QUESTIONS FROM INDUSTRY

1. Question: Does the offeror/vendor need to have a “proof of German authorization”/”proof of authorization to operate in Germany”?

Answer: Contractor should follow all host nation laws in regards to working. See the Installation Clearance Requirements in the Addendum of the solicitation.

Based on the updated PWS page 20 of 37 paragraph 1.24 Authorization to Perform Services in Germany, it states:

1.24.1 Contractors performing services in the Federal Republic of Germany (FRG) shall comply with German law. The Contractor shall determine whether performance requires registration with German authorities or authorization to do business in Germany and, if so, shall comply with all requirements.

Whether or not registration or authorization to do business is required, the Contractor shall determine what documents or authorization its employees and any subcontractor employees must possess to work in Germany. The Contractor shall ensure affirmatively that its employees and subcontractor employees possess such documents or authorizations.

- I would like to clarify, offeror/vendor that we are referring is our company, do our company need a proof of German authorization”/”proof of authorization to operate in Germany”?

- Do our company need current Germany business registration, license, to legally operate and employ personnel within Germany.

Answer: The contractor has to determine what requirements it has to fill in regards to the host nation laws. All that is required to be submitted to the Contracting Office with the quote is outlined in the solicitation. Though the solicitation does not request any documents to be submitted in regards to proof of authorization to do business in Germany, it is up to the Contractor to determine whether performance requires registration with German authorities or authorization to do business in Germany and, if so, shall comply with all requirements.

2. Question:

Question #1: Is the required initial and refresher training considered work and can it be performed during normal duty hours? Required initial and refresher trainings can be completed during normal duty hours. Back up personnel needs to come to the office one time within 30 days to keep the account active. Onboarding does require to come to the office multiple times for one (1) or two (2) hours to complete onboarding procedures (MILCONNECT, ICAM, ATCTS).

- Based on the answer " Back up personnel needs to come to the office one time within 30 days to keep the account active." Based on PWS page 12 of 37 paragraph 1.5 General Information, it states:

This contract is inclusive of one (1) full-time contractor.

Please confirm, how many resume(s) are required to submit along with the proposal.

Answer: Two resumes are required to be submitted (one for the full time employee and one for the backup employee)
