARY OF CHANGES

SECTION SF 30 - BLOCK 14 CONTINUATION PAGE

The following have been added by full text:

Q1: The government appears to initially state it will conduct a pre‐dredge survey. However, it then qualifies this general statement by noting it may use its pre‐existing specification survey as a pre‐dredge survey of record, but only for non‐dynamic areas, even if the specification survey is over 180 days old. Is this a correct reading of the relevant terms?

Response: Yes, this is correct. However there are no non‐dynamic areas in this project.

Q2: If so, then please define, using specific coordinates if possible, what areas within the specified dredge prism the government regards as non‐dynamic within the meaning of this language.

Response: There are no non‐dynamic areas in the dredge area.

Q3: We also read the pre‐dredge section of the specifications as indicating it is left to the contractor to do its own pre‐dredge survey at its option and to alert the government of any discrepancy between the contractor's pre‐ dredge survey and the government's survey. Is this correct?

Response: Yes, this is correct.

Q4: If so, then how will the government resolve discrepancies brought to its attention by the contractor? By what standard?

Response: Discrepancies will be handled on a case by case basis after comparing the two surveys.

Q5: Please clarify the apparent ambiguity in the Definitive Responsibility Criterion which states: "Bidders are not required to submit additional documentation related to this criterion at the time of bid, however the apparent awardee shall submit documentation that they meet the above definitive responsibility criterion to the Government by close of business the day of the bid opening to support the responsibility determination." Is the submission of this information a determination of responsiveness? Please clarify the above, as the statement of "… documentation related to the definitive responsibility criterion will be considered a matter of responsibility, not responsiveness…" appears to be a distinction without a difference.

Response: The apparent low bidder shall submit documentation that they meet the above definitive responsibility criterion to the Government by close of business the day of the bid opening to support the responsibility determination. This is a matter of responsibility per FAR 9.104‐2, not responsiveness per

FAR 14..

Q6: Relative to Bid Item Note 3: Please clarify what the Government is referring to when it references "basic requirements" as this term doesn't appear anywhere else in the solicitation or specification.

Response: The term “basic requirement” in Note 3 on page 4 of the solicitation refers to Bid Items 0001 thru 0003

W912WJ-17-B-0015

Q7: Relative to Note 5: How does this notification of descending importance of additive items affect the contractor?

Response: Additive Bid Items are listed in order of priority to comply with DFARS clause 252.236‐7007 and allow for the proper evaluation of additive items to determine the low offeror.

Q8: Relative to Note 10: The specification indicates that the "turbidity curtain shall be suspended no more than 6" from the harbor bottom at high tide & Silt curtain shall be elevated above the harbor bottom before moving as to not drag the curtain across the beds, inducing turbidity." (Sec. 01 57 20 Pg. 8) Given this restriction, dredge movement will be limited to one location per tide cycle due to the prohibition of dragging the turbidity curtain across the bottom. This also creates a different problem when addressing the cut face of the dredge area which varies greatly from the areas yet to be dredged, as the contractor would have to swap in and replace various sections of the curtain in order to maintain this standard. How does the Government expect the contractor to maintain the required production rate while maintaining this extra standard?

Response: The requirement to have the turbidity curtain suspended no more than 6” from the bottom is to facilitate containment of a dredge induced plume at the bottom of the water column. The Turbidity curtain is allowed to come to rest on the bottom between tide cycles during dredging operations, including the area of the cut face. A significant length (2000 feet) of turbidity curtain has been included in CLIN 0004 to allow the contractor the option to set up a substantially large footprint of turbidity curtain in which to make multiple dredge movements. The Contractor will be permitted to enclose the entire dredge area that remains to be dredged after January 31, 2018.

Q9: Request for the Definitive Responsibility Criteria for this project be waived or modified in the final amendment.

Response: The Definitive Responsibility Criteria for this project will not be waived or modified.

Q10: Will the USACE consider adjusting the performance requirements of the project by allowing the construction of the work to occur in the 2018 dredging window?

Response: No, the dredging window will not be adjusted.
